Harry Roque umalma sa report ng Inquirer

Members of the Bayan-USA and US-based human rights groups held a rally at a New York City restaurant on Friday night (Saturday morning in Manila) to oppose presidential spokesperson Harry Roque’s nomination to the International Law Commission (ILC).

The protesters went to the upscale Manhattan eatery Aretsky’s Patroon “to expose the blood on Roque’s hands as the spokesperson for Duterte’s fascist regime and reject his nomination to the UN International Law Commission,” according to a Facebook post from Bayan-USA.

During the rally, the protesters shouted “Roque out of ILC, Roque out of NYC!” and “No Justice, No peace! Stop the killings in the Philippines!”

Roque, in a statement, condemned the action of the protesters.

“We deplore the effort of militant groups to deliberately cause harm to innocent people in their attempt to disrupt a private reception we were tendering for representatives of several foreign missions in New York,” he said.

“The militant groups were not content to peacefully rally outside the restaurant, they charged upstairs, in the process injuring two elderly waiters, and causing damage to property. The restaurant also informed us that the rallyists ordered food and beverage but did not pay for them,” added Roque.

The son of the late democracy icons Ninoy and Cory Aquino, former President Benigno Aquino III, has died after being rushed to the Capitol Medical Center.

The whole Philippines woke up to a sad morning today, June 24, after the news broke out that former President Benigno “Noynoy” Aquino III was rushed to the Capitol Medical Center in Quezon City.

It was later confirmed by Super Radyo DZBB and several news agencies that the 15th President of the Republic of the Philippines had already died at the age of 61.

According to dzBB reporter Allan Gatus, some of the personalities spotted in the Capitol Medical Center were Noynoy’s sister Kris Aquino, former Senator Mar Roxas, and former Secretary Rene Almendras.

The death of Pnoy shocked social media with the hashtag RIP PNoy quickly reaching the top spot of trending topics on Twitter Philippines.

The late President Aquino is the son of the late democracy icons former Senator Benigno “Ninoy” Aquino, Jr. and former President Corazon “Cory” Aquino.

He is survived by his Ballsy, Pinky, Viel, and TV host-actress Kris Aquino.

As of writing, the Aquino family has yet to release an official statement about the cause of death of their dearest Noynoy. (GMA News)

Mayor Sara handa sa ENGWENTRO kontra Robredo, ‘Stop Politicking!’

Davao City Mayor Sara Duterte fired back at Vice President Leni Robredo over the latter’s statement on the city’s surging coronavirus cases, seeing this as “politicking” for the 2022 presidential election.

“The Vice President should refrain from giving advice if she knows nothing about what is happening on the ground,” Duterte said in a statement issued Monday.

A day earlier, Robredo in her weekly radio show advised the city government of Davao to study the approach of Cebu City in handling its COVID-19 situation, which involves not just the local government, but also a “very active” medical community.

Robredo also pointed out that Quezon City has a larger population than Davao City, and yet the latter topped the list of LGUs with most new cases per day, based on data from the OCTA Research Group, covering the June 5 to 11 period.

Duterte defended Davao City’s efforts to combat the pandemic, stressing Robredo “lacks understanding and knowledge on and does not offer anything helpful to solve a problem.”

The mayor said they have long been working closely with the private sector to boost Davao City’s COVID-19 response.

“In addition, The VP should not attack the medical community of Davao City as being inactive when they have been silently suffering and working tirelessly to help save lives since March of last year,” Duterte said.

“The VP should avoid involving the Covid-19 surge in Davao City in her attempt at politicking. There will be a proper time to attack my performance as an LCE (local chief executive) in this pandemic if she dares to run for President,” she added.

The procurement and eventually the use of body cameras is a tribute not only to Kian delos Santos who died of police abuse in Caloocan City, but also to the policemen whose ultimate sacrifice in the line of duty were tainted by extrajudicial killings, planting of evidence and other unfair allegations.

Ito pong mga body worn camera natin na matagal na nating pinag-uusapan, bagamat ito ay hindi sapat sa lahat ng ating police stations, gusto po namin ito’y simulan na.

In our case, ito pong mga normal patrolling dadalhin din po natin yan. So each city police station was given units nitong body cam which could be used, maximize the use of this, in the conduct of not just operations but regular patrolling.

Kaya sinabihan ko sila na dapat huwag nating gawin iyon sapagkat bansa ang nauukol dito. Nagkaroon ng mediation. Ngayon, ang mediator pala doon ay ang Amerika. Ang question ngayon na hindi ko masagot at hanggang ngayon hindi ko alam kung sino ang humingi ng tulong ng Amerika, ang Amerika ang nagmediate. Nagkaroon ng kasunduan dahil sa mediation ng Amerika na umatras bawat Tsina at Pilipinas doon area ng Scarborough.

Sinunod ng Pilipinas ‘yong kasunduan sa ilalim ng mediation ng Amerika pero ang Tsina ay hindi sumunod. Ngayon ang question ko, kung ang Amerika ang naging mediator, unang question: sino ang humingi ng tulong ng Amerika? Pangalawa, bakit noong hindi tinupad ng Tsina ang kasunduan na umatras din siya, bakit hindi man lang pinagsabihan ng Amerika ang Tsina na tuparin niya ‘yong kasunduan? Ang impression kumbaga eh parang ginamit lang tayo doon sa bagay na ‘yon, ano man na interest ang nauukol para sa Amerika, eh hindi ko alam pero ganoon ang impresyon ko. Hanggang ngayon hindi ko masagot kung bakit ‘yong mediator natin ay hindi tayo tinulungan para tumupad naman ang Tsina para doon sa kasunduan na umatras sila kaya ngayon sila ang nakapuwesto doon, tayo nawala. Iyan po ang natatandaan ko na pangyayari diyan sa problema ng tinatawag natin na Panatag, isla ng Panatag.

PRESIDENT DUTERTE: Senator, I would like the people to know you have given us really the almost the foundation of your talk tonight and probably your answers na bakit pumayag ang Pilipinas na umatras tayo? I would like to know if you know what drove Aquino to reach that decision to order the Navy to retreat?

FORMER SENATE PRESIDENT ENRILE: Iyon daw ang kasunduan na natamo ng dalawang panig sa ilalim ng mediation ng Amerika, Mr. President. Kaya dapat siguro si Albert del Rosario malaman sa kanya kung sino ba ang — bilang Secretary of Foreign Affairs noon, sino ba’ng humingi ng tulong ng Amerika? Si Ambassador Cuisia ba na siya ang ambassador ng Pilipinas sa Washington noon o ang mismong Palasyo, si Presidente Aquino? Hindi natin alam eh. Ngayon, dahil doon sa pangyayaring ‘yon eh nagkakuwan tayo, nalugi tayo dahil umatras tayo, eh ang Tsina hindi nila mapaalis doon sa lugar na ‘yon.

PRESIDENT DUTERTE: This is really my — the dilemma of the nation. For me, sir, the beginning of this problem was when we retreated. And since then, iyong mga paperwork about the arbitral award has become meaningless and the opposite camp of the political side ay nasabi that I should do my very best in asking the UN.

Palagay ko kahit na may resolusyon ang UN eh hindi naman maipapatupad ng UN ‘yong resolution nila wala silang police force eh.

Wala namang world government na kagaya ng istraktura natin sa ating bansa. Mayroon tayong hukuman, mayroon tayong pulis. Eh kung mayroong kailangan na usapin tungkol sa hustisya, magpupunta ka sa hukom. Hindi ganyan sa level ng mga bansa. Sa level ng mga bansa eh ang nananatili diyan eh kung ano ang kakayahan mo kontra sa kabila, iyon lang. It is a — what operates in the level of nations, Mr. President, is what they call the law of nature, the law of force and nothing more. That is international law.

PRESIDENT DUTERTE: That is what I’ve been telling at least our countrymen. I was frank enough in the early days and I said that might makes it right. And we are not unfortunately on the side of might so we cannot do anything because we cannot be in parity in force and in all so we have to talk, just talk and talk until such time, by the grace of God, if there is an opportune time for all of these things to correct itself maybe. Ang ano ko, sir, kasi ako ‘yong sinisisi nila na bakit ko raw — I will not forcefully do everything to go to the United Nations to ask the body for help? One, is that I am a realist, sir. And if this question is as big as the Philippine — West Philippine Sea, this will eventually reach the Security Council.

FORMER SENATE PRESIDENT ENRILE: Mr. President, on the first place, you were elected by the Filipino people to be the leader of this country. Nobody else can frame the foreign policy of the country except the president of this country. That is true to us and true to other countries. Not even the Supreme Court can interfere with your foreign policy. That’s the highest political act of a president. And I wonder why people keep talking without understanding this system. No one else can frame or formulate the foreign policy of the Philippines except President Rodrigo Roa Duterte.

PRESIDENT DUTERTE: That’s what —

FORMER SENATE PRESIDENT ENRILE: Not Carpio, Albert Del Rosario or Juan Ponce Enrile. There is only one person, that’s the President of the Philippines.

PRESIDENT DUTERTE: That’s what I’ve been telling them, sir, what could be more genuine to a title, to a right, to a claim, than the paper itself of the arbitration?

