      Sa pagdaan ni BBM sa simbahan, masayang nakangiti, at kumakaway sa kanilang tapat -malamang na sila ang tinatanaw.

      Binabatikos ang kampo ni Leni sa kanyang pamumulitika na ginagamit ang mga pari at bahay-sambahan upang mangampanya. Sa panahon ng pangangampanya ni Leni Robredo at Kiko Pangilinan, makikita sila sa loob ng simbahan ng Catholic church.

      Tahasang sinoportahan at inendorso sila ng mga lider ng simbahan, kasabay ng panalangin sa kanila.

      Ang spokesperson ni BBM na si Vic Rodriguez ay nalulungkot din sa “meddling” o pakikisawsaw ng mga lider ng simbahan.

      Sa kabilang banda, maalala rin na dumalo si BBM-Sara sa religious worship ng El Shaddai na pinangungnahan ni Bro. Mike Vellarde. Ipinanalangin din si BBM-Sara ng isang born-again bishop na si Ted Malangen upang iendorso sa kanyang nasasakupang denomination.

      Ngunit ang mga ito, ayon sa kampo ng Uniteam, ay hindi “campaign rallies” gaya ng ginagawa ng Angat-Buhay tandem.

      Mainit na sagutan ni BBM at Ka Leody sa usaping pangkapayapaan

      During the SMNI Presidential Debates held in Okada Manila, a question raised by one of the panelists challenged the opinion of two presidentiables who attended the debate. Bongbong Marcos, Jr. and Leody de Guzman gave their own answers if they consider the Communist Party of the Philippines-New People’s Army-National Democratic Front’s (CPP-NPA-NDF) a friend or enemy of the government.

      The question was derived from the recent declaration of the current administration that these groups are terrorists.

      More local government units (LGUs) have joined the administration in condemning the atrocities of these lawless groups by declaring as persona non grata in their respective localities.

      Interior and Local Government Assistant Director Rene Valera revealed that 74 of the country’s 81 provinces already passed resolutions condemning the atrocities of these Communist groups and declared them as persona non grata during one of the virtual press briefing of the National Task Force to End Local Communists Armed Conflict (NTF-ELCAC) held last December 2021.

      Here are the answers we got from Marcos and de Guzman.

      Marcos: “Unang-una, ang depinisyon ng terorista ay yung nagdadala ng violence sa mga, hindi naman, non-combatant kung tawagin – na mga sibilyan. Kaya’t sila ay ginawang terorista.

      Ngayon, papaano naman natin papayagan na sabihin na tumutulong sa atin o kaibigan natin ang isang grupo na nambobomba, namamaril. At ah hindi lamang yung mga sundalo, hindi lamang yung mga pulis, kundi ang isang football player na walang kinalaman na kaawa-awa, ay sa palagay ko wala na tayong ibang maaring sabihin kung hindi tratuhin sila na kalaban dahil kinakalaban tayo. Kaya’t kailangan natin ipagtanggol ang ating sarili.”

      Leody: “Ako ay hindi sang-ayon na siya (sila) ay terorista. Ako, tingin ko sila ay isang rebolusyonaryong grupo na naghahangad ng panlipunang pagbabago at hustisya. Yan ay resulta ng uhm, pagkakamal, pagsasamantala ng iilan sa ating lipunan na ginagamit ang mamamayan, ang manggagawa para sa pagkakamal nila ng yaman. At gumagamit ng dahas kapag lumalaban yung mga naaapi.

      At yung pag-gamit ng dahas na yan ang nagtutulak din sa mga yan kung bakit sila nag-aarmas.

      Kaya kinakailangan natin na magkaroon ng totoong demokrasya sa ating bansa. Demokrasya na hindi lamang sa mga iilang nasa tuktok ng lipunan na nagpapayaman nang nagpapayaman at yung ating mamamayan sa ibaba, pinaghihirap nang pinaghihirap.

      Hangga’t ganyan ang sistema ng ating lipunan, hindi mawawala ang paglaban mula sa welga, protesta, hanggang pumunta sa paghahawak ng armas. Kaya’t wakasan natin yung klase ng pagsasamantala ng iilan laban sa mamamayan.”

      Magpadala ng Navy or Coastguard para may military presence sa WPS

      If he becomes president, former senator Ferdinand “Bongbong” Marcos Jr. said he will push for the crafting of a code of conduct between the Association of Southeast Asian Nations (Asean) and China to resolve the territorial dispute in the South China Sea, which includes the West Philippine Sea.

      During the presidential debate hosted by media network SMNI on Tuesday, Marcos said he is keen on asking help from the Asean and the United Nations in dealing with the Philippines’ maritime dispute with China.

      “Puntahan natin ang Asean, magpatulong tayo sa Asean dahil ang Asean ay mayroon ding binubuo na Code of Conduct para sa Asean at tsaka sa China at sana maipasa na ‘yan (We will go to Asean and ask the help of Asean because they are crafting the Code of Conduct for Asean and China),” Marcos said.

      “At punta pati tayo sa UN at magpadala tayo ng delegation sa Beijing para kausapin ang Presidente Xi at sasabihin papano ba natin ayusin ito, paano ba natin ayusin para di na maulit ang nagyari sa nakaraan (We will send a delegation to Beijing to talk to President Xi and discuss with him how to resolve the issue so that what happened in the past will not happen again),” he added.

