Pati KURYENTE ng Pilipinas! Chinese pala ang Chairman ng NGCP kahit minority share stockholder lang!

Sa gitna ng masusing Congressional inquiry, naging sentro ng talakayan ang National Grid Corporation of the Philippines (NGCP). Ayon kay Cong. Jay-Jay Suarez, may 40% Chinese ownership ang NGCP. Ayon sa kanya, “40% is Chinese owned”.

Chinese ang Chairman ng NGCP!

Isa sa kanyang malaking tanong ay kung paano naging chairman ang isang minority shareholder. Sinabi niya, “Often times the majority uh shareholders would be able to elect their chairman. How is it here in NGCP a minority share was able to hold chairmanship of the company?”

Sumagot si Atty. Lally Mallari na nasa kapangyarihan ng board of directors ang maghalal ng chairman. Ayon sa kanya, “The board of directors can indeed elect who they want to be the chairman of the corporation.”

Ngunit hindi ito kinatigan ni Cong. Suarez, na nagsabing “Now isn’t it quite ironic that a minimum share a a a minority shareholder will hold the highest position in the company”.

Ipinahiwatig niya na taliwas ito sa normal na sistema kung saan ang mayoryang shareholders ang nag-e-elect ng chairman.

Transparency Minutes

Bilang hakbang para mas maunawaan ang proseso ng eleksyon, hiniling ni Cong. Suarez ang minutes ng meeting ng board of directors. Sinabi niya, “Can I also…request Mr. Chair the minutes of the elections of how the board conducted uh themselves Mr. Chair so move Mr. Chairman.”

Ipinaliwanag ni Atty. Mallari na ang halalan ay nakabatay sa kasunduan ng mga miyembro ng board. Ayon sa kanya, “This depends on the agreement amongst the members of the board of directors.”

Hindi pa rin kontento si Cong. Suarez at idiniin na kailangan makita ang mga detalye ng halalan. Aniya, “Can we just ask for the minutes of how the elections was conducted among the board of directors and the officers of NGCP just so that we can get the feel of how it transpired?”

Sumang-ayon naman si Atty. Mallari sa pagsumite ng requested documents. Sinabi niya, “Will submit the minutes as requested by this committee.”

Ang Papel ng Chinese!

Isa pang kontrobersyal na usapin ang papel ni Wen Bo, Chief Technical Officer ng NGCP, sa pagbili ng lupa para sa isang proyekto. Ayon kay Cong. Suarez, “I have documents here from NGCP addressed to the president of the company from their Chief Technical Officer Mr. whose name is Wen Bo.”

Ang dokumento ay may kaugnayan sa pagbili ng lupa para sa isang transmission line project: “The subject of the document is request for approval of authority to purchase lands and land rights using the preferred valuations for EB Magalona Bakod for a 230-kilowatt transmission line project.”

Pinuna ni Cong. Suarez ang sitwasyon kung saan isang Chinese national ang gumagawa ng mahalagang desisyon para sa isang utility company na napakahalaga sa Pilipinas.

Ayon sa kanya, “It leaves a very bad taste in the mouth that even to decisions of this nature in a company running basic utilities in our country such decisions have to be made by a Chinese national as chairman.”

Sinabi ni Atty. Mallari na pumasok siya sa NGCP noong 2019, ngunit ang dokumento ay mula pa noong 2014, ayon kay Cong. Suarez. Idiniin niya ang kanyang pagkabahala, “We find ourselves in a very peculiar situation right now where sovereignty is a very uh sensitive topic in our country right now… Are they even deciding certain decisions that should be left for Filipinos to decide?”

Mga Pangunahing Isyu

  • Kontrol ng Minorya: Bakit hawak ng isang minority shareholder (Chinese) ang pinakamataas na posisyon sa NGCP?
  • Transparency: Hiniling ang minutes ng halalan ng board upang malaman ang proseso.

Kinuwesyon ni Marcoleta ang legislative purpose ng hearing ni Caraps Paduano

Mataas na Kahoy Issue

Planong talakayin ng Committee On Public Accounts ang alegasyon ng maling paggamit ng public funds at iregularidad sa Mataas na Kahoy, Batangas. Ang hearing ay nag-ugat sa reklamong isinampa ng isang citizen’s coalition laban sa alkalde at bise alkalde ng bayan, partikular sa P5 milyong cash deficit at mga kaduda-dudang gastusin para sa COVID-19 response.

Ano ang Layunin ng Hearing?

Sa simula pa lang ng hearing, nagkaroon ng malalim agad na diskusyon hinggil sa legislative purpose ng hearing. Si Cong. Rodante Marcoleta ang nanguna sa argumento, binigyang-diin ang kahalagahan ng malinaw na layunin bago mag-imbestiga.

Sabi niya: “Kailangan pong meron tayong contemplated legislative purpose.” Pinunto rin niya na hindi dapat unahin ang imbestigasyon kung wala pang layunin, gamit ang salitang: “Hwag natin pong ilagay yung Kalesa na nauuna po sa kabayo.”

Dagdag niya, kung walang malinaw na layunin, “…baka kung saan-saan po tayo mapunta.”

Binanggit ni Marcoleta ang kaso ng – – – vs. Senate, na nagtatakda ng dalawang requirements para sa valid na legislative inquiry: dapat may layunin at malinaw na saklaw ng mga tanong.

Ang Salungat na Pananaw nina Jinky Luistro at Caraps Paduano

Si Cong. Jinky Luistro, bagamat nirerespeto si Marcoleta, ay tumutol sa pananaw nito. Ayon sa kanya, hindi kailangang may umiiral na panukalang batas para maglunsad ng imbestigasyon.

Sinabi niya: “…the case cited by Congressman Marcoleta did not require Congress to have an existing or proposed legislation before we could conduct investigations in aid of legislation.”

Idinagdag pa niya na ang naturang isyu ay dapat na dinala muna sa Committee on Rules bago pa man ito napunta sa kasalukuyang komite.

Samantala, iginiit naman ni Caraps Paduano, chairman ng committee, na ang hearing ay may layunin: ang amyendahan ang Republic Act 3019 (Anti-Graft and Corrupt Practices Act). Ipinaliwanag niya: “Uh the very essence and the very heart on filing this resolution was based on the legislative intent on amending Republic Act 3019.”

Binigyang-diin din niya ang kapangyarihan ng komite na mag-monitor, mag-imbestiga, at mag-subpoena: “The power that was given to us by this Congress is to monitor and to conduct hearings and investigations… and subpoena witnesses and documents.”

Paglilinaw at Mga Pahayag mula kay Cong. Acop

Nagbigay din ng pananaw si Cong. Romeo Acop, na binigyang-liwanag ang pagkakaiba ng legislative inquiries at judicial proceedings. Ayon sa kanya, layunin ng mga inquiry na mangalap ng impormasyon para makabuo ng mas epektibong batas.

Dagdag niya: “…even if an inquiry does not result in potential legislation, there is still a need for the legislative body to gather information and data to guide legislators.”

Pahayag ni Cong. Kit Flores

Naniniwala siya na dapat humantong sa paggawa ng batas ang imbestigasyon, kaya’t sinasang-ayunan niya ang layunin ng kasalukuyang imbestigasyon para magbunga ng posibleng batas.

Sumasang-ayon siya kay Marcoleta na dapat may layuning pambatasan ang isang imbestigasyon, ngunit binanggit din niya na ang usapin ay dapat diniretso sa Committee on Rules.

Nilinaw ni Flores na ang kasong binanggit ni Marcoleta ay hindi nangangailangan na may umiiral o ipinanukalang batas bago magsagawa ng imbestigasyon.

Sana ay Mawasto ang Ginagawa ng mga Mambabatas

Ang mainit na diskusyong ito ay nagpapakita ng kahalagahan ng accountability at transparency sa pamahalaan. May Kakaibang Natagpuan sa Dagat

Noong ika-30 ng Disyembre, alas-sais ng umaga, naglayag sina Rodney Valenzuela at ang kanyang mga kasama mula sa San Pascual, Masbate, upang maghatid ng isda. Habang nasa karagatan, napansin nila ang tila isang bagay na palutang-lutang. Ayon kay Valenzuela:

“December 30 po ah 6 ng umaga mag-deliver po kami ng isda papuntang sasal bay… nadaanan po namin yung kala ko po ay ano lang, boya lang na ginagamit ng mga mangingisda bilang tanda. Nalapitan na namin nakita ko po na may malaki palang katawan kaya binalikan ko po.”