FORMER SENATE PRESIDENT ENRILE: Our claim springs from the UNCLOS, Mr. President. It was simply interpreted by the arbitral body in accordance with the dictum of UNCLOS. Of course, apart from UNCLOS, earlier we got involved in the West Philippine Sea because of the discovery of Tomas Cloma during the regime of President Carlos P. Garcia; and that discovery during the presidency of Carlos Garcia, nothing was done about it; and also during the time of Dadong Macapagal as President of the Philippines because they were busy about something else in the country. And during the time of President Marcos, Cloma ceded his rights over Freedomland, that was the name given to that area by Cloma, to the Republic of the Philippines.

That was the first source of our claim to the area. Then UNCLOS came and it was expanded into a greater area because the UNCLOS gave us exclusive economic rights, what we call in civil law, usufructuary right over a — an area of a body of water including its bottom and all the fishes — fish and wealth that you can discover there, exclusive economic right for our country. But that is on the — on the ti — on the assumption that we can protect it and a president of the Philippines, as a person without a strong Navy and Air Force cannot enforce that right no matter what you — how much you want to enforce it. In the same way, UN can issue a resolution but they cannot enforce it.

PRESIDENT DUTERTE: Yes, sir. That’s right. And I said I was quite a bit [scathed?] about their insistence to go back to the United Council. Even if they result into a maybe not a shooting war but a critical issue of security for the world and for everybody, eventually it would reach the Security Council. The Security Council has five permanent members. Two of them are allies: China and Russia. Each one has a veto power. I said if I started a violence now, I said UN will intervene and the Security Council: America, China, Britain, France and the United States.

FORMER SENATE PRESIDENT ENRILE: Mr. President…

PRESIDENT DUTERTE: Eh wala…

FORMER SENATE PRESIDENT ENRILE: You are only — you are answerable only to history for your foreign policy.

PRESIDENT DUTERTE: Yes, sir.

FORMER SENATE PRESIDENT ENRILE: Only history will judge you. And I think that history will judge you very well. If I were in your place, I would have — I would have done the same thing. What else can a President of this country do under our present national circumstance? You can shout, you can beat your breast, you can raise your fist. Without any backup, it’s just — that is just noise.

PRESIDENT DUTERTE: Sir, in the early days of my administration, I announced a change of the direction of our foreign policy from being proWestern to just neutral, just playing it safe in the meantime because it — there might be really a trouble brewing. So nandito lang ho ako sa gitna.

That’s the reason why I went to China and I was prudent enough to bring along my Cabinet members at that time, early days, some of them are now here, mga — ‘yong mga military, sir, General Año was then a general — the chief of staff; Delfin Lorenzana, Secretary Lorenzana was my DND; pati marami — maraming — Esperon was there, sir, so just to make sure. And pointedly, I said to President Xi Jinping, in front of everybody, two panels opposite of each other, sabi ko, “Mr. President…,” there was a long discussion, but I said, “Mr. President, I know that we have conflicting claims but, you know, I have plans of going to the West Philippine Sea to dig my oil.”

Pagkatapos, sir, ang sagot ni President Xi Jinping, almost in whisper, parang ganito, sir, magkaharap, sabi niya, in front of the witnesses that I brought along just to make sure that I will be correct all the time, be prudent about it, sabi ko, “Mag-dig ako ng oil.” Sabi niya, in whisper, “You know, Mr. President, please do not do that. Please do not do that. You will just sour up our, you know, we have a new beginning here, new friendship found, but if you do that…,” he said in — almost whisper, “…there will be trouble.”

FORMER SENATE PRESIDENT ENRILE: Sa totoo lang, Mr. President, ito ay sinasabi ko hindi dahil ako ay anti-American, hindi — ako po ay kuwan, hindi anti-American, sa mga Amerikano, marami akong kaibigan at mayroon akong apo na Amerikana. Ngayon, iba ‘yong mga — mga American citizens sa kanilang gobyerno eh. Sa kanila, ‘yong gobyerno nila, national interest palagi ang pinagbabatayan nila ng galaw nila sa larangan ng relasyon ng mga bansa.

Sa totoo lang sa karanasan ko bilang Secretary of National Defense noong panahon ni Presidente Marcos, hindi natin maaasahan ang Amerika sa mga ganitong usapin. Noong Secretary of Defense ako po, noong kasagsagan ng Vietnam war ng Amerika, humihingi kami ng delivery ng Amerika ng 2,500 Armalites, 2,500 na Armalites lang po ang kailangan namin noon para labanan namin ang mga nanggugulo sa ating bansa dito sa Luzon at ganoon din sa Mindanao. Sapagkat noon ang mga baril lang namin ay Carbine at Garand. At ang aming puwersa noon ay 48,000 lang po ang kabuuan ng sundalo natin.

Nandiyan na ang PC, nandiyan na ang Air Force, nandiyan na ang Army, nandiyan na ang Navy, nandiyan na ang Coast Guard. Ngayon, pumunta kami ni Presidente Marcos doon sa Clark Field, isang araw, tanghali ‘yon, dahil dumating ‘yong si Admiral Gaylord ng Seventh Fleet na naka-base sa Hawaii at hinihingi namin ang delivery ng 2,500 na Armalite para sa militar natin. Eh sabi niya sa akin, “Low priority kayo sapagkat kailangan namin ng baril sa Vietnam.” Sabi namin, “Eh mayroon kaming problema dito eh, kailangan namin ang ipinangako ninyo.” Sa madaling salita po, hindi kami nakakuha. Kaya dahil doon sa karanasan na ‘yon, bilang sekretaryo ng — kalihim ng Department of Defense noong mga panahon na ‘yon, sinabi — minungkahi ko kay Presidente Marcos, kung ganito ang trato sa atin ng Amerika, nandito ang base militar nila, may kasunduan tayo under the Mutual Defense Treaty, hindi tayo matulungan sa 2,500 Armalite, mabuti pa bumili na rin tayo ng baril natin, pagbayarin natin sila ng renta sa base militar nila at ‘yong renta nila ang ipamili natin.

Huwag na tayong aasa na ibibigay nila sa atin. At dahil doon ang ginawa ko para magkaroon kami — tayo ng baril, kinausap ko si Dr. Goh Keng Swee ng Singapore, he was my counterpart. He was the minister of Defence — Defence Minister of Singapore mayroon silang Colt factory doon noong araw, humingi ako ng baril sa kanya. Nakakuha kami nung mga old model ng colt. Wala pa ‘yong kagaya nung mga Armalite ngayon, noon ay mayroong binobomba para kung nag-i — nag-i-stoppage ‘yong mga baril. We were able to get 10,000 pieces of long arms from Singapore and I got the ammunition from Taiwan. Kaibigan ko si General Wei-kuo, kapatid ni Chiang Ching-kuo, he was the head of the arsenal of Taiwan and I was able to get the bullets from him.

Kaya ang kapalit naman no’n na binigay namin sa Singapore na pabor ay nag-istasyon sila ng isang squadron ng kanilang Air Force dito sa Clark natin at for training purposes kaya na — naagapan namin ang seguridad ng bansa dito sa Luzon at sa Mindanao noong mga panahon na iyon. Kaya kung aasa tayo sa tulong ng Amerika, lalo na ngayon, magulo sila sa Amerika at marami silang problema. Nandiyan ang problema sa Gaza, at Israel, at Palestine ngayon ganoon din umaalma ang Russia.

Eh palagay ko kahit na pupunta tayo sa UN, mag-i-issue ng resolusyon ang UN, eh aasahan ng UN na magpapairal no’n eh Amerika din o ‘yong may mga kakayahan. At palagay ko sa panahon na ito ay walang bansa na puwedeng makaya ang Tsina. Kaya tama ‘yong posture ninyo na kausapin ang Tsina dito sa bagay na ito. Huwag gagamitin ang emosyon at init ng ulo.

PRESIDENT DUTERTE: Yes, sir. I would like to explain to the nation that sometimes I must be — I must admit that I am harsh with my words. That is my nature and I cannot change it at this time. Gusto nilang ipasa sa akin ‘yong — to attribute to me against me ‘yong pagkakamali nila.

FORMER SENATE PRESIDENT ENRILE: Siguro kailangan malaman natin kung si — saan ba nanggaling ‘yong koneksyon ni Trillanes sa Beijing? Paano siya nagkaroon ng koneksyon doon? Ni mismo ako naging guest ako ng Beijing, wala akong koneksyon na kagaya ni Trillanes. Paano siya nagka – — nagkaroon ng koneksyon na ganoon na puwede niyang lapitan ang mga pinuno ng Tsina noong panahon na ‘yon? Pati si Presidente Aquino palagay ko wala siyang ganoong koneksyon. Bakit si Trillanes ay nagkaroon ng koneksyon na ganoon? Iyon ang isang misteryo na hanggang ngayon dapat malaman kung anong kasagutan.

PRESIDENT DUTERTE: You know, I do not demean or belittle our Armed Forces. Ang akin lang, sir, it is really a wonder to me why, of course it’s only President Aquino who can answer this, why he chose a military man to do the backchanneling? And the problem is it was so — so secretive almost a sub rosa type of negotiation that was kept secret. Now, you can name the people do the — you can — we can insist on knowing the people pero ‘yong tataguan mo, sir, iyong anong developments doon and this is really my sixty-four-dollar question to everybody.