      Marcos also assured Filipino fishermen that they would be able to return to their traditional fishing grounds in the West Philippine Sea without interference from Chinese coast guard ships.

      “Siguro naman maipapaliwanag natin sa China na ang mga bangka ay hindi naman military threat ‘yan sa kanila bakit sila maglalagay ng warship doon (We will explain to China that our vessels are not a military threat, so why do they need to put warships there)?” he added.

      The former senator said that the Philippines needs to patrol the West Philippine Sea to assert the country’s sovereignty.

      “The reason I spoke about putting a military presence there is so that the government or the Republic of the Philippines has a presence there to show to China that we are defending what we consider our territorial waters,” he said.

      “And that is not for them to go here to fire upon the Chinese vessels but merely to make their presence felt so that the Chinese know we are aware of what they are doing, we do not agree with what they are doing,” he added.

      Marcos said he will use diplomacy to resolve the maritime dispute with China.

      “We carry on with our diplomatic back channel, side channel whatever way we can do to fix the problem and make us have a system so that we no longer have this problem again,” he said.

      Marcos also promised to make his Statement of Assets, Liabilities and Net Worth (SALN) public if he is elected president.

      He said that releasing his SALN “will not be a problem.”

      “If elected, I’ll be willing to make my SALN public if they ask for it,” Marcos said.

      He added that there is no need to amend the law that requires government officials to file the SALN.

      All public officers and employees are required to submit their statement of assets, liabilities and net worth under oath according to Article XI, Section 17 of the Constitution.

      The law also states that in the case of the president, the vice president, the members of the Cabinet, the Congress, the Supreme Court, the Constitutional Commissions and other constitutional offices, and officers of the Armed Forces with general or flag rank, the declaration shall be disclosed to the public in the manner provided by law.

      Bongbong Marcos Jr on Foreign Policy: ‘Find our own line.’

      Philippine presidential candidate Ferdinand Marcos Jr. said he wants his country to have a military presence in the South China Sea, “not to fire upon” vessels but to defend its waters in a long-running dispute with China.

      Marcos, son of the late autocrat of the same name, is leading in opinion polls ahead of the May 9 election and appears poised to complete a remarkable rebranding of the family name 36 years after a “people power” uprising ended his father’s rule.

      In the first televised debate of the campaign, with just four of 10 candidates taking part, Marcos floated the idea of deploying navy ships or coast guard vessels in the disputed strategic waterway to allow fishermen to fish freely.

      Marcos, 64, said he will not prioritise a military resolution to the South China Sea dispute and would continue the “correct approach” of pursuing a policy of engagement with China.

      “The reason why I spoke about putting military presence there is so the government has a presence there to show China that we are defending what we consider our territorial waters,” Marcos said.

      China’s assertive pursuit of its claims in the South China Sea has drawn repeated complaints from the Philippines, Malaysia, Vietnam, Brunei and Taiwan, which all have competing claims. The United States has also repeatedly condemned China’s policy.

      An international tribunal in 2016 invalidated China’s claim to almost all of the resource-rich South China Sea, which is also a major trade route, but Beijing does not recognise the ruling.

      Marcos described the Philippines’ relationship with longtime defence treaty ally the United States as special and “very important”, adding that he would have to “walk a very, very fine line” between China and the United States.

      Marcos faced off against three other contenders in the debate. There are 10 candidates in total, but only four other leading contenders, none of whom attended.

      Ito ang tugon ni Marcos sa katanungan hinggil sa isyu ng paglalahad ng SALN sa SMNI Presidential Debate sa Okada Manila ngayong araw, Pebredo 15, 2022.

      Una nang inamin ng dating mambabatas na sa nakalipas na anim na taon ay hindi niya isinapubliko ang kanyang SALN dahil hindi naman siya opisyal ng gobyerno.

      Ngunit kung sakali aniyang siya ay palaring manalo bilang pangulo ng bansa ay handa niyang ilabas sa publiko at gawin itong public information.

      Pabor din si Marcos na ilabas ng sinuman sa kanyang pamilya kung magiging opisyal ito ng gobyerno.

      Naniniwala rin si Marcos na obligasyon ng bawat opisyal ng gobyerno o maging ng isang indibidwal na ilabas ang kanilang SALN.

      Wala nang hadlang sa pagtakbo sa pagka-pangulo ni dating senador Ferdinand ‘Bongbong’ Marcos Jr. Ito’y makaraang ibasura ng Commission on Elections (Comelec) ang lahat ng natitirang disqualification cases na isinampa laban sa kanya.

      Sa 44-pahinang resolusyon na pinonente ni Commissioner Aimee Ferolino ng First Division at sinang-ayunan ni Commissioner Marlon Casquejo, ibinasura ng poll body ang tatlong natitirang petisyon dahil sa kakulangan ng merito.

      At upang maalis ang pagdududa kung ang kabiguang maghain ng income tax ay isang krimen na kinasasangkutan ng mor turpitude, tinukoy ng poll body ang pronouncement ng Supreme Court sa kaso ng Republic of the Philippines vs. Ferdinand R. Marcos II at Imelda R. Marcos kung saan ipinasya ng high tribunal na ang kabiguang maghain ng tax return ay hindi krime na kinasasangkutan ng moral turpitude.

      Sa ruling ng poll body, malinaw na ang sentensya kay Marcos na magbayad ng multa ay hindi saklaw ng anumang pagkakataon para sa disqualification sa ilalim ng Section 12 ng Omnibus Election Code (OEC).