Sa simula, inakala nilang ito ay isang simpleng ‘boya’. Ngunit nang kanilang lapitan, nakita nilang may antena at kakaibang estruktura. “Nakalutang po ay yung ano lang dulo na kulay pula itong itong pinaka parang antena po ah may antena siya,” dagdag pa ni Valenzuela.

Takot sa Natuklasang Drone

Matapos nilang hilahin ang drone, nagdulot ito ng takot sa mga mangingisda. Isa sa kanyang kasama ang nagsabi: “Sabi ng kasama ko ano bomba pala….”

Sa kabila ng pangamba, itinuloy nila ang pagbuhat sa drone. Ayon kay Valenzuela, mahigit isang tonelada ang bigat nito: “Mabigat mga mahigit 1,000 kilo.”

Sinabi rin niya na nag-ingat siya sa paghawak nito, lalo na sa antena, na maaaring mag-trigger umano ng pagsabog. “Ah takot nga ako sir eh… Saan ka lang? Dun lang sa puno… Oo yung sa palikpik niya dun ako humawak,” dagdag niya.

Pagturn-Over ng Drone sa Philippine Navy

Ang drone ay dinala ng grupo sa pampang ngunit hindi agad na-report. Ayon kay Valenzuela, naiwan siya sa bahay habang ang kanyang mga kasama ang nagtuloy upang magbenta ng isda. Kalaunan, nai-turn over ito sa Philippine Navy.

Sinabi ni Police Colonel Bevel na maingat nilang itinurn-over ang drone sa Navy. “Upon the receipt of the information… walang gagalaw because I’m going to coordinate with the Regional operation division for the expertise of an EOD,” ani Bevel.

Pahayag ni Senator Tolentino

Sa imbestigasyon, tinanong ni Senador Francis Tolentino ang mga mangingisda tungkol sa natagpuan nilang drone. Ayon sa kanya, mahalagang maunawaan ang pagkakakilanlan ng drone. “May nakita ba kayong mga markings? May tunog ba kayong narinig mula rito?” tanong niya.

Idiniin ni Tolentino na ang transparency at kooperasyon ng mga mangingisda ay mahalaga sa pagsisiyasat.

Ano nga ba ang Drone?

Ayon kay General Jonathan Cabal, hindi ito isang pangkaraniwang drone. “It is military-grade or scientific in nature,” paliwanag niya. May markang “HY-119” ang drone, na nagpapahiwatig ng koneksyon nito sa Chinese surveillance systems.

Dagdag pa ni Cabal, mayroon nang naitalang mga insidente ng ganitong klaseng drone sa ibang bahagi ng rehiyon. “Similar incidents have occurred, including one in Indonesia,” aniya.

Iba Pang Detalye:

  • Ang drone ay may haba na dalawang metro, may mga palikpik, at may antenna.
  • Hindi ito itinuturing na armas ngunit pinaniniwalaang ginagamit para sa surveillance.
  • May mga naitalang naunang insidente ng pagkakarekober ng mga katulad na drone, kabilang ang isang insidente sa Catanduanes.
  • Ang mga lugar kung saan natagpuan ang mga underwater drones ay nautical highways o choke points na mahalaga sa maritime traffic.

Apat na Taon Termino, Tatlong Sunod na Panunungkulan

Sa pinakahuling sesyon ng Senado, opisyal na inaprubahan ang Senate Bill No. 2816, na magtatakda ng apat na taon bilang termino ng panunungkulan para sa mga opisyal ng barangay at Sangguniang Kabataan (SK). Layunin ng batas na ito na bigyang-diin ang katatagan at tuloy-tuloy na pamamahala sa lokal na antas.

Ayon sa batas, ang mga opisyal ng barangay ay maaaring magsilbi ng tatlong sunod-sunod na termino. Ang susunod na Barangay at SK Elections (BSKE) ay itinakda sa unang Lunes ng Oktubre 2027.

Paliwanag ni Sen. Imee Marcos

Bilang pangunahing tagapagtaguyod ng panukalang batas, agad na nilinaw ni Sen. Imee Marcos ang kalituhan hinggil sa bersyon ng panukala. Aniya, “to dispel the Uh confusion and the misleading copy That’s uploaded on our website…” na nagsasabing anim na taon ang termino.

Ipinaliwanag niya na nagkasundo sila sa apat na taon. “The third reading copy contains four years—what was approved and adopted during the period of amendments and approved on second reading,” dagdag pa niya.

Inihayag din ni Sen. Marcos na ang mas mahabang termino ay magbibigay ng mas malalim na pag-unawa sa mga opisyal ng barangay at SK sa mga isyung lokal at pambansa.

Sinabi niya, “With the longer fixed term, the barangay officials and members of the SK will deepen their understanding of both national and local issues, as well as implement their own medium and long-term initiative at the barangay level.”

Suporta ng Iba pang Senador

Sen. Robinhood Padilla
Nagbigay-diin si Sen. Padilla sa limitasyon ng tatlong taong termino na hindi sapat para sa mga opisyal. Aniya, “Hindi po talaga sapat ang tatlong taon upang maisagawa ng mga lokal na opisyal ang kanilang mga inilatag na plataporma at mga ninanais na programa.” Idinagdag pa niya na ang mga natitipid sa hindi madalas na halalan ay maaaring ilaan sa mas mahahalagang programa.

Sen. Jinggoy Estrada
Sumang-ayon si Sen. Estrada sa kahalagahan ng tuloy-tuloy na implementasyon ng mga programa sa barangay. Ayon sa kanya, “This will ensure na may pagpatuloy ang mga programa at magkakaroon ng mas matatag na pamamahala ang ating mga halal na barangay officials.”

Sen. Juan Miguel Zubiri
Bilang co-author, sinabi niya, “We’ve been fighting for this measure for quite a long time.” Dagdag pa niya, nais din niyang magpasa ng hiwalay na batas para sa benepisyo ng mga barangay tanod, daycare workers, at health workers.

Sen. Bong Revilla
Pinuri ang papel ng barangay bilang pangunahing yunit ng pamahalaan. Sinabi niya, “Ang barangay ang tulay para mas mabilis at matiwasay ang daloy ng mga programa ng ating pamahalaan diretso sa mga mamamayan.”

Binanggit niya ang kahalagahan ng batas sa pagpapalakas ng mga lider kabataan. “The bill ensures that the Sangguniang Kabataan continues to play a vital component of youth representation as this will also ensure the opportunity to empower young leaders and encourage civic engagement.”

Jinggoy Estrada wawakasan ang VivaMax sa paggawa ng mga bastos na pelikula!

Ang Vivamax, isang kilalang streaming platform sa Pilipinas, ay kasalukuyang nasa sentro ng kontrobersiya dahil sa pagkalat ng mga malaswa at eksplisitong nilalaman na madaling ma-access kahit ng mga menor de edad. Sa privilege speech ni Senador Jinggoy Estrada sa Senado, kanyang ipinahayag ang matinding pagkabahala sa problemang ito.

Ang Talumpati ni Senador Jinggoy Estrada

Sa kaniyang emosyonal na talumpati, binigyang-diin ni Senador Estrada ang mga sumusunod:

  • Moral na Panganib: Ayon sa kanya, “I rise today to express my deepest concern and strongest condemnation over the proliferation of and easy access to vulgar explicit and pornographic content on streaming platforms particularly on Vivamax.” Ipinunto niyang ang nilalaman ng platform ay sumasalungat sa mga moral na prinsipyo ng bansang Pilipino.
  • Eksplisitong Nilalaman: “Vivamax is inundating the digital space with films and shows filled with graphic sexual and exploitative material.” Bagamat may mga palabas itong komedya, drama, at romansa, ang “sexy contents” ang pangunahing itinatampok.
  • Panganib sa Kabataan: “This situation is even more concerning because many of these materials are easily accessible and may target younger audiences who are more susceptible to influence.” Nakababahala ang kawalan ng proteksiyon laban sa madaling akses ng kabataan sa ganitong uri ng nilalaman.
  • Paglabag sa Batas: Ipinahayag ni Estrada na malinaw na nilalabag ng Vivamax ang Article 201 ng Revised Penal Code na nagbabawal sa pagpapakalat ng malaswa o mahalay na nilalaman. “Article 201 of the Revised Penal Code prohibits the distribution exhibition or sale of content deem immoral, obscene, or indecent covering literature, films, music, artworks, performances, plays, scenes, acts, and shows.”
  • Eksploytasyon ng mga Aktor: Binanggit din niya ang mababang bayad sa mga artista, partikular sa mga kababaihan. “The content being produced is exploitative, with actors, especially women, being paid as little as 15,000 pesos per day for roles that require them to expose their bodies.”
  • Walang Pagtutuwid: Ayon sa kanya, hindi tinupad ng Vivamax ang kasunduan nito sa MTRCB na mag-regulate sa kanilang nilalaman. “Vivamax has not upheld its agreement with the MTRCB to self-regulate its content.”