FORMER SENATE PRESIDENT ENRILE: The mystery, Mr. President, to me was: Why Trillanes and not someone else?

PRESIDENT DUTERTE: From the milita —

FORMER SENATE PRESIDENT ENRILE: Why?

PRESIDENT DUTERTE: — from the Foreign Service.

FORMER SENATE PRESIDENT ENRILE: Why? Why Trillanes? Of the senators who were incumbent at the time, why was Trillanes selected as the negotiator for Aquino? And where did Trillanes get the influence over some authorities in Beijing in those days?

PRESIDENT DUTERTE: Yes, sir. I understand that —

FORMER SENATE PRESIDENT ENRILE: That is the puzzle to me.

PRESIDENT DUTERTE: — he traveled to China 16 times? And during his last visit, the 16th visit, shortly, sir, two days after, we lost the Scarborough Shoal.

FORMER SENATE PRESIDENT ENRILE: Maybe he should explain to the nation how he got that kind of an influence to be able to reach out to the higher-ups in China. Not just anybody can talk to any member of the Politburo of China. He must have been a very influential person in China to be able to do his work as he did. And how did he acquire that influence? That is a mystery to me, Mr. President.

PRESIDENT DUTERTE: So with me, sir, I would say. So dapat one of these days, maybe the Filipino people should demand the truth.

FORMER SENATE PRESIDENT ENRILE: They should ask.

PRESIDENT DUTERTE: If they cannot get it from the mouth of Trillanes because maybe it would be a self-preservation thing, then at least some people in the Foreign Ministry, especially our ambassador at that time, Ambassador Brady, can explain because as I understand from you earlier, there — she was not allowed by Trillanes to take notes. Alam mo kasi, sir, ganito ‘yan para malaman ng mga taong Pilipino, kagaya ngayon nandito kami, sa likod natin iyon ‘yong mga steno — ‘yong ambassadors pati mga stenographers kumukuha ng record. So maybe I learned from you earlier na Trillanes did not allow him to take notes.

FORMER SENATE PRESIDENT ENRILE: Ang — ang problema kasi diyan, Mr. President, bakit si Trillanes? Pangalawa, bakit binypass (bypass) niya ‘yong embahada natin sa Beijing? At sa impresyon ko, pati si Del Rosario na kalihim ng Foreign Affairs noon ay binypass (bypass) din niya. Walang kamuwang-muwang si kuwan eh — si Del Rosario doon sa meeting na ‘yon na tungkol doon sa pinag-usapan sa Beijing. Ngayon, nasaan na ‘yong sulat naman ni Brady? Dahil binigyan ako ni Del Rosario nung kopya, nawala lang — marami kasi akong record, wala na akong panahon na tumingin doon sa aking mag — maghalungkat doon sa aking mga records. Eh nasa kanya ‘yon, copy lang ‘yong — ‘yong binigay sa akin eh. O, bakit wala sa Department of Foreign Affairs ‘yong kasulatan na ‘yon? Dapat nandoon ‘yon —

PRESIDENT DUTERTE: On files.

FORMER SENATE PRESIDENT ENRILE: — kasi official records ‘yon eh.

PRESIDENT DUTERTE: Yes, sir, correct, sir. Iyon nga ang problema natin. There is a monkey wrench in arriving at the truth and that is really what happened in the negotiations and why — bakit nag-atras tayo? What prompted Aquino or upon whose advice? Because I do not think that President Aquino would just decide on his own when he knows nothing about it even the negotiations. So kung sino — who prompted him to arrive at that decision?

FORMER SENATE PRESIDENT ENRILE: Tayo ang naonse pero ‘yong namagitan between the Philippines and China ay hindi naman niya man lang sinabihan ‘yong Tsina na, hoy, tuparin mo naman ‘yong kasunduan sapagkat ‘yong Pilipinas eh sumunod eh. Bakit hindi ka sumusunod?

Wala eh, walang nangyaring ganoon eh. Unang-una, kung basahin mo ‘yong Mutual Defense Treaty, ang sinasakop lang nung kasunduan natin sa Amerika ay kung may atake sa ating mga fighter planes or ating mga pang barkong pandirigma sa Pasipiko, saka lang puwede nating gamitin ‘yon. Pero ang sinabi ng Amerika sa amin noong pinag-uusapan namin — na namin ‘yong amendment ng Military Bases Agreement, revision ng Military Bases Agreement, si Kissinger mismo ang kinausap ko at saka si Rumsfeld, who was my counterpart, and later on Armitage also when he was here to negotiate for the extension of the military bases, sabi nila ‘yong West Philippine Sea or South China Sea is not a part of the treaty area of the Mutual Defense Treaty. Kung may mangyari sa West Philippine Sea between China and the Philippines, eh hindi natin magagamit iyong Mutual Defense Treaty.

Although ‘pag kausap mo ang mga opisyales ng Amerika, sasabihin nila, “We will help you. We will protect you. We’ll come to your rescue.” But when the nitty-gritty is there, hindi natin maaasahan ‘yan. Kaya dapat kausapin natin ang Amerika kung gusto nilang baguhin ‘yong Mutual Defense Treaty so para kagaya ng NATO, automatic action ang gagawin nila kung talaga na magkaroon tayo ng problema sa mga ibang bansa dito sa ating kapaligiran. Palagay ko hindi sila papayag diyan.

PRESIDENT DUTERTE: I don’t know what, I said, I’m just a few months away from my presidency. But I’m really greatly worried about this situation because there will be a time that we will be looking towards the resources of the South China Sea or the West Philippine Sea. There will be a time that itong oil, gas, and everything, which you said run into billions — I do not have the figures — they might take an interest on that and that is the time when I said that there will be a real problem. Not so much now. I might — maybe keep silent about it.

FORMER SENATE PRESIDENT ENRILE: Alam mo, Mr. President, ang pinag-uusapan natin talaga diyan at ang bottom line dito ay kayamanan eh. Ang kayamanan nandiyan sa West Philippine Sea na ‘yan, according to the best estimate or rather the proven reserves of oil and natural gas sa West Philippine Sea is 9 — 7 billion barrels of crude and 900 trillion cubic feet of natural gas. That’s a very big quantity. That is already proven, it’s there.

Ang estimate ng China, kaya ganyan ang galaw ng Tsina diyan, ay there is a potential of 130 billion barrels of oil in the West Philippine Sea. So with that amount or volume of wealth to be harvested, I doubt whether China will easily bow to anybody without asserting its rights over the area. Apart from the fact that to China, West Philippine Sea is a very strategic route. If that area is closed or controlled by America, Japan, or any other country, China in two months will wither away as a nation.

They will have famine, riots, they will have no economy because 80 percent of their energy passes through the Strait of Malacca through the West Philippine Sea or South China Sea to China. Even Japan will suffer also if that is controlled by someone else. That’s why China is very careful not to antagonize Japan because Japan has the capability. It’s the number two naval power on this planet at the moment, second to America. And they have nuclear capability because the moment China controls the South China Sea, they can isolate South Korea and Taiwan and Japan. So it’s a very delicate balancing effort in this area.

PRESIDENT DUTERTE: Alam mo sir, I really see the problem — a serious problem in our hands. And it’s quite comforting to me na malaman ko na ano ang totoo from your mouth because sabi ko to me you’re the most authoritative — Senate President ka noon eh. Alam mo ito lahat at dapat malaman ng taong-bayan because hindi naman ako… I’m not talking about politics. I’m just talking about the — well, the behavior of some na tini-twist nila.

So it could be just I said they want me to correct what is wrong. Ang problema niyan is the wrong started from them. So ginagawa akong — well, sabi ni Cuisia niloko tayo. Eh kasi loko-loko ka. Bakit nagpaloko kayo? Ito, I hope that we would be able to weather any trouble with China now and in the future for as long as it is very dangerous for us to go into a kind of…

FORMER SENATE PRESIDENT ENRILE: From where I sit, Mr. President, I think you will be able to handle it well in the manner you are doing it now because what do we — we’ll lose more if we antagonize China. We have no choice except to negotiate with China. If assuming that there’s no dispute about our right over exclusive economic exploitation of our West Philippine Sea assets, still we need foreign money to make it a source of wealth for the country.

Now, our choice on that point will be either go to Europe and get technology and capital to exploit — explore and exploit the energy resources of our economic zone in West Philippine Sea or deal directly with China. Chinese one of the best energy explorer now on the planet. In fact, I read some books which says that China now in engineering almost surpassed MIT in the quality of their graduates. So —

PRESIDENT DUTERTE: Massachusetts Institute of Technology.

FORMER SENATE PRESIDENT ENRILE: — they are very advanced already. So I think that… As far as I am concerned, we will not gain anything by antagonizing China. I’m not pro-China. I’m not… I do not have any interest in China. But as a Filipino, I will take this position to protect my countrymen, to protect our core territory, to protect our economy. Maybe we can get better by talking with China instead of being aggressive.

PRESIDENT DUTERTE: I do not know if it was made clear to us at that time but in one of my many visits to China, there was a talk but it was not really translated into a concrete agreement that maybe China and the Philippines can exploit the resources in the seabeds together. I… I was… This was not clear to me at the time. It might be into the present agreements now below. But as an agreement between heads of state, wala akong — there was no guarantee. It’s the companies down below. But you know, when it comes to a matter of the interest of a country, you can always disregard everything down and you have to protect yours first.