      Nakasaad din sa desisyon na immaterial kung nagbayad o hindi ng multa o penalties si Marcos sa RTC (Regional Trial Court) ng Quezon City, dahil ang kanyang sentensya ay wala sa purview ng Section 12 ng EOC.

      Ang mga ibinasurang disqualification case laban sa presidential aspirant ay isinampa nina Bonifacio Ilagan, Abubakar Mangelen, at ng grupong Akbayan.

      Una nang ibinasura nng Comelec Second Division ang petisyon na nagpapakansela sa certificate of candidacy (CoC) ni Marcos.

      Sa 32-pahinang ruling na nilagdaan ni Presiding Commissioner Socorro Inting at sinang-ayunan nina Commissioners Antonio Kho at Rey Bulay, nakasaad na walang misrepresentation na ginawa ang dating senador.

      Iginiit ng mga petitioner na sina Fr. Christian Buenafe, Fides Lim, Ma. Edeliza Hernandez, Celia Lagman Sevilla, Roland Vibal at Josephine Lascano na naglalaman ng ilang false representations ang CoC ng presidential candidate.

      Pinuri naman ni Atty. Vic Rodriguez, abogado ni Marcos, ang ruling sa pagsasabing nagsinungaling ang petitioners at sinadyang iligaw ang Comelec sa pamamagitan ng pagsasaad ng mga maling probisyon ng batas.

      Vice presidential candidate and Davao City Mayor Sara Duterte on Thursday visited her 70-year old supporter battling breast cancer.

      Duterte paid a visit to Dhely Borja while going rounds in Sta. Maria, Bulacan.

      Due to her illness, Borja said she was not able to attend the campaign launch of presidential aspirant Ferdinand Marcos Jr. and Duterte at the Philippine Arena in Bulacan.

      Borja’s daughter Pia then sent a private message to one of Duterte’s staff and asked if they could visit her mother.

      “Noong nakita namin na medyo may time tayo today na pumunta dito, isiningit natin yung schedule and of course personal na pasalamatan si Ma’am Dhel. Si ma’am Dhel hindi niya ako kilala pero sumusuporta siya sa journey ko sa aking kandidatura kaya nagpapasalamat ako sa kanya,” Duterte said.

      “Nawala yung kirot sa saya, tuwang tuwa po ako,” Borja said.

      Duterte also shared the experiences of her mother Elizabeth who is also a cancer survivor. Elizabeth was in between cancer treatments when she joined Sara in Byaheng DU30 national bus caravan during the 2016 presidential campaign.

      “Good luck sa chemo mo, ma’am. Ihanda mo lang ang sarili mo kasi nakita ko talaga sa mama ko ‘yung hirap niya sa chemo niya. Pero sabi naman nila pag tinapos mo yung cycle ng chemo, mataas yung chances na hindi na bumalik yung cancer,” Duterte told Borja.

      The VP bet added: “Kayang-kaya mo yung chemo. Basta mental preparation sa physical na hirap na dadaanan mo.”

      Comelec pumanig kay Marcos Jr vs. disqualification case

      The Commission on Elections Former First Division has dismissed the disqualification case filed against presidential candidate former Senator Ferdinand Marcos Jr., Comelec spokesman James Jimenez said on Thursday.

      According to Jimenez, the division junked the consolidated petitions of Bonifacio Ilagan, Abubakar Mangelen, and Akbayan “for lack of merit.”

      “WHEREFORE, premises considered, the Petitions are hereby DISMISSED for lack of merit,” read the 41-page ruling penned by Commissioner Aimee Ferolino.

      According to the petitioners, Marcos should not be allowed to run for president because of his conviction for violating the Internal Revenue Code, which carried a penalty of perpetual disqualification from holding any public office.

      They noted that in 1995, a Quezon City court convicted Marcos for not filing his income tax returns from 1982 to 1985. The conviction was upheld by the Court of Appeals but removed the imprisonment sentence.

      Marcos, they said, did not appeal the ruling. 

      Asked for comment on the campaign trail, Marcos said, “That is a good result for us.”

      “Hopefully, we can carry on with the campaign with all of these distractions that were put in the way,” Marcos said.

      Told that there were petitions against his candidacy before the Comelec Second Division, he said, “What else can we do but wait for the decision.”

      Ex-post facto laws

      “Contrary to petitioners’ assertion, the penalty of perpetual disqualification by reason of failure to file income tax returns was not provided for under the original 1977 NIRC,” read the 41-page resolution penned by Commissioner Aimee Ferolino.

      “To be clear, the penalty of perpetual disqualification came into force only upon the effectivity of PD 1994 on 01 January 1986,” it added.

      The ruling said the penalty cannot be made to apply to respondent’s tax violations, which were committed before the effectivity of the said law, in accord with the constitutional prohibition against ex-post facto laws.

      “The petitioners said that despite its omission from the trial court and Court of Appeals decisions, the penalty of perpetual disqualification was ‘deemed written therein’,” the ruling said.

      “The contention lacks merit,” it added.

      “A penalty that would deprive a citizen of his political right to be voted for in an election should be clearly, unequivocally, and expressly stated in the decision,” the ruling said. 

      ‘Moral turpitude’

      The ruling also indicated that Marcos’ failure to file income tax returns in 1982 to 1985 was not a crime which involved moral turpitude.

