Sa pagtatapos ng House hearing on the legislative franchise of ABS-CBN Corp, si Rep. Elpidio Barzaga (Cavite 4th District) ay muling nagpahiwatig ng hindi pagbibigay ng tamang buwis ang pinag-uusapang kompanya.

Ang ABS-CBN ay may ‘tax avoidance scheme’ na ginagawa upang palabasin na sila ay nagbabayad kuno ng tamang buwis. Ngunit pinagdiinan ni Barzaga na sila ay lumalabag sa batas ng tamang pagbabayad ng buwis. ABS-CBN is a tax avoider!

DEPED SECRETARY LEONOR BRIONES: Thank you, Mr. President. My statement will be very short. It’s based on a letter which I wrote to you after you made your statement about not allowing the opening of classes during the time of COVID.

And so we are here from the DepEd to assure you that we are one with you in your uncompromising stand on the matter of the health and the safety of our learners and our teachers.

You said, “I will not allow the opening of classes na dikit-dikit ang mga bata. Para sa akin bakuna muna bago — andiyan ang bakuna, okay na.”

We are saying because there is confusion and anxiety among Filipinos families especially the parents. We are — we are here to state that we are one with you, Mr. President, in this nonnegotiable commitment. It is the first and the most important principle when we worked out our learning community plan with all the details. We stated this also: The first and foremost concern is the health and safety of all learners and our teachers.

Mr. President, there has been a confusion among our people who associate the opening of school with what we describe as “face-to-face” classes.

Well, we are used to learners, we are used to teachers facing each other and we are used to children going to school physically. But we are saying that there will be no face-to-face classes and sessions until we are assured of the safety of our children and our teachers.

However, we also believe, Mr. President, that we can provide learning opportunities to our students without necessarily requiring them to go to school, and this we can do through what is describe as “blended and distant learning.”

Mr. President, this is not a new thing. We have many universities and schools which offer distant learning in many ways. We now call it blended learning because various approaches which are adjusted to the actual situation of the communities will be applied.

But these are all, Mr. President, consistent with your preference that we should not be physically sending our children to school until it is safe to do so.

What is this so-called blending or learning modalities? Because right now there is a bill which is filed in Congress on this. One, for those who don’t have connections, who don’t have interactive facilities, there will be what we describe as printed material which will be delivered to the homes of the students through the barangays, can be picked up also by their parents at designated places within coordinated schedules. We will be working very closely with the barangays and the local governments.

And the second approach is now very popular, Mr. President, this is the online learning platform and we, in DepEd, we have what we describe as DepEd Commons. Right now, we already have over 7 million subscribers wherein lessons, homework, quizzes, tips to learners and to teachers are all in the DepEd Commons and are accessible even to the parents.

So we have instances, Mr. President, of parents who are abroad and who are monitoring what is happening to their children, they also re — go to the DepEd Commons and check on how the children are doing. Now in cases, Mr. President, where there is no connectivity and printed materials may not be available immediately, we have the classic long- time approaches, which have always been used in education, and this would be television. Those homes which do not necessarily have connectivity and — may have television.

And the most and the best used approach, of course, is radio-based instruction. Kasi ang television mga 1950s, ‘60s, radios have been around since the 1800s when it was first invented.

And we know the two World Wars were won through radio messages and not necessarily computers and so on. So ‘yung printed modules, Mr. President, we have a description of what it entails.

And then also on the matter of online, ito ‘yung popular talaga — it’s gaining popularity — online distance learning with already 7 million subscribers and we assume here that they have access to Internet. And one worry is, how about the students and the teachers? Do they have access to laptops?

We made a survey, Mr. President, of teachers more than about 788,000 of them to find out whether they have laptops or desktops in their homes. More than 80%, nearly 700,000 have laptops or desktops in their homes because teachers acquire these for various uses. They have family members abroad, or friends, et cetera, et cetera. So this is a very, very popular mechanism for dispensing education.