FORMER SENATE PRESIDENT ENRILE: Mr. President, China is involved in energy development and production in Africa — in many parts of Africa. I think they are in kuwan — that former colony of Portugal there. [Katrina Ponce Enrile: Ghana?] No, no, no. That’s on the western side of Africa. And then they are also in Nigeria. There have plenty of interests in Africa. Why can’t we not deal with them, with China? We can — we are in this region.

We — realistically, we cannot ignore China. We have to deal with China instead of making China as a foe or irritate China, why don’t we befriend China without surrendering our rights? We befriend China because we are Orientals, we understand each other. Eh ‘yong Malampaya lang hindi natin alam kung totoo ‘yong mga ginagawa ng kasosyo natin doon eh. Eh Dutch ‘yon.

PRESIDENT DUTERTE: Well, maybe I will just ignore my critics.

FORMER SENATE PRESIDENT ENRILE: That’s the best thing, Mr. President.

PRESIDENT DUTERTE: So to not —

Even if we put our entire Navy ships there, we will not start a war because we cannot afford it. I was just being frank to everybody. And China understood us. And that is why there’s not a… I said when I — the pandemic started, I knew right away the problem. The problem is we do not have it. We do not manufacture it. So I called President Xi. The only way for them to get out of the West Philippine Sea is either they go up over Hokkaido and exit in La Pérouse Strait; or they pass through the Strait of Luzon between Taiwan and Batanes; or they pass through — they go south and veer east behind Balabac and pass through the Sulu Sea to the Celebes Sea. That’s why we must never give China a reason to attack our core territory. That’s the —

That’s a period of agony for the country. McArthur abandoned us, and then they wrecked Manila. They destroyed… The Japanese did not destroy Manila, it was destroyed by the Americans.

PRESIDENT DUTERTE: Yes, the heaviest bombing to occur in Southeast Asia at that time when they bombed Manila to rubbles. So I would like to just study very carefully the advent or with the coming of the renegotiation of the Visiting Forces Agreement. Something has got to give. IGNACIO: Second question po ni Kris Jose ng Remate: Komento sa sinabi ng ilang senador na iresponsable raw ang naging pahayag ninyo na hindi sakop ng Exclusive Economic Zone ng Pilipinas ang Julian Felipe Reef dahil nagpapakita lamang daw ito ng pagiging atat ng Palasyo na kumampi sa China, tanong din kung sa China din daw kayo sumasahod?

SEC. ROQUE: Wala pong basehan iyan, kasi nga iyong factual finding na mayroong territorial sea na nadyi-generate ang dalawang high tide elevation ay nanggaling po sa Hague Arbitral Panel. Malinaw na malinaw po iyan kaya ko nga kinowt (quoted) po iyong paragraph ng Arbitral Tribunal Ruling. Namumulitika lang po sila!

SEC. ROQUE: Again, alam ninyo po iyong report na iyan dapat ilagay sa konteksto kasi hindi natin alam exactly kung nasaan sila. Marami pong portions diyan, claim ng ibang mga claimant, bagama’t ang common claimant ay Tsina. Ang dapat tayong mabahala ay iyong mga bapor na naruroon na sa mga lugar na sakop ng ating conflicting claims with China.

So huwag nating problemahin iyong buong West Philippine Sea kasi hindi naman buong West Philippine Sea, iyong buong South China Sea na tinatawag na mga Tsina, ay kini-claim din natin. So mas mabuti siguro kung linawin kung ano iyong mga areas na mayroon tayong claim at naruroon iyong mga fishing vessels ng Tsina.

Pero sa akin po, gaya ng aking sinabi kanina, maski sila po ay naririyan, maski sila po ay mas makapangyarihan sa atin, might is not always right dahil kung wala silang basehan para magkaroon ng titulo sa mga pinag-aawayang isla, their occupation will not result in title anyway.

PIA GUTIERREZ/ABS-CBN: Sir, ngayon ang dami pa ring vessels sa area, sir. So ano na po iyong naging kinahinatnan ng panawagan ng Pangulo sa China? And how does the administration still manage to trust China given these repeated incursions, sir?

SEC. ROQUE: Alam mo, napakahirap sagutin [garbled] naruroon sila ay hindi sakop ng ating claim eh bakit natin pakikialaman. Pero hindi ko po alam talaga kung ilan iyong mga barko na nandoon sa mga lugar na ating sinasakop din ‘no. So siguro po, we should be guided by that.

Now, iyong tanong mo is dapat bang i-trust ang China? Well, alam ninyo po, lahat ng bansa sa daigdig dapat itaguyod ang kanilang pangnasyonal na interes. So sa akin po, iyong pagkakaibigan natin ay isang pamamaraan para nga magkaroon tayo sometime in the near future ng resolution dito sa pinag-aagawan nating teritoryo. Pero, at the same time, sabi nga po ng Presidente, may hangganan po iyan ‘no. Magiging tolerant tayo sa ibang mga bagay pero kapag langis ang pinag-uusapan, eh ibang usapan na iyan.

Pero sa ngayon po, linawin muna natin: Nandoon ba ang karamihan doon sa mga teritoryo or areas covered by sovereign rights na kini-claim din natin? At iyon talaga ang dapat nating problemahin. Iyon iyong dapat na iprotesta muli ng ating DFA. At saka alam ninyo iyong pagpuprotesta, ni hindi na dapat iyan isinasapubliko eh dahil as a matter of course, ginagawa po iyan ng ating DFA. Kaya nga po doon sa Julian Felipe, ginawa natin ang dapat nating gawin – nag-file tayo ng diplomatic protest.

PIA GUTIERREZ/ABS-CBN: Sir, si Carlo Montehermoso, iyong mangingisda na nagtanong sa Pangulo noong Halalan debate tungkol sa West Philippine Sea noong 2016, sabi niya dismayado siya doon sa sinabi ng Pangulo na joke, joke lang iyong sagot doon sa magdyi-jet ski siya sa West Philippine Sea. Can you speak to these fishermen, sir, and explain the context of the President’s response to that question? Pati iyong sinabi ng Pangulo na tanga lang iyong maniniwala sa kanilang pangako, kasi nainsulto raw itong mga mangingisda na ito at pati raw sila ay nagsisisi na binoto sila si Pangulo over that promise?

SEC. ROQUE: Well, Carlo, unang-una ang tanong: Nakakapaghanapbuhay ka ba ngayon? Hindi ba totoo na noong mga panahon na administrasyong Aquino kung saan tayo po ay palaaway sa Tsina ay iyon po iyong panahon na hindi kayo nakapangisda sa Borough? So huwag po nating kakalimutan na kung hindi po nabago iyong polisiya natin sa Tsina, hindi pa rin po kayo makakapangisda.

Pangalawa, iyong sinabi ni Presidente na magdyi-jet ski at mag-aano ng flag, bagama’t ito po ay sinabi sa panahon ng eleksiyon, ang mensahe niya ay itataguyod niya ang sobereniya ng Pilipinas at iyan po ang nangyayari. Kaya lang alisin natin sa ating mga isipan na iyong pagtataguyod ng sobereniya, ibig sabihn ay makikipaggulo, makikipaggiyera doon sa Tsina. Hindi po. Mayroong iba’t ibang pamamaraan para itaguyod ang ating sobereniya, at sa ngayon po ay mukhang gumagana iyong polisiya ng Presidente, isulong ang mga pupuwedeng isulong na mga bagay-bagay, dahil ikaw po ngayon ay isa sa mga nagbibenepisyo – nakapaghahanapbuhay muli sa Borough.

So kalimutan po natin iyong mga pula ng lahat kasi panahon na po ng eleksiyon, ginagawa po talaga nilang election issue, at ito nga pong si Justice Antonio Carpio ay nagtayo pa ng partido so ano pa po ang gusto ninyo? Malinaw na malinaw na it is all for election purposes. Pero sino po ngayon ang nagbigay ng pagkakataon sa’yo, Carlo, para magkaroon ng pagkain sa hapag-kainan? SEC. ROQUE: Well, ang punto po, dati ni hindi sila makapunta ng Bajo de Masinloc. Malaking bagay po iyon. Huwag po nating i-deny iyan. At hindi ko po alam kung si Carlo ay isa doon sa aking naging kliyente noong kami nga rin po ay nagreklamo. Pero ang pagkakaiba, Carlo, noon at ngayon, ngayon ay malinaw na na ang inyong pangingisda is a matter of right dahil nagkaroon nga ng decision na ang Hague Tribunal. At bagama’t ang sinasabi ng Tsina ay hindi niya kinikilala itong Hague Tribunal na ito eh pinapayagan nila kayong mangisda.

Ang tanong: Bakit hindi sila ngayon gumagamit ng water cannons para palabasin kayo? Bakit hindi sila ngayon tinatakot at forcibly hinaharang? Dahil nga po dito sa kasunduan na bagama’t hindi kinikilala ng Tsina ang Arbitral award eh karapatan ninyo pa rin iyan at mayroon na tayong, kumbaga, normal na relasyon sa ating kapitbahay.

PIA GUTIERREZ/ABS-CBN: Pero ang problem, sir, despite these pronouncements of Malacañang, sila rin mismo ang nagsasabi na sila mismo ay hindi raw sila makapasok dahil tinataboy sila ng Chinese Coast Guard. So are you saying na dapat masaya sila na at least nakakalapit sila at nakakakuha pa rin sila doon sa gilid mismo ng Scarborough Shoal?