      “After carefully examining each argument of the parties and the circumstances surrounding respondents failure to file income tax, we find to rule in respondent’s favor,” the resolution read.

      The former first division said the failure to file tax returns was neither immoral nor did it involve fraud.

      “Is the failure to file tax returns inherently immoral? We submit that it is not. The failure to file tax returns is not inherently wrong in the absence of a law punishing it,” the former First Division said.

      “Was there fraud in the failure to file income tax returns of respondent? We don’t think so,” it added.

      Citing the case of Jose B. Aznar vs. Court of Tax Appeals, the Comelec said the Supreme Court considered the failure to file income tax returns “a mere omission on the part of the taxpayer, thereby removing it from the ambit of acts that constitute fraud.” 

      The Comelec division likewise ruled against the argument in the Ilagan petition, claiming that failure to file income tax returns is considered a form of tax evasion.

      The commissioners said the Local Finance Committee of the Province of Ilocos certified that the taxes due Marcos were withheld against his salary.

      They also said the records are bereft of any evidence that Marcos voluntarily and intentionally violated the law.

      “While he was found by a competent authority to have failed to file his income tax returns, failing to file a return, standing alone, is not an attempt to evade or defeat tax,” the resolution read.

      In ruling out that failure to file tax returns is a crime involving moral turpitude, the Comelec Division cited the SC ruling in the case of the Republic of the Philippines vs. Ferdinand Marcos II and Imelda Marcos, which they said, ruled that a failure to file a tax return is not a crime involving a moral turpitude.

      Not binding precedent

      Retired Comelec Commissioner Rowena Guanzon, former First Division presiding officer, in her separate opinion released January 31, said this jurisprudence is not a “binding precedent” as this is just an “obiter dictum” or as defined by the Supreme Court, is “an opinion expressed by a court upon some question of law that is not necessary in the determination of the case before the court.”

      However in the resolution penned by Ferolino, the Comelec Division said the SC also ruled that “a dictum that generally is not binding as authority or precedent within the stare decisis rule may be followed if sufficiently persuasive.”

      “Therefore, having found the same to be true in the aforesaid case of Republic vs. Marcos II and Marcos, We see no legal infirmity in a =dopting the said dictum in the hopes of finally putting the issue on moral turpitude to rest,” the resolution read.

      The Comelec Division also answered in the affirmative on the issue whether Marcos is qualified to be elected as the Philippine president.

      The commissioners stated that Marcos’ failure to pay the fines before the QC RTC, which the petitioners claimed to be equivalent to serving Marcos’ sentence, is not a ground for disqualification under the Omnibus Elections Code.

      “It is clear as day that Respondent’s sentence to pay fines does not fall under any of the above-mentioned instances for disqualification under Section 12 of the OEC to operate,” the Comelec Division said.

      “Thus, whether or not he satisfied the payment of fines and penalties with the RTC of Quezon City is immaterial, as his sentence did not fall within the purview of  Section 12 of OEC,” the resolution read.

      In concluding the resolution, the Comelec division explained the importance of preventing “convicted criminals and the underserving” from running and being voted for.

      No bias

      As the institution mandated to enforce and administer all laws relating to the conduct of the elections, the Comelec division said the poll body “must see to it that is judgment is free from bias and partiality.”

      “We recognize that the resolution of the instant case is of paramount importance, considering that the 2022 [National and Local Election] is fast approaching. However, the deprivation of one’s right to be voted for in any election should not be exercised whimsically and capriciously, lest we will be preventing qualified candidates from pursuing a position in public office,” the Comelec division said.

      Another member of the First Division, Commissioner Marlon Casquejo has issued a separate opinion which bolstered Ferolino’s argument that the case of Marcos has long attained finality.

      Thus, the petitioners could not assert that the judgment did not reach its finality if it is a void judgment.

      He said the petitioners could not rely on the case of Gonzales vs. Solid Cement Corporation as careful scrutiny of the said jurisprudence would show that “it is in fact misleading to the point that if read in the context of how the petitioners present it, would lead a gullible reader to believe that this commission can in its almighty power declare the final judgment of the Court of Appeals in Republic vs. Marcos void.”

      He added that the Marcos case and the cited jurisprudence have a different factual milieu and different nature.

      Further, he pointed out that the solicitor general should have filed an appeal within the prescribed period if the CA decision on Marcos case was actually void.

      Casquejo’s separate opinion also backed Ferolino’s ruling, saying it is the dispositive portion of the decision that controls the purposes of execution.

      He said the CA ruling, modifying the RTC ruling is written in clear language that casts out ambiguities.

      “Again, in light of being repetitious, the undersigned once again stress that the Commission will not be used as instruments by any party to exercise jurisdiction to modify a decision that has long became final. At some point issues must come to an end,” he said.

      “Not all modification or reversal in every ruling becomes void just because one party feels [aggrieved] or unsatisfied. Much more can just any person disturb a final ruling that has long rested in the confines of the archives of the court,” he added.

      Moreover, Casquejo said special penal law  on the accessory penalties are deemed written in the decision under Article 73 of the RPC  but this has no “automatic application” when it comes to special penal laws.

      Crime of omission

      Lastly, Casquejo said the non-filing of ITR does not equate to moral turpitude. 