Now for those who don’t have access to interconnectivity, then we have television. Right now, Mr. President, 15% of television time — this is provided by law — should be dedicated to programs of — programs designed for children. So there are already existing educational programs on television stations. What we need to do is to utilize these programs to transmit our curricula and we are working out how to do this.

For example, Mr. President, PCOO is volunteering its TV facilities and also IBC-13 which is radio for the utilization of lessons through radio and television. Radio and television for those who don’t have access to computer.

Now radio-based instruction is quite popular, Mr. President, because right now municipalities are volunteering. Usually municipalities have their radio stations, cities have radio stations, there are local radio stations and big networks also have radio stations, and many of them have lessons which ‘yung tawag niyon is “schools on the air”. Mayroong mga religious groups, they give lessons in agriculture, lessons in whatever sciences over the air because alam nila not everybody has access to television or to online computers.

So ito ‘yung pinaka-ancient — pinakamatandang paraan for teaching as an alternative to face-toface. Now, Mr. President, what we are doing in the regions is — the regions are different from each other. Some regions have many islands, some regions have many mountains, some regions have interconnectivity and so on and so forth.

So what our regions are now doing is to translate our curriculum from curriculum for lecture — the teacher lectures the children for long periods of time. It has to be translated one into digital modes sa platforms natin into television programs because children have to be taught through — in a different way.

Iba ‘yung effect ng television programs because their attention span can be very brief as well. And then also converted into radio scripts. So this is where much of the work is now being concentrated.

What we are saying, Mr. President, is that we fully and completely support your stand that our children should not be exposed to the dangers of COVID-19 physically but we are also offering opportunities for them to continue their studies and their learnings.

And some people ask: are we prepared? What we are trying to do, Mr. President, are not really new. Hindi naman ito bagong imbento because distance education — many universities have distance education programs. Many local governments have radio stations. We are utilizing existing ways of communication without necessarily requiring our children to go to school.

So they can still go to school, they can still study, teachers can monitor them as well as their parents.

So ito ‘yung ano namin, Mr. President, which we would like to share with you and we seek your approval of our alternative ways of learning which are already existing right now.

And these are being done by many schools but this time mas malaki ang emphasis because we are now shifting to less physical, face-to-face classes, but education will continue, Mr. President. Thank you.

PRESIDENT DUTERTE: I’m impressed with the simplicity of the program, ma’am. And I believe that all that you have said is really feasible. Radio kung walang television and all of these things.

I — I believe we have a very workable program and I support you.

SEC. BRIONES: Thank you, sir.

PRESIDENT DUTERTE: And should you require any help from any of the departments, feel free to communicate to them. If it’s a question of funding, I will — sought to speak, scrape the bottom — the bottom of the barrel…

You just sign a whatever document there. I will pay for the hospitalization of any Filipino who finds himself in a strange place and he has nowhere to go.

That is really an order of the national government to the local governments. Help, do not deny, and you must expedite the hospitalization until he is cured. No problem about payment. I will pay. Just bill me and I will pay.

MANILA – Deputy Speaker Rodante Marcoleta on Tuesday claimed that the embattled broadcast network ABS-CBN did not comply with the terms and conditions of its franchise, as well as with existing laws and the country’s Constitution.

Marcoleta made the statement during the joint hearing of the House committee on legislative franchises and the House committee on good government and public accountability on the proposals seeking to grant a full 25-year franchise to ABS-CBN.

“In fact, they will show in the succeeding hearings in the committee of legislative franchises that ABS-CBN deliberately and with impunity violated the conditions of its legislative franchise, and more so of our laws and our Constitution,” Marcoleta said.

He said the panel should deny the franchise application of ABS-CBN, noting that the network’s previous franchise lasted longer than the constitutionally-mandated 50-year period.

“The ABS-CBN has been using the airwaves for more than 50 years, 53 years today to be exact. Our Constitution says that Congress can grant a franchise of up to 50 years only,” he said.

“The committee on the legislative franchise should not allow itself to be used by ABS-CBN to again circumvent the Constitution and violate the categorical 50-year limitation imposed on franchises,” he added.