SEC. ROQUE: Ngayon po kasi ay walang nakakapasok sa lagoon. Wala rin naman pong mga Tsinong nakapangingisda sa lagoon bagama’t mayroon din silang karapatan na mangisda sa lagoon. Pero ang isda naman po, wala namang pinipili iyan eh. Nandoon lang sila sa lagoon, nandoon sila sa katabi. Iyan po ay rich fishing ground, iyong buong area ng Scarborough Shoal.

Alam mo ang katotohanan naman niyan, bagama’t iyang lugar na iyan ay isla kasi may mga ilang bato na permanently above water. Pinakita ko nga dito sa ating press briefing noong nakaraan kung ano iyong ilang bato na iyan ‘no. So ang importante po ngayon, nakakapunta pa rin sila gaya nang ginawa ng kanilang mga ninuno sa area ng Scarborough at nakapangingisda.

Pero iyon nga po ‘no, lilinawin ko kay Carlo, sang-ayon po sa Hague tribunal, lahat ng mangingisda – Pilipino, Tsino, Vietnam – puwedeng mangisda, at ito nga po ang ruling ng Hague tribunal na ito dahil nireklamo natin na pinapaalis ang ating mangingisda.

PIA GUTIERREZ/ABS-CBN: Sir, last na lang ha. Have you been vaccinated against COVID-19?

SEC. ROQUE: Ano po?

PIA GUTIERREZ/ABS-CBN: Have you been vaccinated already, sir?

SEC. ROQUE: Eh dapat po ‘no kaya lang nagka-COVID nga ako. So ang plano ko po, mayroon daw akong three months na mataas na antibodies so antayin ko po pag-exercise ng three months. At nagpa-test naman po ako talaga, ang dami kong antibodies ngayon dahil sa COVID. So useless po magpa-vaccinate ngayon, sayang iyong aking antibodies.

PIA GUTIERREZ/ABS-CBN: Sir, last na lang na question iyong sa Sinopharm na donation, isasauli pa rin ba ito o hihintayin na lang iyong EUA?

SEC. ROQUE: Hindi ko po alam, iyon ang totoong kasagutan ko kasi ang bilis ng pangyayari. Matapos sabihin ni Presidenteng isasauli bigla namang nagkaroon ng EUL (Emergency Use Listing) ang Sinopharm at tapos, Department of Health na ang mag-a-apply ng EUA. Pero sa kasagutan sa tanong mo, hindi ko po alam kung ano po talaga ang magiging desisyon.

PIA RANADA/RAPPLER: Sir, there seems to be a very big disconnect between Malacañang’s remarks and the remarks especially in relation to the West Philippine Sea by the DND and DFA. For example, earlier you said the China policy of the President is working but if that’s the case, why do we still have all these reports from the National Task Force on the West Philippine Sea? Why do we still have need to keep filing diplomatic protest even daily protest at one point? And why Secretary Lorenzana telling Chinese ships to go out?

SEC. ROQUE: Well, when I say it’s working, I’m not saying it’s perfect. So, kung mayroon talagang basehan para mag-file ng diplomatic protest, kinakailangan mag-file ng diplomatic protest kasi in international law, isang pamamaraan para mapawalang-bisa ang iyong claim to territory is kung mayroon kang acquiescence ‘no. So, kapag mayroon silang ginagawa na tingin natin labag sa ating claim, kinakailangan iprotesta ‘no para hindi tayo ma-accuse of estoppel or acquiescence ‘no. So, having a working policy does not mean it’s perfect, it’s not a perfect world ‘no. Kaya nga kinakailangan patuloy pa rin nating protektahan ang ating interes.

PIA RANADA/RAPPLER: But, sir, these problems have been there since the beginning of the Administration. Does the Palace consider or does the President consider changing the policy given that it’s been how many years already and we just see the same thing over and over again?

SEC. ROQUE: Again, I will bring you back to the reality. Wala pong Scarborough sa Administrasyon ni Presidente Duterte. Wala po tayong teritoryong nawala at kung gagayahin natin ang ginawa ni Secretary Albert at ni dating Senador Trillanes eh baka mawalan na naman tayo ng isla. So, that is proof that the President’s China policy is working.

PIA RANADA/RAPPLER: Sir, you also keep downplaying the findings of the National Task Force in the West Philippine Sea, for example, iyon nga na hindi daw part of the EZZ iyong Julian Felipe Reef and in earlier you said parang you muddled the remarks of the NTF when they said that over 200 ships are still in the West Philippine Sea. Sir, do you coordinate with the NTF, the DND, the DFA when you make statement like that? How does it go, the communication line, to make sure that you are all in the same page?

SEC. ROQUE: Well, unang-una po, I answer questions. Now, I offered actually to everyone kung gusto ninyo hindi ako sasagot ng tanong, isu-submit ang mga questions para kayo ang sumagot. Ayaw naman nila because that would mean na parang hindi natin alam ang sagot.

Pero wala pong inconsistency eh kasi siguro sa detalye, hindi ko naman alam kung nasaan iyang mga barko na iyan. So, I’m in no position to actually say anything but the policy of the President is consistent and has not changed and as I said, has worked. Now, ang problema you will never agree to that and I’m sure Rappler will never agree to that, so let’s just agree to disagree.

Pero iyong pula mo I don’t think holds water because all of the agencies will have to comply with the policy of the President kaya nga po mahirap na supilin ang pananalita ng Presidential Spokesperson unless talagang magdesisyon si Presidente na mali-mali ang mga pinagsasabi ko, in which case, sisisantehin niya ako. But I’m still talking today hindi ba po ‘no because the President is still the architect of foreign policy.

PIA RANADA/RAPPLER: But, sir, even a detail as simple as how far Julian Felipe Reef is from our baselines, how come that you don’t even know because that’s the basis of saying—

SEC. ROQUE: No, okay. Kaya nga po nilinaw ko eh. It’s the Arbitral Award, regardless of the distance, nilinaw ko eh. Pakita natin iyong slides ulit ‘no. Unang-una, it’s not me saying na hindi talaga siya Exclusive Economic Zone, it’s the Tribunal itself na sinabi na mayroong two high tide elevations.

Ang dapat intindihin ninyo, hindi ibig sabihin na palibhasa 200 nautical miles automatic iyan kasi pupuwede ngang magkaroon ng pockets of territorial sea at mas maraming karapatan ang bansa sa territorial sea, okay? Pupuwede ring mangyari po iyan doon sa pinag-aagawang Scarborough. In the end, mapupunta po iyan sa Pilipinas bagamat in possession of China and yet ang mangyayari po diyan magkakaroon ng pocket of territorial sea.

So, iyan po talaga ay desisyon ng Tribunal kaya nga po siguro it is a very complicated and obscure provision of the UN Convention on the Law of the Sea but as I said, I always have a source and the source is the primary material – the Arbitral Ruling. So, iyon po ang aking nililinaw, hindi po sa akin nanggaling iyon, nanggaling po iyan sa Arbitral Tribunal Paragraph 1203 B3. Hughes Reef lies within 12 nautical miles of the high tide features of Mckennan Reef and Sin Cowe Island and therefore can be enclaved as territorial sea and not just part of the Exclusive Economic Zone.

So, mali iyong sinasabi mo, Pia. I’m sorry to say.

PIA RANADA/RAPPLER: Last question. So, given that iyon nga si DFA Secretary has flagged the remark you made, corrected it and then now you’re saying that, you know, you still have get to speak on these issues, what will be your next step to ensure that these contradictions won’t happen in the future given that the big consequences of different Cabinet members saying different things?

SEC. ROQUE: Kaya nga po sa lahat ng oportunidad eh binibigyan naman po ang Presidente ng access sa kaniya para masiguro na tama iyong pinagsasabi ko at sang-ayon sa kaniyang polisiya. Kaya po napapansin ninyo sa Talk to the People, well, matagal po iyong mga meeting namin pero matagal din iyong usapin namin na primarily on foreign affairs kasi iyon talaga ang importante na tama ang mga sinasabi ko ‘no.

At hindi naman po sinasabi ni Presidente na mali ang sinasabi ko. Kapag sinabi naman niya na talagang mali eh ‘di susunod tayo ‘no. Pero iyan po ang dynamics sa administrasyon ngayon ‘no, kaya maski wala akong sasabihin sa Talk to the People nandoon ako kasi sa panahon ng pandemya iyon lang ang pagkakataon na pupuwede kaming magkaroon ng konsulta.

Territory acquired through conquest will never ripen into title

Now, kailangan pong linawin natin ang ating posisyon sa Julian Felipe Reef. Mabuti naman po at nag-issue ng statement ang National Task Force for the West Philippine Sea. Ang sabi ng National Task Force, and I quote, “Ang Felipe Reef ay isang low-tide elevation na nasa 175 nautical miles mula Bataraza, Palawan at nasa loob ng 200 nautical miles ng Exclusive Economic Zone.” Pero dagdag po ng NTF, bahagi siya ng teritoryo ng Pilipinas dahil ito ay nasa loob ng overlapping 12 nautical miles territorial seas ng McKennan Reef at isa pang posibleng high-tide feature ang Grierson, ang Sin Cowe Reef na dahil nga po sa PD 1596 ay kabahagi ng teritoryo ng Pilipinas sa ilalim ng Municipality ng Kalayaan.