      While he believes that the non-filing of ITR, which speaks of crime of omission on the part of Marcos, is “necessarily punishable by law,” he said this “will not suffice to equate to moral turpitude.”

      He cited the case of Edgar Teves vs Comelec which involves a candidate for election but was convicted of violation of the Anti-Graft Corrupt and Practices Act.

      Casquejo applied to Marcos’ case the SC jurisprudence which downgraded the indeterminate penalty of imprisonment of nine years and 21 days as minimum to 12 years as maximum to a lighter penalty of fine of P10,000 is a recognition that petitioner’s violation was not intentionally done contrary to justice, modest, good morals but due to his lack of awareness or ignorance of the prohibition.

      He said Marcos cannot be faulted if the CA found grounds to modify the ruling of the RTC and obliterated the imposition of imprisonment.

      Casquejo stated that Marcos has all the right to claim and declare that he has not been found liable for an offense which carries with it the accessory penalty of perpetual disqualification to hold public office which has become final and executory.

      “The Commission is confronted with legal issues subject to strong public scrutiny. But no matter how unpopular our findings and appreciation of facts and the law is, we must remain unperturbed and apply the law as it is,” Casquejo wrote.

      “The welfare of the general public is best served when we resolve any case without fear or favor. That is the true test of integrity. We examine each case based on how they were presented, coupled with evidence, the law and jurisprudence to back up every decision. We are not easily swayed because our duty to uphold the Constitution is more paramount than fear of reprisal,” he added.

      The consolidated disqualification cases against Marcos which was handled by the First Division became controversial when Guanzon accused Ferolino of delaying the resolution of cases.

      She claimed that the reason behind the delay was there were efforts to influence Ferolino.

      Ferolino, however, accused Guanzon of trying to influence her decision on the said cases.

      Prior to her retirement, Guanzon had already released her separate opinion where she voted for Marcos’ disqualification as she believes that the non-filing of income tax returns for four consecutive years constitutes moral turpitude.

      Six out of seven petitions against Marcos’ candidacy had already been junked by the Comelec divisions.

      Only the disqualification case filed by Pudno Nga Ilokano remains pending before the Comelec.—NB/LDF, GMA News

      2 senior citizens ang kauna-unahang namatay sa Omicron

      The Philippines on Wednesday confirmed the first domestic deaths caused by the highly infectious Omicron variant of COVID-19.

      The  Department of Health said those who died were elderly patients with existing health issues and had not been vaccinated against COVID-19.

      The two were “aged more than 60 years, unvaccinated, and had pre-existing medical conditions,” the DOH said.

      “While Omicron mostly presents with asymptomatic and mild disease, our data shows that those most at risk for fatalities are still the elderly and those with co-morbidities and unvaccinated,” it said.

      Drilon: DOJ should not allow unvaxxed PAO chief to report to work

      Chief of the Public Attorney’s Office (PAO) Persida Acosta must be disallowed from reporting to work, following her refusal to get vaccinated against COVID-19, Senate Minority Leader Franklin Drilon told Malacanang and the Justice Department on Wednesday.

      This comes days after Acosta admitted in a television interview that she chose to not receive the COVID-19 vaccine, citing age and other health reasons. 

      Senate Minority Leader Franklin M. Drilon urged Malacanang and the Department of Justice (DOJ) not to allow Public Attorneys Office (PAO) Chief Persida Acosta to report to work, saying that the PAO chief’s continued refusal to get vaccinated undermines the government’s COVID-19 vaccination campaign.

      ‘Hindi ba sampal iyon sa gobyerno?’ Drilon says

      “Acosta is putting the life, health and safety of her co-workers in danger and that should be dealt with accordingly and decisively,” Drilon said in a statement on Wednesday.

      Drilon said the government will be accused of double standards if it allows Acosta to report to work while it restricts the movement of unvaxxed ordinary Filipinos.

      “If the government is serious about its ‘no vax, stay at home; no vax, no ride policy,’ it should apply it to all. Otherwise it will not work,” Drilon said.

      “The government should take the same hardline stance against their own officials. Set an example with Acosta,” he stressed.

      Drilon added that barring Acosta from reporting to work is consistent with the President’s pronouncements that he will restrict movements of unvaxxed individuals “for common good.”

      The former justice secretary said that the government may impose restrictions for unvaccinated Filipinos to contain the further spread of the COVID-19 virus and promote the general welfare and public health.

      Acosta’s boss, Justice Secretary Menardo Guevarra, also said the same, saying in an interview that while there is no law making anti-COVID vaccination mandatory, the PAO chief has to obey government regulations restricting the movement of unvaccinated individuals in the interest of public safety.

      It is well within the power of the State to restrict the movement of unvaccinated individuals, according to Drilon.

      “It is a valid and reasonable exercise of police power to promote the health, safety, and general welfare of the people. The general welfare clause also provides sufficient authority to the State to implement measures for the ‘maintenance of peace and order, the protection of life, liberty, and property, and promotion of the general welfare,'” Drilon said.

      “The State may also interfere with personal liberty to promote the general welfare as long as the interference is reasonable and not arbitrary,” he previously said.

      In the United States, Drilon said the exercise of police power in promoting public health and safety has long been upheld. In 1905, the US Supreme Court in Jacobson v. Commonwealth of Massachusetts [197 U.S. 11 (1905)] upheld the compulsory vaccination of persons over the age of 21 against smallpox. It ruled that the vaccination program had a “real and substantial relation to the protection of the public health and safety.”