Sa kaniyang paninindigan, sinabi niyang, “Nanindigan ako upang bigyan ng wakas ang ganitong uri ng kabuktutan sa ngalan ng ating mga kabataan, Pamilyang Pilipino, at ng ating Inang Bayan.”

Ang Usapan Tungkol sa “Araro”

Sa talakayan sa Senado, ginamit ni Senador Jinggoy Estrada ang salitang “araro” bilang metapora upang ilarawan ang pagpapalaganap ng malaswang nilalaman. Aniya, ang “araro” ay isang mahalagang kasangkapan sa agrikultura ngunit hindi ito dapat gamitin sa maling konteksto.

Pinasaringan niya ang ilang pelikula sa Vivamax na naglalaman ng mga eksena na malaswa ngunit isinasangkot ang simbolismo ng “araro” para gawing tila makatwiran ang kanilang tema.

Ipinunto niya na, “Ang araro ay sumisimbolo ng pagsusumikap at marangal na trabaho. Ngunit kung ito’y gagamitin para sa eksenang nagpapalaganap ng kabuktutan, nawawala ang dangal nito.” Nanawagan siya sa industriya na magpakita ng higit na responsibilidad sa paggawa ng mga pelikula na may tunay na halaga.

Ang Suporta ni Senador Joel Villanueva

Buong suporta naman ang ipinahayag ni Senador Joel Villanueva sa talumpati ni Estrada. Ani Villanueva, “Bihira po sa mga nakikita natin ngayon sa industriya ang may ganitong karakter para i-expose ang ganitong uri ng mga bagay.”

Kanyang itinanong kung sino ang dapat mag-monitor sa mga streaming platforms gaya ng Vivamax. “Well, ikinalulungkot ko pong sabihin sa inyo, Ginong Pangulo, na wala hong ahensya de gobyerno ang pwedeng mag-monitor nitong mga pinalabas nitong sa streaming platforms, lalo na po yung MTRCB.”

  • Walang Age Verification: Binanggit niya ang kawalan ng mekanismo upang matiyak ang edad ng mga user. “Streaming platforms do not have a mechanism to verify the age of their users, allowing even minors to access adult content by simply falsifying their age.”
  • Pagprotekta sa Kabataan: Kanyang ipinahayag, “Sino ho ang pupwedeng magprotekta sa ating mga kabataan na itinuturing ng ating Konstitusyon na pag-asa ng bayan?”
  • Regulasyon ng MTRCB: Sinang-ayunan niya na ang MTRCB ang nararapat na ahensya upang mag-regulate ng streaming platforms. “The MTRCB is the most appropriate agency to regulate and monitor streaming platforms.”
  • Pananagutan ng Kumpanya: Nagmungkahi siya ng pagrepaso sa mga prangkisa ng mga kumpanya. “If that’s the case, Mr. President, I’m not even thinking twice to revisit the franchises that we have given to these companies.”

Pag-Aksyon ng Senado

Nagkaisa ang mga senador na kailangang magpatupad ng mas mahigpit na regulasyon sa mga streaming platforms. Nagmungkahi sila ng mga solusyon, kabilang ang:

  • Pagpapalakas ng Mandato ng MTRCB: Isinusulong ang pagbibigay ng mas malawak na kapangyarihan sa MTRCB upang masubaybayan ang nilalaman ng online streaming platforms.
  • Mas Mahigpit na Parusa: Pinag-usapan ang pagtaas ng mga parusa sa ilalim ng Article 201 ng Revised Penal Code para sa mga lalabag.
  • Pagsusuri sa Payment Platforms: Tinalakay ang pananagutan ng payment apps gaya ng GCash at PayMaya na nagagamit ng mga menor de edad upang magbayad para sa streaming apps.

Ang Ating Pananaw

Bilang mga Pilipino, mahalaga ang pagtutulungan upang mapanatili ang moral na integridad ng ating bansa. Hindi ito usapin ng censorship kundi proteksyon para sa ating kabataan at pagpapahalaga sa ating mga tradisyon at prinsipyo.

Ang usaping ito ay sumasalamin sa pangangailangan ng mas maayos na regulasyon at responsibilidad sa industriya ng digital streaming.

Sino ang May Kontrol sa Kuryente ng Pilipinas?
Sa gitna ng Congressional hearing, sinusuri kung sino talaga ang may kontrol sa National Grid Corporation of the Philippines (NGCP). Pinapalutang ang mga isyu ng Chinese influence sa control system ng NGCP at ang epekto nito sa Philippine grid security. Mahalagang matukoy kung sapat ba ang ating sistema ng seguridad laban sa mga banta sa soberanya. Narito ang mahahalagang detalye mula sa pagdinig.

Kontrolado Ba ng Tsino ang NGCP?

Si Rep. Jinky Luistro ay nagpahayag ng matinding pagkabahala sa kontrol ng NGCP. Ayon sa kanya, 40% ng NGCP ay pag-aari ng State Grid of China Corporation, at may mga Tsino rin na nasa mahahalagang posisyon sa kumpanya. Paglipat sa Chinese IT Provider

Pinuna rin ni Luistro ang desisyon ng NGCP na lumipat mula sa Escada, isang Pilipinong IT provider, patungo sa Nar, isang kumpanyang Tsino. “I understand that prior to NGCP, the IT infrastructure is Escada, a Filipino corporation. However, upon the assumption of NGCP, they converted to Nar, which is a Chinese corporation. Now I wish to ask, what is the reason why you switch from Escada, a Filipino corporation, to Nar, a Chinese corporation?” tanong niya.

Inihambing pa niya ang sitwasyon sa isang manlilikha at gumagamit: “The creature cannot become higher than its creator.” Dagdag niya, “I believe that the one who created knows more and knows better about the system than the one using the system.”

Posibleng Banta ng Remote Control

Pinabulaanan naman ng NGCP ang isyu ng remote control. Ayon sa isang resource person, “Based on my experience and in my knowledge, our SCADA system is actually isolated, ma’am. It’s not connected to the internet, so you cannot easily remote control it.” Dagdag pa niya, “Based on our configurations of our control center, this cannot be controlled remotely through overseas, not even here.”

Gayunpaman, iginiit ni Luistro na dapat magsagawa ng ocular inspection upang personal na makita kung sino talaga ang may kontrol sa operasyon ng NGCP. “I wish to suggest, Mr. Chair, that we conduct an ocular inspection of the NGCP IT infrastructure, including the system, and perhaps we can invite experts to guide the committee members in evaluating whether this system [is] the one which really [is] in main control of the operation of the NGCP … or just equipment being used by Filipino citizens,” sabi niya.

Kahinaan ng Sistema: Puntos ni Ace Barbers

Samantala, binigyang-diin ni Rep. Ace Barbers ang kahinaan ng kasalukuyang sistema. Sinabi niya, “You power to switch it on or off is only in the hands of one or a few, therefore vulnerable.”

Nagbigay siya ng isang posibleng senaryo na maaaring pagsamantalahan ng masasamang loob. “Terrorist group … they turn it off … can they do that? That’s possible procedure,” tanong niya. Dagdag pa niya, “Can anyone just turn it off like that? … In simple analogy, it can just be turned off just like that.”

Nagpahayag din siya ng suporta sa ocular inspection at iminungkahi ang partisipasyon ng mga eksperto sa pagsusuri. Aniya, “Organize technical capabilities that can properly guide the committee in our ocular inspection.”

Ocular Inspection, Suportado ng Komite

Sa huli, bumoto ang komite para isagawa ang ocular inspection sa mga pasilidad ng NGCP. Layunin nitong matukoy kung sino ang tunay na may kontrol sa sistema ng kuryente sa bansa at kung gaano ito kasigurado laban sa posibleng banta.

Pahirap ng LTFRB sa seniors, PWD at mga estudiyante kasabwat ang APP owners inungkat ni Raffy Tulfo

Mainit ang naging talakayan sa hearing ukol sa mga reklamo laban sa mga Transport Network Companies (TNCs) tulad ng Grab at Angkas. Tinalakay ang mga isyu ng discounts para sa mga estudyante, PWDs, at senior citizens, pati na rin ang unfair na hatian sa surcharge fees. Narito ang mga pangunahing punto mula sa diskusyon nina Senador Raffy Tulfo, Mr. Ariel Lim, at Attorney Guadiz ng LTFRB.