Tulad ng sinabi ko kahapon na ang Julian Felipe Reef ay appended sa teritoryo dahil nga po sa Presidential Decree 1596.

Now, ano po ang importansiya ng deklarasyon ng ating National Task Force? Ito po iyong sinasabi ko na hindi ibig sabihin na palibhasa nasa 200 nautical miles ay automatic exclusive economic zone. Pupuwede pong magkaroon ng packet territorial seas doon sa ating EEZ. At mas marami pong karapatan ang coastal state dahil ang territorial seas po ay mayroong soberenya at mayroon din pong hurisdiksyon. Samantalang sa exclusive economic zone, ito po ay karapatan lamang para mangalap ng mga tanging-yaman.

So ang aking punto lang po kahapon ‘no ay kabahagi siya sa 200 nautical miles pero malinaw po na mayroong dalawang high-tide elevations doon na magkakaroon po ng territorial sea kung saan kabahagi ang ating Julian Felipe Reef.

Sa totoo lang po, hindi naman po ako ang nagsabi na mayroong dalawang high-tide elevation. Nasa ating screen po ngayon iyong decision mismo ng Hague Arbitral Tribunal. Ang sabi po ng Hague Tribunal, and I quote ‘no: “The Tribunal finds with respect of the status of features in the South China Sea that Hughes Reef lies within 12 nautical miles of the high-tide elevations or features of McKennan Reef and Sin Cowe Island.” So hindi po ako ang nagsabi niyan; iyong Tribunal po ang nagsabi niyan.

Now, totoo pong inaangkin natin iyan pero ang katotohanan po ay ang naka-ukopa diyan sa dalawang bato na iyan ay ang Tsina at ang Vietnam. Ito po ang larawan ng McKennan Reef na ino-occupy po ng Tsina; in-expand na po nila iyong kanilang artificial island. At ito naman po iyong isa pang bato, isla na ino-occupy ng Vietnam, ang tawag po diyan ay Sin Cowe Island. Iyan po iyong konteksto ng sinabi ko ‘no na pupuwede na hindi talaga siya kasama ng EEZ kasi may territorial sea. Of course, inaangkin po natin iyan so posibleng maging territorial sea ng Pilipinas iyan.

Now, doon sa mga ibang nagsasabi na ano ba itong possession na ito? Kapag ba possession, automatically mawawala na sa atin? Hindi po. Kasi ang applicable norm sa international law, sa mga isla ay iba po doon sa karagatan. Ang applicable rule po is: The state that presents the superior claim to disputed territory on the basis of effective occupation shall be granted title. Ano ba ho iyong effective occupation? Ito po iyong mga ebidensiya na mayroong soberenya na sumasakop sa isang teritoryo na pinag-aagawan. Ano po iyang mga ebidensiya na iyan? Kasama na po diyan iyong batas na nagkabit ng isang disputed territory sa teritoryo ng isang bansa; iyong aktibidades ng militar; iyong pag-i-exercise ng legislative at saka judicial jurisdiction.

So, now, lilinawin ko rin po na hindi ibig sabihin na palibhasa 200 nautical ang EZZ eh automatic 200 nautical na po talaga iyan ‘no. Sa katunayan po, hindi lang ang Pilipinas ay mayroong 200 exclusive economic zone on the basis of 200 nautical miles. Lahat po ng ating karatig na lugar ay mayroon din po silang mga exclusive economic zone. Itong susunod na slide ay magpapakita po na bagama’t iyong pinakamalayong delimitation line, iyan po iyong ating 200 exclusive economic zone ay mayroon po talagang overlaps doon sa ating mga karatig-bansa. So according to UNCLOS, itong mga overlaps po ay dapat pag-usapan, magkaroon ng negotiations nang magkaroon ng kasunduan kung paano madi-delimit po ito. Okay? So sana po naging malinaw na iyan.

Now, itong desisyon po ng Arbitral Tribunal na mayroong territorial sea dito sa McKennan ay isa lang po iyan sa mga bagay-bagay na dapat pag-aralang mabuti, lalung-lalo na po ng Kongreso, na bumuo ng Archipelagic Baselines Law kung paano dapat baguhin ang ating batas na nauukol sa ating teritoryo. Noong isang araw po sa ating briefing, pinakita ko po iyong iba’t ibang mga teritoryo ng Pilipinas sang-ayon po sa iba’t ibang mga batas. Iyong kuwadrado po, iyan ang Treaty of Paris. Tapos po kinabit po ng Presidente Marcos, PD 1569, iyong KIG Group of Islands tapos nagdeklara ng EEZ pursuant din po sa isang presidential decree.

Pero tingnan po natin kung ano ang sinabi ng Tribunal, ng Hague Tribunal tungkol dito sa batas nating ito. Nagkaroon po tayo ng Archipelagic Baselines Law na kinuwestiyon nga namin doon sa Magallona, hindi kami nagwagi, pero nawala po talaga iyong ating internal waters at territorial sea na [garbled] natin ‘no.

Now, anong sabi ng Korte Suprema sa ponensya po ni Justice Carpio nga po ‘no, and I quote: “Although the Philippines has consistently claimed sovereignty over the KIG and Scarborough Shoal for several decades, these outlaying areas are located outside the appreciable distance from the nearest shoreline of the Philippine archipelago which any straight baselines loped around them from the nearest base point will inevitably depart to an appreciable extent from the general configuration of the archipelago.”

Ibig sabihin, sabi po ng Korte Supreme doon sa desisyon nila ay iyong KIG ay hindi natin maa-attach sa ating teritoryo sa pamamagitan ng archipelagic baselines kasi masyado raw malayo. So ang ginawa po nila, in-append nila iyong KIG group sa pamamagitan ng regime of islands diumano ‘no at ito po ngayon ang pinag-aralan din ng Tribunal.

Now, balikan po natin ‘no, ang teorya namin doon sa Magallona ‘no ay hindi pupuwedeng mabago iyong teritoryo ng Treaty of Paris dahil iyan naman po ay, unang-una, sang-ayon sa tratado. Hindi po iyan historic claims of water gaya ng Nine-Dash Lines ng Tsina. Pangalawa, ito po ay binding because it is a treaty delimitation. And pangatlo, mayroon po tayong prinsipiyo nga na uti possidetis na iyong mga colonial boundaries para hindi magkagulo iyong mga bagong bansa na naging malaya laban sa mga colonial powers ay conclusive. So mayroon po talaga tayong basehan na panindigan iyong ating Treaty of Paris.

Pero gumawa nga po ng batas ang Kongreso, sinabi namin unconstitutional, kinilala pa rin na constitutional ‘no. At ang sabi nga po nila, and I quote: “The baselines cannot be drawn from the boundaries or other portions of the rectangular area delineated in the Treaty Paris but from the outer most islands and the lying reefs of the archipelago.”

So anyway, para baga hong nawala talaga iyong ating internal waters at territorial seas at ang sabi pa ni Justice Carpio sa decision na iyon, dahil tayo ngayon ay compliant sa UNCLOS, aba, mas malakas ang possibility natin na magwawagi tayo sa ating claims doon sa pinag-aagawang isla.

Tingnan po natin kung ano ang sinabi ng Hague Tribunal, ito po iyong sa arbitration na isinulong natin ‘no. Paragraph 575, and I quote: “In any event, however, even the Philippines could not declare archipelagic baselines surrounding the Spratly’s Islands. Article 47 of the Convention limits the use of archipelagic baselines to circumstances where within such baselines are included the main island and an area which the ratio of the area of the water to the area of the land, including atolls, is between 1 to 1 and 9 to 1.”

Ano pong nangyari doon sa ating domestic na batas? Doon po sa archipelagic baselines ho sinasabi nila na tuloy pa rin ang bisa ng 1569, eh iyong 1569 po in-append natin iyan as an offshore part of the archipelago.

So, tingnan pa po natin iyong ibang paragraphs ng Tribunal award ‘no. Ito naman po, Paragraph 575: “The Convention also provides in Article 7: For States to make use of straight baselines under certain circumstances and the Tribunal is aware of the practice of some States in employing straight baselines with respect to offshore archipelagos to approximate the effect of archipelagic baselines. In the Tribunal’s view, any application of straight baselines to the Spratly islands in this fashion would be contrary to the Convention.”

Ibig sabihin, para bagang iyong ating legal na basehan para angkinin nga itong Spratly ay sinabi rin ng Tribunal na hindi rin sang-ayon sa UNCLOS kasabay ng sinabi niya na iyong nine-dash line ng China ay wala pong legal na basehan. May isa pa pong paragraph ang nais kong i-quote. Final paragraph is 575 ‘no.

“These conditions do not include the situation of an offshore archipelago.”

So, ibig sabihin po talaga eh para bagang kinakailangan repasuhin iyong ating PD 1569 na nagiging legal na basehan natin para idikit ang Spratly sa ating lehislatura. So, uulitin ko po ang aking paghihingi sa ating mga mambabatas, kinakailangan po tayong bumuo ng bagong batas para po magkaroon ng mas malakas na angkla ang ating titulo diyan po sa Kalayaan Islands Group. At ang importansiya nga po nito, iyong batas na ginagamit natin para maging kabahagi ng ating teritoryo ang Kalayaan Island Group ay isa sa ebidensiya ng effective occupation.