      Drilon also cited Zucht v. King [260 U.S. 174 (1922)] wherein the parents of an unvaccinated child excluded from school challenged the ordinance requiring vaccinations for schoolchildren as violative of the Equal Protection and Due Process clauses. The Court held that “it is within the police power of a State to provide for compulsory vaccination” and that the ordinance did not bestow “arbitrary power, but only that broad discretion required for the protection of the public health.”

      Drilon said that he finds it “unacceptable” that while the government is persuading people to get their COVID-19 shots, Acosta remains unvaccinated.

      ‘Hindi ba sampal iyon sa gobyerno?” Drilon said, “I hope it is not deliberate but Acosta’s recent statements can fuel vaccine hesitancy that we are trying to address.”

      While vaccine acceptance has improved in the country, Drilon said the number of Filipinos unwilling to get vaccinated remains a cause of concern.

      “One of them, unfortunately, is a member of the administration. Acosta can make a good case study for the government. If you can convince Acosta to get vaccinated, then the government has a better chance of persuading every Juan dela Cruz to get vaccinated,” Drilon said.

      “But until she gets vaccinated, she should be barred from reporting to work” he said.

      Opposition coalition 1Sambayan expressed alarm after the Commission on Elections Second Division dismissed the petition to cancel presidential aspirant Bongbong Marcos’ certificate of candidacy for the upcoming polls, as filed by their ally Atty. Theodore Te.

      “We in 1SAMBAYAN are concerned to learn of the decision of the Comelec Second Division to dismiss the petition to cancel the Certificate of Candidacy (COC) of the son of the late dictator based on the grounds of material misrepresentation. While we understand and respect the authority of the Comelec, 1SAMBAYAN will continue to monitor the developments in this issue,” the group led by Retired Supreme Court Senior Associate Justice Antonio Carpio said in a statement.

      “The dismissal of the petition is not final and is subject to appeal. Marcos Jr. remains a convicted criminal who has not served his sentence. Reasonable people can agree that such a person should not hold public office,” they added, noting 1Sambayan will continue to keep watch over this case and similar petitions blocking Marcos’ candidacy.

      The group is referring to Marcos being found guilty of not filing his income tax returns from 1982-1985, which was first given by a Quezon City court and upheld by the Court of Appeals.

      “As for now, our objective remains: to continue with our efforts to show that Leni Robredo is the best candidate among those seeking the highest office of the land,” it said.

      President Rodrigo Duterte commended the military for its “tireless toil” and said he was satisfied with the performance of the national police despite a few “bad eggs.” 

      Duterte made the statement during a taped meeting with officials where the military summarized its contributions to the government response to typhoon Odette, the strongest storm of 2021 that struck last month. 

      “Utility worker itong mga sundalo, ‘yan. Bagyo, baha, sunog, landslide, away, kanila ‘yan,” Duterte said in the meeting that aired on Tuesday.

      “‘Pag wala kang ma-mobilize, mga ganitong biglaan na there’s a lot of people to be assisted, sundalo lang talaga ‘yan matawag mo na para matulong, na hindi magsabi hindi.”

      He said policemen can also be tapped during emergencies “to a certain extent.” 

      “But if the head happens to be a corrupt officer, down below, corruption malakas.” 

      Duterte said some police generals were involved in illegal drugs when his presidency started. 

      Other controversies that hounded the PNP during Duterte’s term include killings in his drug war, the ransom and murder of a South Korean businessman, and alleged corruption, among others.

      “But overall, actually ang pulis, I am satisfied. Magtatapos na ako ng term ko. For the so many years I have been there, commander in chief, okay ang performance except a few,” said the President.

      “There will always be bad eggs. Basta ang organization na ganoon kalawak, meron talagang scalawag,” he said of the 221,000-strong police force.

      Duterte noted that former military generals in his Cabinet headed the cleanup of the Manila Bay and Boracay island, as well as the country’s COVID-19 vaccine procurement.

      “I am praising the military because they deserve it,” he said.

      “In behalf of the Filipino people, I would like to commend, salute the Armed Forces for their tireless toil during times of need, times of crisis, and the time to help your fellow man,” added Duterte.

      President Rodrigo Duterte is pushing for a bigger statue for the country’s first national hero, Lapu-Lapu in Cebu province.

      During his taped public address aired Tuesday, Duterte said he’s “very uncomfortable” with the fact that Lapu-Lapu’s monument is smaller than Magellan’s.

      “I mean no offense kay Magellan. He made the trip from somewhere in Spain, tapos Mexico. Dumating siya sa in the shores of Limasawa. They were trying to conquer the Philippines,” according to the President.

      “I think as a Filipino at presidente ako ngayon, gawin na lang natin, mag ano tayo ng pera, palakihan natin ng konti. Mas malaki kesa kay Magellan. Hindi pwede na maliit ang national hero,” he added.

      Duterte instructed the National Historical Commission of the Philippines to go to Cebu and “try to look at the situation without offending the Cebuanos.”

      Disqualification kontra BBM ibinasura ng Comelec! Leni Robredo nagsalita na!

      Presidential aspirant Vice President Leni Robredo on Monday, Jan. 17, shrugged off the disqualification cases against her rival, former Senator Ferdinand “Bongbong” Marcos Jr., before the Commission on Elections (Comelec), whose second division earlier junked one of the cases.