Mga Hinanakit ng Pasahero at Driver

Pinuna ni Senador Raffy Tulfo ang mabagal na pagtanggap ng booking ng mga estudyante, PWDs, at senior citizens. “Bakit yung reklamo nakarating sa akin pag sila estudyante o PWD or senior ang tagal makakatanggap ng booking eh?” aniya.

Ipinahayag niya rin ang kanyang pagkadismaya sa hindi patas na sistema kung saan ang mga driver ang gumagastos sa sasakyan, gasolina, at maintenance, habang ang mga app owners ay “nakaupo lang nangungu(langot) lang and they’re making tons of money.” Dagdag pa niya, “Bakit kailangan may share ang corner ng Apps?”

Pasanin ng Discounts: Ang Tinig ng Mga Driver

Ayon kay Mr. Lim, 100% ng discount ay ikinakarga sa mga driver ng Grab: “Pinakarga na po nila sa lahat ng mga ah driver natin ng Grab no kay pin as in 100%.” Ibinahagi niya na umaabot ng 41% ng kita ng mga driver ang nawawala dahil sa discount. “Kami ang nagmamaneho ng sasakyan, sa amin ng gas, sa amin ng maintenance,” dagdag niya.

Binigyang-diin niya ang panloloko ng ilang TNCs: “Huwag sana magsinungaling.” Ayon kay Lim, malinaw sa isang memorandum circular na dapat ang TNC ang sumalo sa mga discount: “Malinaw po ah nakasaad po rito… policies and rules and regulation shall be shouldered by TNCs.”

Pag-amin ng LTFRB at Planong Solusyon

Inamin ni Atty. Guadiz na nagkaroon ng kakulangan ang LTFRB sa detalye ng kanilang memorandum circular: “Wala nakalagay lang doon driver… It was an oversight… isa pong malaking paumanhin.”

Ipinahayag niya na nagda-draft na ang LTFRB ng bagong memorandum circular kung saan ang TNCs at app owners ang sasalo sa discounts. “We’re now drafting a memorandum circular… wherein all of the discounts will now be shouldered by the TNC operator and by the owner of the app.”

Tungkol naman sa surcharge fees, nilinaw niya na 80% ang napupunta sa driver at 20% sa TNC. Ngunit, tiniyak niyang mino-monitor ito para maiwasan ang abuso.

Mga Diskwento at Surcharge ng mga TNC: Paano Ito Nahahati?

Sa pagdinig na isinagawa, napag-usapan ang porsyento ng mga diskwentong binibigay sa mga senior citizens, estudyante, at PWDs, at kung paano ito pinangangasiwaan ng iba’t ibang transport network companies (TNCs).

Narito ang breakdown ng mga porsyento:

  • Grab: Ang operator ang sumasagot sa 60% ng diskwento, habang ang Grab ay sumasagot sa 40%. Gayunpaman, nabanggit sa pagdinig na sinisingil ng Grab ang mga driver para sa buong 100% ng diskwento.
  • Joy Ride: Ang operator ang sumasagot sa 80% ng diskwento, at ang Joy Ride ay sumasagot sa 20%.

Ayon sa mga mapagkukunan, 80% ng surcharge fee ay napupunta sa driver, habang ang 20% ay napupunta sa TNC. Ang hatiang 80/20 na ito ay karaniwang sinusunod ng karamihan sa malalaking TNCs.

Ang 20% na napupunta sa TNC ay ginagamit upang pondohan ang operasyon ng kumpanya, kabilang ang maintenance ng kanilang IT systems. Bahagi rin nito ang mga benepisyo ng driver tulad ng insurance at social security payments.

Debate ni Richard Gomez at Erwin Tulfo tungkol mga drugraid na ginagawa ng pulis na kasama ang media

Sa isang privilege speech, ipinanukala ni Erwin Tulfo na amyendahan ang Section 21 ng Republic Act No. 9165 upang alisin ang media representatives bilang signatories sa inventory ng mga nakumpiskang droga.

“Ang pagsama ng media sa ganitong operasyon ay delikado para sa kanilang kaligtasan at ng kanilang pamilya,” ani Tulfo. Dagdag pa niya, nakakaapekto rin ito sa pagiging independent ng mga mamamahayag.

Ayon sa kanya, mas mainam na ang Department of Justice (DOJ) at Barangay officials na lang ang magbigay ng testimonya, kasabay ng paggamit ng video documentation para sa transparency.

Richard Gomez: Mabilisang Aksyon ang Kailangan
Nang magbigay ng interpellation si Richard Gomez, agad niyang tinanong kung miyembro si Tulfo ng anti-drugs committee. Sinagot ito ni Tulfo na hindi siya bahagi ng komiteng iyon, ngunit miyembro ng deputy majority group.

Binigyang-diin ni Gomez na ang Section 21 ng RA 9165 ay naamyendahan na sa nakaraang Kongreso at kasalukuyan muling inaamyendahan ngayon. “Marami pang batas na kailangang ma-review at inaabangan na ito ng publiko,” ani Gomez.

Ipinunto rin niya na natapos na ng House of Representatives ang bahagi nila sa pag-amyenda ng batas at ito’y nasa Senado na. Nangako siyang ipaabot ang panukala ni Tulfo sa Senado.

Nagkasundo sina Tulfo at Gomez na kinakailangang alisin ang media representatives sa delikadong tungkulin bilang signatories sa drug operations. Pareho nilang hinimok ang Senado na pabilisin ang pagpasa ng amyenda upang maisabatas ito.

Ayon sa mga mambabatas, “media practitioners civilians are place in potentially life-threatening situations when required to participate in such operations exposing them to this risk compromises not only the safety but also that of their families.”

Sagutan ni Efren Reyes Jr vs Romeo Acop sa batas tungkol sa baril

Sa isang pagdinig kamakailan sa Kongreso, tinalakay ang mga panukalang pagbabago sa Republic Act No. 10591, na nagreregula sa mga baril sa bansa. Nagtipon ang mga mambabatas, grupo ng shooters, at mga responsableng may-ari ng baril upang talakayin ang mga isyung lubos na nakaapekto sa larangan ng competitive shooting sa Pilipinas.

Mga Pagbabago sa Batas ng Baril
Narito ang ilan sa mga problemang itinampok sa diskusyon:

  1. Permit sa Pagdadala ng Baril
    Dati, ang permit para sa pagdadala ng baril ay may bisa mula anim na buwan hanggang isang taon, na nagpapahintulot sa shooters na magdala ng baril sa lahat ng firing range para sa ensayo at kumpetisyon. Ngayon, limang araw na lang ang itinatagal nito kada kumpetisyon, at kailangan pa ng hiwalay na permit kahit para sa ensayo.
  2. Limitasyon sa Bala
    Ang kasalukuyang batas ay naglilimita sa 500 bala para sa transportasyon—kulang na kulang ito para sa 1,000 hanggang 1,500 bala na kailangan ng mga competitive shooters bawat araw. Bagamat pinapayagan ang replenishment, abala ang isang linggong proseso para makakuha ng bagong permit, na nakakaantala sa regular na pagsasanay.
  3. Pagpapalawig ng Bisa ng Permit at Paggamit ng Rifle
    Ang Permit to Carry Firearms Outside of Residence (PTCFOR) ay kasalukuyang may bisa ng dalawang taon, pero iminungkahi na gawing limang taon ito nang hindi masyadong tataas ang bayad. Isa pang mungkahi ay payagan ang transportasyon ng rifles tulad ng 5.56 at 7.62 caliber para sa mga pagsasanay.
  4. Edukasyon at Kaligtasan sa Paggamit ng Baril
    Ang bawat aplikante ng lisensya ay kailangang dumaan sa gun safety seminar. Iminungkahi din na ituloy ang mga ganitong klase habang hinaharap ang mga hamon sa proseso.

Ang Debate nina Acop at Reyes
Isa sa mga tampok ng pagdinig ay ang mainit na diskusyon sa pagitan nina Rep. Romeo Acop at Efren Reyes, kinatawan ng Philippine shooters.

Ngunit nilinaw ni Reyes na hindi lang ito tungkol sa pagpapanatili ng tagumpay kundi sa pagbibigay ng mas maraming pagkakataon para sa iba pang shooters na magtagumpay.

Mga Mungkahing Solusyon sa Panukala
Ang mga mungkahi para sa pagbabago ng batas ay nakatuon sa mga sumusunod:

  • Itaas ang limitasyon ng bala para sa transportasyon.
  • Palawigin ang bisa ng PTCFOR sa limang taon.
  • Gawing mas simple ang proseso ng pagkuha ng permit para sa baril at bala.
  • Payagan ang rifles para sa pagsasanay.