He also cited that the ABS-CBN violated the Constitution, which requires 100-percent Filipino ownership and management of mass media companies.

He said the network’s former president, Eugenio “Gabby” Lopez III, was an American citizen when he took the helm of the company in 1986. It was only in 2000 that Lopez petitioned for recognition of Filipino residency.

He further argued that the network is foreign-owned because of its Philippine Depositary Receipts (PDR), which virtually allowed foreign holders beneficial ownership and potential voting rights.

Marcoleta said the network committed unfair labor practices, which consequently denied its employees the benefits required by law.

He said that of the 11,000 ABS-CBN employees, almost 8,500 are contractual workers and talents.

“ABS-CBN has not regularized its contractual workers and talents despite performing the functions of regular workers,” he said.

“Hindi po maikakaila sa publiko na napakarami ng labor cases na hinarap at haharapin pa ng ABS-CBN. Ang masaklap pa dito, ni hindi nagbibigay ang ABS-CBN ng contribution sa benefits,” he added.

(It is not a secret that ABS-CBN is and will be facing numerous labor cases. What makes it worse is that ABS-CBN is not giving a contribution to the benefits [it is reaping].) 

Marcoleta slammed ABS-CBN for its alleged political bias for certain candidates in the 2010 and 2016 presidential elections, contrary to the terms of its franchise and in violation of the Omnibus Election Code.

“It is also a matter of record that ABS-CBN failed to air some of President Duterte’s political advertisements during the 2016 campaign period despite receiving the payment of these political ads,” he added.

Other violations enumerated by Marcoleta include offering a pay-per-view service Kapamilya Box Office (KBO) channel (via TV Plus) through free-to-air signals, and the “tax evasion” schemes of the network.

“ABS-CBN violated the terms and conditions of its franchise by offering its TV Plus boxes for a one-time fee, but using the free-to-air signal authorized in the franchise granted by Congress to ABS-CBN at no cost,” he said.

“ABS-CBN also violated the terms and conditions of its franchise by engaging in tax avoidance schemes which deprived the government of the much-needed revenue,” he added.

He said that the network used its fully owned subsidiary, Big Dipper Digital Content, and Design, as a tax shield. The Big Dipper’s main customer is a foreign Hungary-registered company, which is also a fully-owned subsidiary of ABS-CBN.

“Because of this unconscionable tax avoidance scheme, ABS-CBN’s alleged effective tax rate in 2018 was at -5 percent. This means that ABS-CBN managed to avoid paying taxes in 2018,” he said.

He said the network also did not pay its rightful taxes in 2019 by entering into a compromise agreement with the Bureau of Internal Revenue, with the latter accepting the former’s settlement of around PHP152 million, equivalent to 40 percent of its assessed deficiency in income tax, value-added tax, and documentary stamp tax payments.

During the same hearing, ABS-CBN president and CEO Carlo Katigbak said that the network has not violated any laws.

“We agree. The law is the law. And under the law, we are innocent under proven guilty. Up to now, there is no court that has determined we have broken any laws,” he said.

“Sabi po ng BIR, bayad ang aming buwis. Nanggaling sa SEC (Securities and Exchange Commission) na aprubado sa kanila ang pag-issue ng mga PDR. Ang Department of Justice ang nagsabi na hindi labag sa prangkisa ang KBO. Ang DOLE naman ay nagsabi na sumunod kami sa lahat ng compliance orders nila,” he added.

(The BIR [Bureau of Internal Revenue] said we paid our taxes. It came from the SEC that it approved the PDR issued [to us]. The Department of Justice said that the KBO is not a violation of the franchise. Meanwhile, the DOLE said we complied with the compliance orders from them.)

Katigbak said that while they are not a perfect organization, they are prepared to fix any issues of the company.

Sa pagka ngayon, mayroon tayong 24,000 stranded in Manila and they are stranded in the sense that they are not allowed or they cannot go home because the local governments are not accepting them — are not accepting them.