      “Hindi, hindi namin inaabangan kasi whatever naman nung desisyon ng Comelec, hindi naman apektado ‘yung laban,” she told reporters during a chance interview at the sidelines of her Swab Cab project in Antipolo City.

      Robredo also earlier said that personally, she would want to face Marcos in the upcoming presidential elections to prove “once and for all” that she won in 2016.

      The son of the namesake of the former dictator petitioned for Robredo’s removal from office for allegedly cheating in the vice presidential polls. This was junked by the Supreme Court in February last year.

      “Lagi naman namin sinasabi na ‘yung laban ng aking kandidatura ay hindi naman nakadepende saka nakabase sa galaw ng ibang mga kandidato,” Robredo said.

      “Tayo, whatever the decision will be, sige lang tayo,” the Vice President added.

      On Monday, the poll body’s second division junked the petition filed by former Supreme Court spokesperson Theodore Te, representing political detainees and human rights and medical organizations that opposed the Martial Law, for the cancellation of Marcos’ Certificate of Candidacy (COC).

      Druglord Kerwin Espinosa at 2 pa nagtangkang tumakas sa NBI detention cell

      Nabigong makatakas ang pinaghihinalaang drug lord at self-confessed drug dealer na si Kerwin Espinosa at dalawa pang kasamahan nito sa kanilang kulungan sa National Bureau of Investigation (NBI) nitong Enero 13.

      “In view of this incident, security measures at the jail have since been tightened with regular inspection of all jail facilities,” pahayag ni NBI Officer-in-Charge Director Eric Distor nitong Lunes, Enero 17.

      Kaya lamang aniya napigilan ang pagtakas ni Espinosa at dalawa pang nakakulong na hindi na isinapubliko ang pagkakakilanlan dahil sa maagap na pagtugon ng mga tauhan ng NBI.

      Nitong Enero 13, nakatanggap aniya ang mga opisyal ng NBI-Security and Management Section (NBI-SMS) ng impormasyon na pinaplanong tumakas ni Espinosa at dalawang iba sa pamamagitan ng butas ng isa sa exhaust fan sa kisame ng kanilang kulungan.

      “On the same night, they immediately conducted an inspection of the jail. In one of the cells of the jail, the raiding team,” aniya.

      Noong Disyembre 17 ng nakaraang taon, ibinasura ng Makati City Regional Trial Court (RTC) ang kinakaharap na drug cases nito at ng tatlo niyang kasamahang akusado at nangyari ito bago pa man sila makapagharap ng mga ebidensya sa hukuman.

      Kasama rin sa inabsuwelto sa kaso sina Wu Tuan Huan, alyas Peter Co, Lovely Impal, at Marcelo Adorco.  

      Isinagawa ang pagbasura sa kaso nang aprubahan ng hukuman ang isinampang demurrer to evidence na iniharap ng mga akusado dahil sa umano’y kahinaan ng ebidensya ng mga prosecution panel.

      Gayunman, nakakulong pa rin si Espinosa dahil sa kinakaharap na illegal drug cases sa Manila City at sa mga hukuman sa Leyte.

      Here are some highlights in the ruling: “In essence, the Comelec agreed with the petitioners that the representations made in Item 11 and Box 22 of the COC of Marcos Jr. are material but disagreed that they were false; in the process, the Second Division ruled that there was no ground to cancel Marcos Jr.’s COC on the ground of material misrepresentation,”

      In resolving the petition, the Comelec division said they cannot “agree with Petitioners’ theory that Respondent’s convictions for failure to file [ITRs] for taxable years 1982 to 1984 render him perpetually disqualified from holding any public office, to vote and to participate in any election for the simple reason that to do so would violate the Constitutional proscription against ex post facto laws.”

      “The CA Decision is correct for not imposing on herein Respondent the penalty of perpetual disqualification from holding any public office, voting, participating in any election. There was no error in judgement as the CA Decision was in accord with the law in force at the time of commission of violations,” the ruling read.

      “Since Respondent was not meted the accessory penalty of perpetual disqualification from public office, it cannot be rightfully said that he committed a false misrepresentation when he answered in the negative to the question in Item No. 22 of his COC. In like manner, when Respondent declared in Item No. 11 of his COC that he is eligible for the office for which he seeks to be elected to, he was essentially speaking the truth,” it added.

      “It is clear therefore that when Respondent replied ‘No’ to the question in Item No. 22 of his COC, he did so without any intention to mislead, misinform, or hide a fact which would otherwise render him ineligible,” it said.

      Mga dapat tandaan sa pagsisimula ng ‘No vax, No ride’ policy ngayong araw

      Hindi ang pasaherong lalabag sa “no vaccination, no ride” policy ng Department of Transportation (DOTr) sa pampublikong transportasyon ang mapapatawan ng multa kung hindi ang driver at operator ng sasakyan, ayon sa isang opisyal. Gayunman, hindi pa rin lubos na lusot ang pasahero.

      Sinabi ni DOTr Road Transport Sector Assistant Mark Steven Pastor, na maaaring maparusahan ang mga driver at operator sa ilalim ng Article I, Section J ng Joint Administrative Order No. 2014-01.

      “Ang fines magsisimula sa P1,000 hanggang P10,000 depende kung pang ilang paglabag sa ating polisiya,” ani Pastor.