Si Morica Jola Cruz ay halimbawa ng pagsusumikap at pagtatagumpay sa buhay. Marami sa atin ang nangangarap na magkaroon ng sariling negosyo, ngunit madalas ay nakatago sa ating mga isipan ang mga sagabal na nagpapahina sa ating mga pangarap. Duterte’s Absence Sparks Controversy at House Drug War Hearings

Former President Rodrigo Duterte missed Tuesday’s House quad committee hearing on alleged extrajudicial killings during his administration’s drug war, despite his recent statement that he wouldn’t hesitate to appear before House lawmakers.

During the hearing, a letter from Duterte’s lawyer, Atty. Martin Delgra III, was read, explaining that Duterte was “not feeling well” and “in need of much rest.” However, Delgra assured the committee that Duterte is “willing to appear” at a later date, “preferably after November 1.”

Abang Lingkod party-list Rep. Joseph Stephen Paduano, one of the hearing co-chairs, raised questions about Duterte’s absence.

“There is no authority coming from the former President that he will be represented by Atty. Martin Delgra, and at the same time, no medical certificate confirming that indeed the former President will be excused in today’s hearing because of his medical situation,” Paduano said.

Previously, the quad committee had required former Pag-IBIG Fund trustee Mylah Roque—the wife of former Duterte spokesperson Harry Roque—to submit a medical certificate for missing a hearing. When she didn’t provide one, she was cited in contempt.

Rep. Robert Ace Barbers, however, asked his colleagues to show some “courtesy” to Duterte and not demand a medical certificate.

“As we all know, the former President is already old and has been experiencing, based on media reports, has been sick lately, and actually had his medical check-up, I believe. In deference to the former President, I think we should afford him the courtesy that is due to him, by not requiring him to submit to this committee a medical certificate,” Barbers said.

Paduano initially disagreed, emphasizing, “We have our rules.”

“We all know he has reached that age of a fragile age. Therefore, maybe we can grant that exception to the former President,” Barbers replied, urging leniency for Duterte’s absence.

After a short suspension and discussions among House members, Paduano finally agreed to the request, though he noted the need for documentation of Delgra’s authority to represent Duterte at future hearings.

Rep. Barbers suggested that the issue might have been “an oversight” on Delgra’s part and that the lawyer should attend the next session to officially represent Duterte.

Meanwhile, another lawmaker questioned if the committee was giving Duterte “special treatment.”

“Are we giving special treatment to a witness just because he is the former President?” asked Manila 6th District Rep. Bienvenido Abante Jr.

Rep. Barbers argued that it wasn’t special treatment but rather a sign of respect, urging the committee to “extend a little bit of the courtesy due to him.”

Santa Rosa, Laguna Rep. Dan Fernandez pointed out that House rules only allow two postponements without “justifiable cause.”

He added, “We have to apply the rules of this committee to all or to none at all.”

ACT Teachers Party List Rep. France Castro also criticized Duterte, calling him a “pusit,” or squid—a term she has previously used for his daughter, Vice President Sara Duterte, describing it as a tactic to avoid accountability.

“Parang nagagayahan lang ang mag-amang Duterte. Ang daming sinasabi ‘pag hindi under oath o wala sa tamang lugar. Pero kapag pinatawag na sa pormal na pagdinig, nag-uugaling pusit na pareho at ang daming rason para huwag dumalo at sagutin ang mga katanungan natin,” Castro said.

(It is like the father and daughter are copying each other. They have so many comments when not under oath or in a different setting, but when invited to a formal hearing, they act like squids with plenty of reasons not to come and answer our questions.)

She argued that if Duterte skips the next hearing, he should be cited in contempt according to House rules.

Gabriela Party List Rep. Arlene Brosas and Kabataan Party List Rep. Raoul Manuel also voiced their disapproval of Duterte’s absence.

“By refusing to participate, the former President is hindering the people’s right to know and denying them the opportunity to seek justice for the crimes committed during his term,” Brosas said.

“Pare-pareho silang hindi marunong humarap at managot. Ang mga taong hindi kayang umako ng responsibilidad ay hindi kailanman dapat maupo sa gobyerno,” Manuel added.

(Both of them are averse to facing issues and being held accountable. Those who cannot take responsibility should not be in government.)

In an unexpected twist, some lawmakers, including former Sen. Leila de Lima, extended “get well” wishes to Duterte, hoping he would recover to “face the music.”

“I hope he gets well na, so he would have health to face the music,” said de Lima, a vocal critic of Duterte, in an interview at the hearing.

“Kay Ginoong Duterte, sana gumaling na kayo. Magpagaling po kayo, para mayroon kang lakas na harapin ang lahat,” De Lima added.

Rep. Abante also acknowledged Duterte’s statement about being ready to face lawmakers.

“Sana po makapunta kayo sa susunod na hearing. Sana po samahan ka ng ibang invited personalities na nagtatago pa rin. Sana po sa pagpunta niyo rito, maraming mga katanungan ang maaari ninyong sagutin,” he said.

“Alam naman nating siya ay nasa edad na mahina na. Kaya, baka pwede nating ibigay ang exemption na ito sa dating Pangulo,” sagot ni Barbers, habang nananawagan ng konsiderasyon sa pagliban ni Duterte.

Matapos ang isang maikling suspensyon at mga pag-uusap ng mga mambabatas, sumang-ayon si Paduano sa kahilingan, ngunit binigyang-diin ang pangangailangang magkaroon ng dokumentasyon ng awtoridad ni Delgra upang kumatawan kay Duterte sa mga susunod na pagdinig.

Binigyang-diin naman ni Santa Rosa, Laguna Rep. Dan Fernandez ang mga alituntunin ng Kamara, na nagsasaad na ang mga saksi ay pinapayagan lamang ng dalawang postponements nang walang “makatarungang dahilan.”

Dagdag pa niya, “Dapat nating ipatupad ang mga alituntunin ng komiteng ito sa lahat o wala.”

Samantala, inakusahan naman ni ACT Teachers Party List Rep. France Castro si Duterte, at tinawag siyang “pusit,” isang tawag na ginamit na rin niya sa anak nito na si Pangalawang Pangulo Sara Duterte, na nagpapakita ng taktika upang maiwasan ang pananagutan.

“Parang nagagayahan lang ang mag-amang Duterte. Ang daming sinasabi ‘pag hindi under oath o wala sa tamang lugar. Pero kapag pinatawag na sa pormal na pagdinig, nag-uugaling pusit na pareho at ang daming rason para huwag dumalo at sagutin ang mga katanungan natin,” ani Castro.

Iginiit niya na kung hindi dadalo si Duterte sa susunod na pagdinig, dapat siyang i-contempt ayon sa mga alituntunin ng Kamara.

Kinondena rin nina Gabriela Party List Rep. Arlene Brosas at Kabataan Party List Rep. Raoul Manuel ang pagliban ni Duterte.

“Sa hindi niya pakikilahok, hinahadlangan ng dating Pangulo ang karapatan ng tao na malaman at ikinakaila sa kanila ang pagkakataong maghanap ng hustisya para sa mga krimeng naganap sa kanyang termino,” ani Brosas.

“Pare-pareho silang hindi marunong humarap at managot. Ang mga taong hindi kayang umako ng responsibilidad ay hindi kailanman dapat maupo sa gobyerno,” dagdag pa ni Manuel.

Nagbigay naman ng “get well” wishes ang ilang mambabatas, kabilang si dating Senador Leila de Lima, na umaasang gagaling si Duterte upang “harapin ang musika.”

“I hope he gets well na, so he would have health to face the music,” sabi ni de Lima, isang kilalang kritiko ni Duterte, sa isang panayam sa pagdinig.

Rep. Dan Fernandez and Rep. Benny Abante Accused of Pushing Ex-Police Chief to Validate Drug War Rewards

A former city police chief has accused Rep. Dan Fernandez (Lone District, Sta. Rosa, Laguna) of pushing him to back claims about a reward system in the country’s drug war.

In the ongoing Senate inquiry into the drug war, ex-Mandaluyong City Police Chief Colonel Hector Grijaldo shared that Fernandez and Rep. Bienvenido Abante (Chair of the House Committee on Human Rights, Manila, 6th District) met with him and lawyers representing retired colonel Royina Garma on October 22—the same day a House Quad Comm panel was set to convene.

“Dan Fernandez put the paper he was holding on the table and told me, ‘Ito ang sasabihin mong statement na ito’, while pointing on the paragraph on the paper, ‘Ito ang supplemental affidavit ni Colonel Garma, sabihin mong alam mo ang reward system. I-confirm mo lang’,” Grijaldo explained.