Now, kanina po, sasabihin ko po, nagkaroon kami ng virtual debate ni Justice Carpio at panoorin po natin iyan mamaya ‘no sa isang channel. Pero ang importante po, marami ang nagtatanong, eh paano nga iyon, hindi ba dapat paalisin ni Presidente ang Tsina doon sa mga isla na ino-occupy lalung-lalo na doon sa mga lugar na sinasabi na sakop ng ating Exclusive Economic Zone at wala nga pong mga karapatan ang Tsina na gumawa ng isla doon?

Well, tama po at pinapaalis po natin sila kaya lang hindi sumusunod. Ito iyong konteksto na sinasabi na siguro dahil ayaw umalis eh kinakailangang use of force ang tanging pamamaraan para sila mapaalis pero sabi nga ni Presidente sa UN General Assembly, bawal po ang paggamit ng dahas kaya nga po patuloy tayo sa diplomasya.

Pero ang tanong, anong epekto ng mga artificial islands doon sa lugar lalung-lalo na sinabi na ng Arbitral Tribunal na kabahagi natin ang EEZ? Wala po! Kasi matagal na pong prinsipyo sa international law na ang mga teritoryo na nasakop sa pamamagitan ng paggamit ng dahas, “territories acquired through conquest will never ripen into title.”

So, huwag po kayong mag-alala, maski tayo po ay mag-status quo na naririyan sa kanilang mga artificial islands, kung wala naman silang legal na basehan para angkinin iyan, hindi ibig sabihin na palibhasa malakas sila at hindi natin sila mapaalis ay sa kanila na po ang territory. So, in that sense po, sinisigurado tayo ng international law, “might will not always be right” because territory acquired through conquest will never ripen into title.

Okay! Sana po naging malinaw iyan at siguro po mula ngayon iyong mga tanong sa national territory ibato na po natin ngayon sa Kongreso dahil at least ang isang mabuting ibinunga nitong debate pagdating sa Kalayaan Island Group eh ano nga bang epekto ng Arbitral Award na iyan sa batas natin pagdating sa ating teritoryo, at kinakailangan po talaga repasuhin iyan ng Kongreso. Iiwan na po natin iyan sa Kongreso dahil hindi naman po iyan katungkulan ng isang Presidente.

Sa pag-upo ni Lieutenant General Guillermo Eleazar bilang bagong pinuno ng Philippine National Police (PNP), nangako siya na magsasagawa ng paglilinis sa hanay ng kapulisan.

Ayon kay Eleazar, hindi siya magdadalawang-isip na sibakin sa puwesto ang mga pulis na magdudungis sa imahe ng PNP.

Sinabi pa niya na madalas na natatawag na “pulis patola” o “kotong cops” ang mga pulis dahil sa iilang tiwali sa kanilang hanay.

“For as long as I’m the chief PNP, every single centavo of your hard-earned money allocated to us will be in good hands,” sabi ni Eleazar sa kaniyang talumpati sa pag-upo niya sa puwesto.

“Sa mga natitirang hoodlum in police uniforms, sisiguraduhin ko sa inyo, you will hate me. Hindi ako magdadalawang-isip na magtanggal ng mga tiwaling pulis dahil sa laki ng sweldo na binibigay sa atin ng ating gobyerno at benepisyo, sigurado akong madaming gustong pumalit sa inyo,” pahayag niya.

Inaasahan naman ni Eleazar ang mga opisyal ng PNP na mahusay na pamumunuan ang kanilang mga tauhan.

“Naniniwala ako na magdadalawang-isip gumawa ang sinumang pulis, maging ‘yan man ay patrolman o patrolwoman, maging heneral, kung alam niya na siya ay di kukunsintihin ng kanyang commander, ng kanyang kasamahan at ng kanyang organisasyon,” sabi pa ni Eleazar.

I am avoiding the situation where things will go out of control and — kasi ‘pag ito ang military would also, upon my orders, press for a fight in order to impose peace.

You just don’t know the endless meetings, mga ilang kape ‘yan, ilang tasang kape ‘yang maubos ko noon just to talk and convince to support BARMM so that hopefully sana there will be peace.

But the monkeywrench of the whole situation now is the BIFF and they continue to inflict hindi lang maliliit. They continue to burn, ambush, detonate bombs, talagang a full-blown terrorism.

Ngayon, nagmamakaawa ako sa inyo tulungan ninyo ako because otherwise, I said, if I give the order for an all-out offensive, it will be bloody and it will be sad.

Iyon ang ayaw ko kaya ako pumunta dito. Iyan lang ang gusto ko. I will not detain you here more than — hold your knees more than necessary. Alam ko mainit. Ako basang-basa na ako sa loob. Pawisin ako na tao.

Duterte to Carpio: ‘I’m not afraid of you, I just forgot you’re not president’

President Rodrigo Duterte on Monday explained why he backed out of the challenge he posed to former Supreme Court Senior Associate Justice Antonio Carpio that they debate on issues concerning the West Philippine Sea.

“Ang problema rito nakalimutan ko ako ang Presidente, si Carpio hindi,” Duterte said in his weekly talk to the people .

Duterte made the remark days after presidential spokesman Secretary Harry Roque Jr. said that the Chief Executive listened to Cabinet secretaries’ advice that he should not engage Carpio in a debate.

He said his statements in the debate could be construed as “policy.”

“I might bind future actions of government pagdating dito sa West Philippine Sea, pero du’n ako sa kahon,” Duterte said.

“It’s not because I’m afraid of debates,” he added.

Police commanders will be held liable if their stations will be found untidy during inspections, the country’s top cop said on Monday.

In his first press briefing as chief of the Philippine National Police (PNP), Gen. Guillermo Eleazar said he has instructed the Internal Affairs Service (IAS) to focus on the cleanliness in all PNP precincts, stations, and offices under the “Intensified Cleanliness Policy” (ICP).

Sinabi ko sa ating (IAS) Inspector General, Atty. Alfegar Triambulo na bigyan ng focus itong cleanliness in the offices at kung kinakailangan mag recommend kung sino ang dapat nating i-relieve na PCP (police community precinct) commander (I told our IAS Inspector General, Atty. Alfegar Triambulo to give focus on the cleanliness of the offices and if needed, recommend those PCP commanders who should be relieved.

He added that keeping police precincts and stations clean and presentable will help the institution gain the public’s trust and respect.

“Actually, our IAS conducts regular inspections everyday and I saw in their report that they have already inspected at least 1,000 police units,” he added.

Eleazar added that he will also conduct surprise inspections of police stations to ensure that their cleanliness and orderliness will be observed.

“Yes, I will do that. Expect that all other commanders from the regional directors down to the chiefs of police will do their own inspection. We will have our time. I am giving them the chance to clean up and as I have heard from other officers, there also already those who are starting renovations and cleaning,” Eleazar said.

Eleazar first introduced the ICP when he was chief of the National Capital Region Police Office.

The ICP aims to correct minor problems in the service to prevent them from getting worse.

KOMENTO ni Robredo parang minaliit ang kaalaman ng ilang Filipino

Duterte made the decision after some of his Cabinet members advised him not to face Carpio supposedly because nothing good will come out of it, presidential spokesperson Harry Roque said in an announcement aired on state-run PTV.

Duterte will be represented instead by Roque. The Philippine Bar Association has already offered to host the debate.

In a televised address on Wednesday night, Duterte claimed that Carpio was involved in the decision to withdraw Navy ships during a 2012 standoff with China at Scarborough Shoal. He vowed to resign if proven false and challenged Carpio to a debate.

Or at least ang medisina or whatever it is, has an effect in fighting COVID or building the antibodies in your system. Gaano ito sila katagal, sir?

FDA CHIEF ERIC DOMINGO: Well, Mr. President, ang sinasabi lang naman po ng mga espesiyalista natin is that we wait for the evidence.

At makikita naman po natin in the next siguro one to two months dahil marami na pong ongoing na clinical trials sa buong mundo, makikita naman na magkakalinaw na kung talagang magagamit siya, at kung magagamit naman, kung paano ‘yong dosage ‘no kasi sa ngayon po hindi pa rin po masyadong malinaw ‘yan. Iyon pong clinical trial natin mga six to eight months po siguro ‘yon, ‘yong sa DOST, bago tayo magkaroon ng preliminary trials.

Kaya lang po kasi ‘yong mga naunang mga study, mas hindi po kasing well-designed katulad po nang gagawin ng DOST ‘no. Kaya po ‘yong mga ongoing ngayon mga well-designed studies na po ‘yan at diyan po natin makikita talaga kung — mas objective po kasi talaga at mas maganda po ‘yong ebidensiya na lalabas.

There’s a possibility po that it is useful but there’s always that possibility po na it’s the same as not taking it ‘no. Kaya po talagang kailangan lang pong hintayin lang natin ‘yong clearer evidence on the effect po talaga ng Ivermectin sa COVID-19.

PRESIDENT DUTERTE: I am praying that Ivermectin could be of use to maski ano na lang, palliative na ma — hindi ka mahawa kaagad.