So mayroong mga pronouncement na ang policy na they will not accept returning OFWs. Ang masama nito kasi ‘pag ganun ang behavior natin, Secretary Bello says that there are about 302 coming in in a short while and 62,000 —- 302 and 62,000 are expected to arrive as soon as our airports are open.

You know, in the — not really confusion but in the — in their desire to protect their respective turf, territories kaya ganun man, and I can say that if that is the way they would handle it like a somebody who is really a chieftain of a city or province during a pandemic time, okay ‘yan.

Pero alam mo hindi naman lahat talaga nagkasakit and it is very cruel actually to deny them to go home.

Nandito ‘yan sila sa hotel because they are not or they cannot go home. First because of lack of money and resources. So I have instructed — [was it last night?] — through Secretary Roque that I am ordering the use of all government assets whether it’s really the air or the sea or the transportation owned by government that should be utilized in accepting and probably delivering them to their — if possible, delivering them to their homes, to their families.

Now itong coming na 302 is an — it’s a big worry. Now ‘yung 62 na dadating shortly, ‘pag hindi ninyo tinanggap ‘yan, magkagulo tayo ang Pilipinas.

Now let me be very clear. Let me talk about legality para wala tayong — wala tayong sakit ng loob. Nobody but nobody can really stifle the right of a — whether he is traveling and working outside and coming in, going home. Nagkaroon lang itong temporary — an aberration in the movement of people because of the COVID.

Ito ang sasabihin ko sa lahat: I said nobody but nobody. And only the national government can impose restrictions on travels because it is the only agency who can declare that there is an emergency of national interest. The issue is national interest.

And that power to — of declaration is not shared by anybody. It’s the national government. Ngayon, may mga siyudad na ayaw nilang tanggapin. You know, I’m ordering you to accept them, open the gates of your territories and allow the people — and allow the Filipino to travel wherever they want.

Iyong ano, ‘yung sequestration ng tao o lockdown should dovetail the national policy. Or better still, as not to confuse the people, you are not allowed to unilaterally declare na ganito, you are closing the entry, the egress and ingress ng tao.

Mahirap ‘yan. Magkagulo tayo, kanya-kanya kayong… So if you want a measure to be implemented in your local government unit, ask permission from the Task Force because alam mo it involves many issues.

If you want, as an adjunct of government, maghingi ka ng permiso sa Task Force. They are the better position really to assess.

Inatasan din po ng ating Pangulo ang DOH na palawakin o palakasin ang PCR testing ng ating mga probinsiya para sa ganoon ay doon na po sila sa probinsiya maghihintay ng kanilang resulta sa PCR at doon na rin sila magka-quaratine ‘no, at hindi na matengga dito sa Metro Manila.

So sabi po ng Presidente, hindi po katanggap-tanggap na napakatagal na ang inabot para sa paghintay ng resulta ng PCR. At kung hindi po natin mapapauwi itong 24,000 na nasa Maynila ngayon, eh paano pa po iyong hundreds of thousands na parating pa ‘no. So isang linggo po ang binibigay ng ating Pangulo sa mga kinauukulan, kasama na po diyan ang DOLE, ang OWWA at ang DOH.

MACALMA: Secretary, sir, klaruhin lang natin na iyong mga OFWs kahit wala pang COVID testing result ay puwede nang pabalikin ng probinsiya? Hindi na hihintayin—

SEC. ROQUE: Hindi po. Ang sabi ng Presidente, sa linggong ito ay dapat mapalabas ang resulta ng PCR testing dahil marami po diyan ay isang buwan na pong naghihintay ng resulta. Hindi na po niya aalamin kung bakit nagkaroon ng ganitong aberya, pero importante ay mapalabas ang PCR testing result at itong linggong ito ay mapauwi silang lahat – lahat po iyan – all 24,000.

MACALMA: Sabagay mabilis na po yata ang resulta, Secretary sir, three days yata o four days.