(Dan Fernandez put the paper he was holding on the table and told me, ‘This is the statement you will say,’ while pointing to a paragraph on the paper, ‘This is the supplemental affidavit of Colonel Garma; tell them you know about the reward system. Just confirm it.’)

Grijaldo clarified that he didn’t actually know anything about this alleged reward system.

In response to the accusation, Fernandez called it untrue. While he did admit he had spoken with Grijaldo, he explained that it was only because Garma’s lawyers said Grijaldo was aware of the reward system.

“We never ask him to sign any affidavit, we ask him if have any knowledge about what Col. Garma talked about,” Fernandez stated.

Abante also disputed the claim, denying any pressure to sign affidavits.

Initially, Abante said he hoped the Senate probe on the drug war would be objective and fair, but after the recent hearing, he expressed concerns over impartiality.

“It is clear from the conduct of the Senate hearing that a conflict of interest exists and compromises the Senate’s ability to hold fair and impartial proceedings. Senators can either be subjects of the hearing or can be involved in conducting it—they cannot be both,” Abante stated.

Meanwhile, the House investigation has led to major revelations, with names like former President Rodrigo Duterte, Sen. Bato dela Rosa, and Sen. Bong Go coming up. Garma even implicated Duterte, saying he promised police officers rewards for killing suspects under the drug war policy.

Despite the House hearings, Duterte chose to appear before the Senate, where allies Go and Dela Rosa were also present.

Nilinaw naman ni Grijaldo na wala siyang personal na kaalaman ukol sa nasabing reward system.

Bilang tugon sa akusasyon, tinawag ni Fernandez na kasinungalingan ito. Inamin niyang kinausap niya si Grijaldo ngunit paliwanag niya, ginawa niya iyon dahil sinabi ng mga abogado ni Garma na may kaalaman ang dating hepe ng pulisya tungkol sa reward system.

Itinanggi rin ni Abante ang akusasyon at sinabing hindi niya pinilit ang sinuman na pumirma ng affidavit.

Fernandez, Abante strongly denied any harassment to Grijaldo

In a press briefing on Tuesday, Quad Committee chairpersons Santa Rosa City Rep. Dan Fernandez and Manila Rep. Bienvenido Abante Jr. discussed the recent Senate hearing statements and allegations about extrajudicial killings (EJKs) during the Duterte administration.

Fernandez strongly denied allegations of pressure or harassment linked to the sworn testimony of Police Col. Hector Grijaldo at the Senate hearing.

He explained that these actions “never happened” and clarified that the meeting mentioned in the testimony was held at the request of retired Col. Royina Garma.

“Unang-una, talagang there was an incident na talagang pinatawag namin siya pero not on our own volition. Because it was Col. Garma as what I am saying sa mga interviews sa akin that asked na kausapin si Col. Grijaldo,” Fernandez clarified.

He further explained that the meeting was part of a vetting process and involved other participants, including Abante and two of Garma’s lawyers, to ensure transparency.

“Kasi vetting process pa lamang yun. Alam mo sa Kongreso, kinakausap muna namin and then kapag nalaman namin na pwede nating i-validate yung sinasabi niya, then the lawyers will come out,” he said.

Fernandez also mentioned his surprise at Grijaldo’s presence, noting that the Quad Committee had not formally invited him as a resource person regarding EJKs before Garma’s testimony.

“Noong bago mag-testify si Col. Garma, he was there. He was there and he wasn’t even been invited. Nagulat na lamang ako nandun siya at hindi ko siya kilala,” he said.

Fernandez expressed his hope that Grijaldo would gain clarity, emphasizing that Grijaldo’s role was only in a minor issue related to Gen. Wesley Barayuga’s case and not the primary investigation.

“Nagugulat kami na nakikisawsaw siya sa isang bagay na hindi naman siya involved,” Fernandez noted.

He suggested that the allegations were an attempt to damage his and Abante’s reputations and discredit the Quad Committee’s work, emphasizing that the meeting resulted from Garma’s request.

Fernandez also responded to former President Duterte’s statements accusing him of encouraging false testimony and threatening legal action. He reaffirmed the Quad Committee’s integrity, their dedication to transparency, and their readiness to address any legal issues.

“And if this is the way that we need to act on certain things that happened, then we will confront the issue,” Fernandez stated.

Abante also addressed the impact of Duterte’s comments, emphasizing the need for justice in EJK cases.

He highlighted Republic Act 9851, or the “Philippine Act on Crimes Against International Humanitarian Law, Genocide, and Other Crimes Against Humanity,” noting that the Quad Committee is not filing lawsuits but aims to create laws to prevent future EJKs and ensure accountability.

“Nais lang namin ang katotohanan mailabas dito para makapagpagawa kami ng mga batas na hindi na maaaring mangyari pa ang extrajudicial killings. Nag-file na nga kami ng unang-unang bill tungkol dyan na making extrajudicial killings a heinous crime,” he said.

Fernandez also stated that local courts would take charge of such cases and called on the Department of Justice (DOJ) to enforce the law effectively, in line with various international conventions on issues like genocide and children’s rights.

Abante and Fernandez, along with Surigao del Sur Rep. Robert Barbers and Abang Lingkod Partylist Rep. Joseph Stephen Paduano, lead the quad committee, which consists of the Committees on Human Rights, Public Order and Safety, Dangerous Drugs, and Public Accounts.

This committee is jointly investigating the connections and possible criminal activities involving illegal Philippine offshore gaming operators (POGOs), illegal drugs, EJKs, and human rights abuses.

Analyzing the OVP’s Safehouse Spending and Confidential Funds

The Office of the Vice President (OVP) under Vice President Sara Duterte allegedly spent P16 million in confidential and intelligence funds (CIFs) to rent 34 safehouses for just 11 days during the last quarter of 2022.

This was revealed on Thursday, October 17, during the ongoing investigation by the House Committee on Good Government and Public Accountability. The investigation, aimed at examining potential misuse of public funds, focuses on the OVP and the Department of Education (DepEd), which was also under Duterte’s leadership from June 30, 2022, to July 19, 2024.

Manila 3rd district Representative Joel Chua, who chairs the anti-corruption panel (the House’s equivalent to the Senate Blue Ribbon Committee), led the investigation.

The panel discovered that one of the safehouses rented by the OVP charged P91,000 per day. Records presented showed that the OVP spent a total of P16 million on renting 34 safehouses, with payments ranging from P250,000 to P1 million for each property between December 21 and December 31, 2022.

These payments were listed in a report submitted by the OVP to the Commission on Audit (COA) to explain the spending of P125 million in CIFs over the same 11-day period. CIFs are classified as secret funds, meaning they aren’t subject to the usual auditing procedures.

None of the OVP representatives attended the hearing, so the lawmakers directed their questions to lawyer Gloria Camora, the leader of the COA team that audited the OVP’s CIFs in 2023.

Representative Chua, surprised by the high costs, questioned why expensive properties were rented as “safehouses.” He compared the daily rate of P91,000 paid by the OVP to the much lower monthly rental rates in high-end areas like Bonifacio Global City (BGC) in Taguig City, which are around P90,000.

“Hindi po ba kayo nagtaka kung bakit ganoon kamahal? Wala po kayong information kung gaano kalaki ang building (safehouse)?” Chua asked. (Weren’t you surprised with the rate? Didn’t you have any information about the size of the building?)

Camora responded that the audit team had no specific details about the size or location of the rented safehouses.

After the hearing, Chua mentioned that he wished Vice President Duterte had attended the inquiry.
“Sana nga lang mag-take siya ng oath, at tsaka sana sagutin din niya yung mga katanungan (But I hope she takes an oath and actually answers the questions),” he said.

The COA had previously issued a notice of disallowance, essentially a directive to return P73.28 million out of the P125 million CIFs used by the OVP in December 2022.

The OVP justified these rental payments using receipts that were unsigned, unclear, missing names, or only had recipient signatures. Additionally, these receipts lacked supporting documents like lease agreements or relevant records.

During questioning by Antipolo City 2nd district Representative Romeo Acop, Camora said that the OVP followed the COA’s guidelines for using CIFs, including the use of these problematic receipts. Acop, a retired police brigadier general, expressed frustration that COA only relied on these documents without verifying their authenticity.

“So, walang paraan ang COA para malaman kung gawa-gawa lang ang mga acknowledgment receipts na sinubmit? (So there’s no way for COA to find out if the submitted receipts were just fabricated?)
“Would my statement be correct?” Acop asked, to which Camora replied, “Yes, Mr. Chair.”