There has to be — there has to be an effect in that thing there that is being introduced into your body kasi kung for preventive mayroon ka, kung maglabas ‘yan that’s what also I am hoping that it will turn out that way that we can use it so that ako — ako ang maunang mag-ano because inumin mo para ano ka ‘yong at least preventive.

Duterte to De Lima: ‘If you want me to die, you must pray harder’

President Rodrigo Duterte said he does not have any ailment that would prevent him from exercising his duty as chief executive.

Duterte made the remark amid speculations on his health following the cancellation of his regular public address for two consecutive days last week.

His longtime aide and now Senator Christopher “Bong” Go on Sunday posted a series of photos and videos where the president could be seen swinging a golf club, riding a motorcycle at night time.

“Kaya ako nakaka-swing ng golf tapos nagmo-motor kasi kaya ko pa,” Duterte said in his nationally televised address on Monday night.

“Noong nawala ako ng ilang araw, talagang sinadya ko ‘yon. Pag kinakalkal mo ako, lalo akong, ‘yong parang bata, pagka lalo mo akong kinakantsawan, lalo akong gagana,” he said.

Duterte then slammed his critics, including Senator Leila de Lima, who he said wants him to die early.

“If you want me to die early, you must pray harder,” Duterte said.

Duterte stands by Lorenzana’s remark, denounces China’s claim on Julian Felipe Reef

MANILA – President Rodrigo Duterte is standing by the strong statement made by Defense Secretary Delfin Lorenzana demanding the immediate departure of the remaining 44 Chinese vessels from the Julian Felipe Reef in the West Philippine Sea, Malacañang said Monday.

Lorenzana on Saturday told the remaining 44 Chinese vessels to leave, saying they had no more reason to take shelter there since the weather has cleared.

In response, the Chinese Embassy in Manila called Lorenzana’s remark “unprofessional”, maintaining its historical claim over the feature which is within the Philippines’ exclusive economic zone (EEZ).

“Of course, the President stands by the statements of our Secretary of Defense,” Presidential Spokesperson Harry Roque said in an interview over CNN Philippines.

Roque, however, pointed out that the presence of Chinese ships in the area would not lead to war.

“I hasten to add that the President has been clear that this is not an issue that will lead to war between friendly nations. We are hoping that our friendly relations will soon resolve this latest impasse,” he added.

In a Palace press briefing aired over PTV-4, Roque cited Duterte’s speech during the United Nations General Assembly (UNGA) in September 2020 where the latter affirmed the Permanent Court of Arbitration’s (PCA) ruling in favor of the Philippines’ arbitration case against China’s expansive maritime claims in the disputed sea.

“Hindi po nagbabago ang posisyon ng ating Presidente. Eto po yung kanyang nabanggit na salita sa UN General Assembly. Hindi po natin isasakripisyo, hindi natin ipamimigay ang ating national territory at ang ating mga exclusive economic zone (The President’s position has not changed. He mentioned this during his speech at the UN General Assembly. We will not sacrifice or give away our national territory and EEZ),” he said.

Roque said Duterte also believes that friendly relations between the Philippines and China will result in the peaceful resolution of this impasse.

“Ang posisyon po ng Presidente, paninindigan natin ang ating karapatan pero hindi po to isang bagay para tayo po ay gumamit ng dahas. Kampante po ang ating Presidente na dahil nga po mero tayong malapit na pagkakaibigan mareresolba ang hidwaan na ‘to (The President’s position is that we will fight for our rights, but this is no reason for us to use force. Our President is confident that our strong ties would resolve this impasse),” he added.

He also reiterated support for Lorenza’s demand for Chinese vessels to leave the Julian Felipe Reef.

“I think Secretary Lorenzana was correct in pointing out that we consider that area as part also of Philippine territory and exclusive economic zone,” he said.

‘Sovereignty non-negotiable’

In a separate statement, Chief Presidential Legal Counsel Salvador Panelo expressed opposition over the “unjustified stay” of Chinese vessels at the Julian Felipe Reef, saying it could result in “unwanted hostilities” between the two countries.

“While we recognize the historical and cultural ties with China that have evolved into a productive relationship, its present territorial incursions is producing an unwelcome stain in their bond and may trigger unwanted hostilities that both countries would rather not pursue, as destructiveness consequences are not only undesirable, they are abhorrent as well and anathema to the peace of the region,” Panelo said.

Panelo insisted that the country’s sovereignty is “non-negotiable” despite the Philippines’ improved ties with China.

“Let it be clear to all countries of the world that are protective of their own sovereignties. Like them, we are fiercely protective of ours. We can negotiate on matters of mutual concern and benefit, but make no mistake about it — our sovereignty is non-negotiable,” he added.

He said the matter of territorial dispute has to be resolved in the “diplomatic negotiating table or by the dictates of international law.”

The National Task Force for the West Philippine Sea earlier expressed concern over a Philippine Coast Guard report that about 220 Chinese fishing vessels, believed to be manned by Chinese maritime militia personnel, were sighted in line formation at the Julian Felipe Reef on March 7.

The reef is located approximately 175 nautical miles west of Bataraza, Palawan.

The Department of Foreign Affairs expressed support over the DND’s demand for the remaining Chinese ships’ withdrawal from the Julian Felipe Reef.

“[T]he Philippines’ position on this continued Chinese presence in the WPS has been unequivocal, as articulated by the recent statement of the National Task Force for the West Philippine Sea and the statement today by the Department of National Defense,” the DFA said.

On March 21, the Philippines filed a diplomatic protest over the presence of around 200 Chinese ships at the Julian Felipe Reef.

The DFA on Monday “strongly” denounced the Chinese embassy’s “unprofessional” comment against Lorenzana.

“The DFA strongly denounces the Embassy’s attempt to impugn the Secretary of National Defense — a Cabinet official of the Republic of the Philippines — by calling his statement ‘unprofessional,’” the DFA said in a statement.

Sila po talaga ang ating mga sundalo dito sa giyera laban sa COVID-19 at naintindihan po natin iyong hirap na walang katapusan po iyong dumarating na mga pasyente dahil nga po pumasok itong mga new variants na nakakahawa.

So nagbibigay-pugay po tayo at binibigay naman po natin ang lahat ng pangangailangan ng ating mga health workers: Sa ating Bayanihan Act eh mayroon po tayong mga binibigay na benepisyo kung sila po ay magkakasakit; sinisigurado po natin na kumpleto sila ng PPE at iba pang mga protective equipment nang ang kanilang kalusugan ay mapangalagaan; binibigyan po natin sila ng mga dormitoryo dahil alam po natin na iyong ilang mga nurses lalung-lalo na ay nagdu-duty sila nang 2 weeks at sinasagot na po natin ang gastos ng dormitoryo ‘no.

At siyempre po kung ang tanong ay gusto pang makipagdiyalogo, ang Presidente naman po talagang bukas ang kaniyang tanggapan para sa lahat ng Pilipino na mayroong mga hinagpis na nais iparating sa kaniya. Pero hindi na po kinakailangang hingin iyan dahil ang Presidente naman po talaga patuloy po ang kaniyang pagdidiyalogo sa mga miyembro ng mga medical frontliners.

Kada kami ay nagkikita po, kinukuwento niya kung sino naman ang nakausap niyang doktor dahil siya mismo po gumagawa ng hakbang para malaman kung ano talaga po ang nangyayari sa ating mga medical frontliners.

Nakita ko po sa East Avenue at saka sa Lung Center at saka sa NKTI, high morale po iyong ating mga health care workers kahit nakita po namin ang pagod nila, ang dedication po nila nakakainspired po ang dedication ng ating mga health care workers.

At ako po ay talagang humahanga po talaga sa kanila kasi talagang halos… dito po sa PGH more than 200 po ang affected na nagkaroon po ng COVID pero talagang tuluy-tuloy pa rin po ang kanilang pagbabakuna, tuluytuloy ang kanilang pag-aano sa mga emergency room at tuluy-tuloy rin po ang talagang pagagapay nila po sa kanilang mga talagang naghihirap po natin na mga ibang mga pasyente at talagang tinutulungan po nila.

So ako po ay talagang saludung-saludo sa ating mga health care workers at sinasabi nga po nila na gusto nga po nila na magkaroon po ng message ang ating mahal na Presidente para sa kanila. And then I gave them iyong message na pinagawa po ng RTVM at maraming, maraming salamat po.

Defense chief Lorenzana tests positive for COVID-19

MANILA – Department of National Defense (DND) Secretary Delfin Lorenzana said he will undergo isolation after being tested positive for the coronavirus disease 2019 (Covid-19) Tuesday.

“The result of my RT-PCR (reverse transcription-polymerase chain reaction) test today, 06 April 2021, came up positive. I will be undergoing isolation, following the quarantine guidelines to avoid infecting others. Those who have been exposed to me have been informed. They have been advised to isolate and get tested for Covid-19 as well,” he said in a statement.

Lorenzana said the DND will continue to operate with a skeleton workforce to ensure continuity of service, with the prescribed health protocols strictly enforced.

“I would like to remind everyone that the threat of the virus is as real as ever, more so now due to the new variants. Let us all cooperate and abide by the prescribed health protocols to help in curbing the spread of Covid-19,” Lorenzana said.

Last year, the DND chief tested negative for Covid-19 in March and April after coming into close contact with people infected with the virus.