      “Maaaring ma-suspend ang prangkisa depende sa gravity ng offense na kanilang na-commit,” dagdag pa ng opisyal.

      Sinabi naman ni DOTr Undersecretary for Legal Affairs and Procurement Reinier Paul Yebra, na hindi kasi sakop ng Department Order No. 2022-001 ang mga pasahero kaya hindi sila mapapatawan ng multa.

      “Para sa mga magba-violate ng ‘no vaccine, no ride,’ linawin natin ‘pag pasehero po, sa Department Order, wala tayong penalty doon kasi hindi po ‘yun saklaw ng Department of Transportation,” ayon kay Yebra.

      Pero puwede pa ring maparusahan ang pasahero kung mayroong hiwalay o sariling kautusan na umiiral ang lokal na pamahalaan tungkol sa paglilimita sa galaw ng mga taong hindi pa bakunado ng panlaban sa COVID-19.

      “Ang range po niyan nasa P500 up to P5,000. ‘Yung iba naman po may kasamang imprisonment ranging from five days to six months,” ani Yebra.

      Ipinaliwanag din ng opisyal na hiwalay ang parusa ng LGU ordinance sa pinapatawan ng parusa sa ilalim ng Republic Act No. 11332 o Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act.

      “Doon kasi pine-penalize ang non-cooperation na tinatawag at ang penalty doon ay merong fine from P20,000 to P50,000 at imprisonment of one month to six months,” sabi pa ni Yebra.

      Paalala rin ni Yebra, may parusa sa Revised Penal Code sa mga pekeng COVID-19 vaccination cards na ang multa ay aabot sa P1 milyon at kulong ng anim hanggang anim na taon.

      Sa Department Order No. 2022-001 ng DOTr, hindi maaaring sumakay sa mga pampublikong transportasyon ang mga wala pang bakuna ng COVID-19 vaccines dahil na rin sa mataas na kaso ng hawahan g virus sa Metro Manila.

      Metro Manila stays under Alert Level 3

      The National Capital Region (NCR) will remain under Alert Level 3 until the end of January amid the rise in coronavirus disease (COVID-19) cases, Malacañang said Friday (Jan. 14).

      Acting presidential spokesperson and Cabinet Secretary Karlo Nograles announced this decision made by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF-EID) in a Palace briefing.

      The Metro Manila Council (MMC) earlier decided to retain the Alert Level 3 status for NCR, citing enough restrictions in place and only a slight increase in the region’s healthcare utilization rate (HCUR) despite the increasing number of COVID-19 infections.

      In IATF Resolution 157-A, also under Alert Level 3 from January 16 to 31 in Luzon are Baguio City, Ifugao and Mountain Province in the Cordillera Administrative Region (CAR); Dagupan City and Ilocos Sur in Region 1 (Ilocos); Santiago City and Cagayan in Region 2 (Cagayan Valley); Angeles City, Aurora, Bataan, Bulacan, Olongapo City, Pampanga and Zambales in Region 3 (Central Luzon); Rizal, Batangas, Cavite, Laguna and Lucena City in Region 4-A (Calabarzon); Marinduque and Romblon in Region 4-B (Mimaropa); Camarines Norte, Camarines Sur, Naga City and Sorsogon in Region 5 (Bicol).

      Areas in the Visayas under Alert Level 3 are Iloilo City, Iloilo province Negros Occidental and Guimaras in Region 6 (Western Visayas); Lapu-Lapu City, Bohol, Cebu and Negros Oriental in Region 7 (Central Visayas); Ormoc City, Biliran, Samar, Eastern Samar, Leyte, Northern Samar and Southern Leyte in Region 8 (Eastern Visayas).

      In Mindanao, the areas under Alert Level 3 are Isabela City, Zamboanga City and Zamboanga del Sur in Region 9 (Zamboanga Peninsula); Bukidnon, Iligan City, Misamis Occidental and Misamis Oriental in Region 10 (Northern Mindanao); Davao del Sur and Davao del Norte in Region 11 (Davao region); General Santos City and South Cotabato in Region 12 (Soccsksargen); Surigao del Sur and Agusan del Norte in Caraga; and Lanao del Sur in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM).

      Meanwhile, placed under the less strict Alert Level 2 are Apayao, Batanes, Palawan, Puerto Princesa City, Masbate, Siquijor, Zamboanga del Norte, Zamboanga Sibugay, Camiguin, Lanao del Norte, Davao de Oro, Davao Occidental, Davao Oriental, North Cotabato, Sarangani, Sultan Kudarat, Dinagat Islands, Surigao del Norte, Basilan, Maguindanao, Sulu and Tawi-Tawi.

      Under Alert Level 3, establishments or activities shall be allowed to operate or be undertaken at a maximum of 30% indoor venue capacity for fully vaccinated individuals only and 50% outdoor venue capacity, provided that all workers of the establishments are fully vaccinated against COVID-19.

      Intrazonal and interzonal movement are still allowed, however, reasonable restrictions may be imposed by the LGUs, which should not be stricter as those prescribed under higher alert levels and subject to the oversight, monitoring, and evaluation of their respective Regional IATF.

      Those below 18 years of age, and those belonging to the vulnerable population, shall be allowed access to obtain essential goods and services, or for work in permitted industries and offices in accordance with existing labor laws, rules, and regulations. Individual outdoor exercises shall also be allowed for all ages regardless of comorbidities or vaccination status.