Illegal Raid Leads to 30-Day Detention for 8 Police Officers

The House Committee on Public Order and Safety has detained eight police officers for 30 days, citing them for contempt in connection with an illegal raid on the residence of House witness Renelyn Rianzales.

The officers cited are Capt. Aaron Herrera, Master Sgt. Richie Yuayan, Staff Sgt. Henry Mago, Staff Sgt. Junar Cabalsa, and Corporals Rainier Zaballa, Allan Abdon, Wilson Bantilan, and Rene John Bartolata.

This follows the contempt citation of their superior, Lucena City police chief Lt. Col. Reynaldo Reyes, on May 28.

“We are not against the whole organization… alam ko medyo nasasaktan ka [referring to PNP Regional Director (RD) Paul Kenneth Lucas] rin sa mga sitwasyon nating ito. But we need to eradicate mga ‘bad eggs’ sa organisasyon. Ito ang nakakasira sa kapulisan. And we are dead serious in trying to do our jobs as well,” said Santa Rosa City Rep. Dan Fernandez, chairperson of the House Committee on Public Order and Safety.

The hearing is based on House Resolution 147, filed by Deputy Speaker David “Jay-Jay” Suarez of Quezon province.

The resolution calls for an investigation into violence, intimidation, and harassment against Rianzales, who is a witness in a case of alleged irregularities during the 2023 barangay elections.

The committee reviewed CCTV footage showing men exiting a vehicle and approaching Rianzales’ house.

When asked to confirm if they were the men in the footage, Herrera invoked his right against self-incrimination.

Fernandez cautioned, “Ayan ang hindi niyo dapat ginagawa sa hearing. We are just in aid of legislation. Mag da-doubt na agad kami sa mga lengguwahe mo.”

Suarez added, “You are not incriminating yourself; we are just asking questions.”

The officers involved could not provide pre-plan documentation for the supposed buy-bust operation.

“Kung ganyan ang ginagawa ng lahat ng kapulisan natin sa buong Pilipinas, mawiwindang ang mga kababayan natin dahil nag-ooperate kayo without the proper documentation being planned,” Fernandez said.

Lucas noted that the penalty for grave misconduct could lead to dismissal from service.

The police officers’ repeated attempts to use their right against self-incrimination led Abang Lingkod Party-list Rep. Joseph Stephen “Caraps” Paduano to propose they be cited in contempt for “refusing to answer relevant questions in this committee.”

The committee also discussed alleged irregularities in the 2023 Sangguniang Kabataan (SK) and barangay elections, illegal buy-bust operations by PNP Regional Office 4A officers, and other alleged misconduct by the PNP in San Pedro, Laguna.

Massage Spa Raided for Illegal ‘Extra Services’ in Pasay City

Authorities raided a massage spa in Pasay City, uncovering human trafficking and illegal “extra services,” leading to the rescue of four women and the shutdown of the establishment pending further investigation.

The spa, which operated under the guise of providing legitimate massage services, was found to be offering “extra services,” a term commonly used to refer to sexual services.

Operatives from the Pasay City Police, Pasay LGU, and DSWD conducted the raid at around 9 PM on Saturday. The spa was found to be providing additional services beyond massages.

“Meron tayong pinapasok na nagpanggap bilang isang customer at doon po natin napatunayan na meron ngang illegal na activity itong establisymento na ito.” (We sent in an undercover agent posing as a customer and confirmed that illegal activities were indeed taking place in this establishment),” said Police Colonel Samuel Pabonita, chief of Pasay Police Station.

“Talagang nakita na meron talagang hindi maganda. Naging sex den ito imbes na spa lang,” (We saw that something inappropriate was happening. It had become a sex den instead of just a spa), added Pasay City Mayor Imelda “Emy” Calixto-Rubiano.

According to Pabonita, there were about ten women and two men working at the spa. Four women were rescued.

“Wala naman kaming nakitang mga minors. Lahat sila ay nasa tamang mga edad. Ang range ng kanilang edad is from 22-28,” (We did not find any minors. All of them were of legal age, ranging from 22 to 28 years old,) said Social Welfare Officer III Leonor Loor.

Among those arrested were the receptionist and cashier of the establishment.

During the raid, authorities confiscated incriminating evidence, including a box of condoms and several cellphones.

Authorities are now on the lookout for the manager and owner of the spa, who will face charges related to human trafficking.

Additionally, it was discovered that the spa lacked the necessary business permit to operate legally.

“Nakadikit po yun sa pader ma’am kaso naglaglagan po…meron po ma’am, kasi nilalakad po ‘yan ma’am e,” (It was posted on the wall, ma’am, but it fell off… we do have it, ma’am, because we were processing it, ma’am,) said the receptionist.

Arnie Teves Released from Timor-Leste Prison

Former Negros Oriental 3rd District Congressman Arnulfo ‘Arnie’ Teves Jr. was temporarily released from Becora Prison in Dili, Timor-Leste.

Teves had been in preventive detention since his arrest in March, following a “red notice” from Interpol for his alleged involvement in the murder of former Negros Oriental Governor Roel Degamo and nine others.

Teves’ lawyer, Atty. Ferdinand Topacio, announced that Teves was released before his extradition because the extradition request from the Philippine government did not align with customary international law.

Topacio also stated that Teves’ detention was declared illegal.

Earlier, Topacio said he was informed by his counterparts in East Timor that his client was freed from temporary imprisonment because the DOJ “screwed up.”

“The request for extradition by the Philippine government was made out of time and in a manner that is not sanctioned by practice and customary international law. In other words, our government ‘screwed up’. Thus, his (Teves’) imprisonment was declared illegal,” Topacio said.

Teves still faces judicial proceedings in Timor-Leste, starting tomorrow.

Topacio, meanwhile, said his client will remain in Timor-Leste to undergo judicial proceedings, which will start on Tuesday (June 11), according to CRA Law Office and Dr. Jose Ximenez.

“He (Teves) will be present therein, together with witnesses in his favor, including former Human Rights Commissioner Wilhelm Soriano, who will be presented as an expert in human rights,” Topacio added.

He is expected to attend these proceedings with witnesses, including former Human Rights Commissioner Wilhelm Soriano, who will testify as a human rights expert.

Tortured Chinese National Rescued in Pampanga POGO Hub Crackdown

A Chinese national was rescued from a POGO hub in Pampanga following a dramatic police operation after being found detained and tortured.

In a recent high-stakes rescue operation, a Chinese national, suspected to be a victim of torture, was freed from a Philippine Offshore Gaming Operator (POGO) hub in Porac, Pampanga.

The rescue took place after the victim, locked inside a building within the POGO hub, was heard shouting for help.

Members of the Philippine National Police-Special Action Force (PNP-SAF) stationed outside the premises heard the cries and initiated the rescue.

The incident prompted an immediate response from the Presidential Anti-Organized Crime Commission (PAOCC), in coordination with PNP-SAF.

Using bolt cutters, the SAF team broke into the building and found the Chinese national on the fourth floor, in room number 4.

The building lacked electricity and was extremely hot, adding to the ordeal faced by the detainee.

Upon discovery, the victim, who showed signs of physical abuse with several bruises, revealed through an interpreter that he had been confined for several days without food.

Gilbert Cruz, the PAOCC Undersecretary, assured the victim of his safety, which elicited an emotional response from the detainee.

Following the rescue, the victim was immediately taken to a hospital for medical attention​​.

The operation highlights the ongoing issues with illegal POGO hubs in the Philippines, which have been linked to various criminal activities, including human trafficking and torture.

POGO Ties with Alice Guo and Other Local Syndicates

Senator Sherwin Gatchalian raised alarms about the deepening ties between Philippine Offshore Gaming Operators (POGOs) and local criminal syndicates, highlighting the urgent need for national security intervention.

Speaking at the Kapihan sa Senado, Gatchalian shared findings from a Senate Committee session on Women, Children, Family Relations, and Gender Equality hearing the case of suspended Bamban Mayor Alice Guo.

During the executive session, security and law enforcement agencies revealed disturbing details about the growing ties between Chinese and local criminal groups.

“After no’ng first part, kinilabutan ako dahil nga na-confirm no’ng ating mga intelligence agencies ‘yong kinakatakutan natin na lumalalim na yung ugat nitong POGO. Malalim, ibig sabihin, ‘yong kanilang impluwensya umaabot na sa mga politiko, enforcement agencies tulad ng kapulisan, Bureau of Immigration; at pangatlo, mayroon silang binanggit do’n na pati yung mga local criminal syndicates nakakasama na nila,” Gatchalian said.