SEC. ROQUE: Dapat nga po at napakatagal nang hinihintay ng karamihan, ng ating mga kababayan diyan sa iba’t ibang hotels at saka sa mga barko po diyan sa Manila Bay.

MACALMA: At itong pag-uwi, Secretary Roque, sir, walang gastos po ang mga OFWs, sagot lahat ng gobyerno iyan?

SEC. ROQUE: Wala pong gastos ang mga OFWs, gobyerno po ang may sagot: Kung eroplano, gobyerno ang magbabayad; ganoon din po kapag bus at mga barko.

MACALMA: Mayroon pang 42,000 na parating na mga OFWs, Secretary Roque, sir, saan po sila dadalhin?

SEC. ROQUE: Iyon nga po eh, kaya nga po kinakailangan mapauwi na itong 24,000 dahil wala tayong paglalagyan diyan sa 42,000. At kung hindi magkakaroon ng kapasidad ang mga probinsiya na mag-PCR testing, lahat iyan dito sa Manila matetengga.

Kaya po itong linggo namang ito, kinagagalak ng Pangulo na na-increase by 10,000 ang ating PCR testing capacity, sa pagbubukas po ng mga PCR testing facilities sa Cebu, sa Bohol, sa Baguio, sa Iloilo at sa Davao.

MACALMA: By June 1 nga ba, Secretary, sir, ay ida-downgrade na sa GCQ ang Metro Manila?

SEC. ROQUE: Well, kung ang datos po ay magpapakita na napabagal na iyong pagdoble ng kaso ng COVID at dadamihan ang ating critical care capacity, posible po iyan. Pero hintayin po natin ang pormal na anunsiyo ng IATF.

MACALMA: Paano po, Secretary, sir, ang mga malls, mga barbershops, mga salon – bubuksan din po ba? Kailan po sila bubuksan, Secretary, sir?

SEC. Indeed, resplendent in your uniforms, in your paragons of manhood with all its connotations- officers and gentlemen.

I am really very happy for you tonight. I share your exhilaration. And I, me, I am confident that I will have soldiers, the finest from our military schools and police graduates, that you will be there to secure the Republic for all time.

All of you owe your parents so much and that is why I said you should be — I am sure you will find a way to be together even at a distance just to shorten the space. As it is mandated by law, we cannot do anything.

That is why, as you hand over your diplomas, medals or plaques to your parents as a sign of respect and filial piety, express to them in the manner you deem most appropriate, your lasting gratitude. They deserve the accolade. And I also applause for them.

Graduates, the world is changing and we have to adapt to the changes lest we lag behind. But like someone else said, “We can change in a changing world and yet cling to the unchanging values of life.”

Yes, indeed. Values like love of country, honesty, integrity, concern for the poor and the needy, adherence to the rule of law. These are values that make our society, humane, and a nation, progressive. A simple truth that is unassailable.

I suppose that all of you are imbued with these values. After all, that is what your alma mater prepared [you for]. Let it not be said by anyone later [that] in the conduct of your affairs and performance of your duty, you failed your alma mater, and wasted the efforts of your mentors. Heaven forbid. Sana huwag naman.

For indeed, that would be very sad. Keep that in mind always. The eyes of the Filipino, your fellow alumni and your alma mater are upon you wherever you may be. By your conduct, your alma mater shall be judged. So also shall be, your fellow alumni be similarly treated.

Finally, let me end [by posing] this question which I once heard. It goes thus: if those who are tasked with the maintenance of peace and order and the protection of public and private property do not do their mandate or worse, commit that which they are called upon to prevent or guard against. Again, I said the question be: what then?

Sino’ng tutulong ng bayan? Who will carry the liberty? Who will carry our independence? Who will carry the constitutional duty of due process, fair play? These are the things which you have to worry.

For after all, your Magna Carta, and for all of us is the Constitution of the Republic of the Philippines. Remain true to that sacred document and remain as ever loyal to the Filipino flag.

Graduates, that is both a question and a challenge that beg for a response – your response. Think it over. You have all the time to do that. Thereafter, act accordingly.