“Nakakatakot ito dahil pera ng mga foreign criminal syndicates pumupunta na dito, pinopondohan nila ‘yong local criminal syndicates kaya nagsasanib-puwersa na itong mga masasamang elemento,” he added.

He emphasized the threat posed by these powerful financial connections, which could destabilize local governance and law enforcement.

Gatchalian supported Senate Deputy Minority Leader Risa Hontiveros’s call for the National Security Council to discuss these findings with President Ferdinand R. Marcos Jr. They urged for a review and a potential total ban on POGOs.

“Ang kinakatakutan ko, baka umabot sa punto na hindi na natin mako-control ang mga ito at sila na ang ko-control sa gobyerno natin kasi may mga tao na silang binabayaran,” the senator said.

Gatchalian also expressed suspicion about a recent raid on an alleged POGO hub in Porac, Pampanga. The raid detained over 100 foreigners, mostly Chinese nationals, but fell short of the expected 1,000 detainees.

The operation was prompted by reports of scams, torture, kidnapping, and sex trafficking.

Presidential Anti-Organized Crime Commission (PAOCC) spokesperson Dr. Winston John Casio admitted a possible “leak of information” might have compromised the raid.

“When the PAOCC filed the search warrant, someone tipped off the operators. So, I suspect it’s not just enforcement agencies but also the judiciary that has been compromised,” Gatchalian remarked.

“Apparently noong nag-file ng search warrant ang PAOCC, merong nag-tip dito sa mga operators. So, ang kutob ko dito hindi lang enforcement agencies, kundi pati judiciary mayroon na silang mga tao,” Gatchalian said.

This highlights a broader issue of systemic corruption aiding criminal activities.

“Marunong ding gumalaw ang mga ito para magkaroon ng mga galamay at ito ‘yong isang ebidensya na meron na silang mga tao sa mga lugar na magbibigay ng tip sa kanila,” he added.

BIFF Kumander Bayawak Arrested in Maguindanao Del Sur

Criminal Investigation and Detection Group (CIDG) recently captured Kumander Bayawak of the Bangsamoro Islamic Freedom Fighters (BIFF) in Maguindanao del Sur.

Lt. Col. Ariel Huesca, chief of the CIDG in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM), identified the suspect as 65-year-old Abunawas Ibad Damiog of Barangay Alongan, Datu Piang town.

Damiog, also known as Kumander Bayawak, aged 65, faces serious charges including murder, attempted murder, and arson, as well as violating the Anti-Terrorism Act of 2020.

A .45 caliber pistol was also seized from his possession.

“Armed with search warrants, CIDG operatives arrested Damiog near his home in Datu Piang. He was armed with a .45-caliber pistol when arrested around 1 p.m.,” Huesca said in an interview on Thursday.

He ranks as the third most wanted individual in BARMM.

Reports from various news outlets underscore the severity of Damiog’s alleged crimes.

He’s accused of involvement in an attack on Datu Piang in December 2020, which included setting fire to a police car and firing at the local Catholic Church.

Additionally, Kumander Bayawak allegedly led a BIFF assault on an Army detachment in Barangay Meta, Datu Unsay, resulting in the death of a soldier and injuries to two others.

His ties to BIFF founder Ameril Umra Kato highlight his influence within the organization.

However, Damiog surrendered to the Army’s 1st Mechanized Infantry Brigade in Ampatuan, Maguindanao Sur, in 2021, along with four other BIFF members.

This arrest demonstrates Philippine authorities’ commitment to maintaining peace and security by dismantling terrorist networks and safeguarding communities.

At present, Kumander Bayawak is detained at the CIDG-BARMM detention facility awaiting court appearance to answer the charges filed against him.

Farmer Jigger Barotolo Killed by Disguised Soldiers in Negros Occidental

On May 30, Jigger Barotolo, a farmer from Sitio Sangay, Barangay Hilub-ang, Calatrava, Negros Occidental, was shot dead.

According to some witnesses, Barotolo was summoned by “disguised soldiers” of the 79th Infantry Battalion (IB).

Police Major Wilfredo Benoman Jr., the town police chief, said Barotolo was on his way home to pasture his carabao when he was shot by two unidentified persons.

Villagers heard gunshots. Four bullet wounds killed the farmer.

The victim suffered gunshot wounds to the chest, right elbow, left leg, and waist. He was rushed to Calatrava Municipal Hospital but was declared dead on arrival.

Benoman noted that no fired bullets were recovered from the crime scene, but they suspect that a .38 caliber revolver or an improvised homemade shotgun was used by the perpetrators.

He also mentioned that Barotolo had no prior police record but had been complained about in the barangay for his behavior when drunk.

Witnesses reported seeing disguised soldiers from the 79th IB on motorcycles near the scene during the incident. A unit of the 79th IB was also patrolling in the nearby Barangay Macasilao at the time. They denied the allegations.

Also, the NPA’s Northern Negros command stated they had no involvement in the killing and condemned the act.

The New People’s Army might be employing them as scapegoats; or vice-versa.

The case is still under investigation.

This incident has stirred significant controversy and calls for justice. Barotolo’s death is part of a troubling pattern of violence against farmers in Negros Occidental.

Similar incidents, like the killings of Braulio Tobalado and Jose Caramihan, have seen communities disputing military claims that the victims were NPA members, asserting these individuals were civilians.

Michael Yang and Willie Ong’s Alleged Drug Links

A panel from the House of Representatives has issued a show-cause order to former Presidential Economic Adviser Michael Yang for failing to attend a hearing regarding a significant drug bust in Pampanga last September 2023.

Yang’s absence was noted during the House Committee on Dangerous Drugs session, led by Surigao del Norte 2nd District Rep. Robert Ace Barbers.

“(We are) seeking the former Duterte adviser because based on documents, he is an incorporator or stockholder or financier of several interlocking corporations linked to Empire 999 Realty, Inc.,” said Surigao del Norte Rep. Robert Ace Barbers, who chairs the committee.

Despite being summoned, Yang did not appear at the hearing. Instead, his lawyer, Raymond Fortun, attended on his behalf, explaining that Yang was currently abroad on a business trip in Dubai.

This prompted the committee to demand an explanation from Yang for his non-attendance.

Rep. Barbers highlighted Yang’s involvement with several interconnected corporations linked to Empire 999 Realty, Inc., suggesting potential financial ties to controversial companies Omni and Pharmally Pharmaceutical.

These companies were previously implicated in irregularities during the COVID-19 pandemic.

Before the decision to issue a show-cause order, Rep. Dan Fernandez of Santa Rosa City argued that a subpoena should be issued instead, as Yang’s lawyer had already provided a valid reason for his client’s absence.

The investigation stems from a shipment intercepted by the Bureau of Customs, National Bureau of Investigation, and the Philippine Drug Enforcement Agency, which traced the contraband to a warehouse owned by Empire 999 Realty Corporation, allegedly under the name Willy Ong.

However, Barbers revealed that “Willy Ong” is believed to be a fictitious identity.

The committee has also issued an arrest warrant for the elusive “Willy Ong,” who has been absent from hearings since last year.

Barbers stated that the authorities have no choice but to arrest Ong due to his repeated failure to appear and testify.

Further complicating the case, Barbers mentioned that the Bureau of Immigration has no records of Ong using a Philippine passport.

However, a Chinese national named Cai Quimeng, bearing a photograph identical to Ong’s, has been identified in travel documents.

“Since he consistently failed to appear before us, we have no other recourse but to issue a warrant of arrest against him,” said Barbers. “Soon as you determine his whereabouts, arrest and bring him to this Congress so we can get his side of the story.”

Estrada Alleges Alice Guo’s ‘Boyfriend’ Manages Illegal POGO Operation in Bamban

On Wednesday, Senator Jinggoy Estrada claimed that Bamban, Tarlac Mayor Alice Guo’s live-in partner, who is said to be a government official from Pangasinan, is managing illegal Philippine Offshore Gaming Operator (POGO) activities in Bamban. Guo denied this claim.

During a Senate Committee hearing on Women, Children, Family Relations, and Gender Equality, Estrada said he had received reliable information that Guo is romantically involved with a mayor from a Northern province who is running the POGO operations in Bamban.

“Wala po. Marami na silang nali-link sa ’kin simula po na buksan ang isyu. Sobrang dami nilang nili-link sa’kin pero wala po akong partner,” Guo said.

Guo suggested she knew which mayor Estrada was talking about but did not want to name anyone. She asked the senator to name the official and jokingly asked if the person linked to her was attractive.

“Kaya ko bini-bring out ito because the reports that I received is that your partner, ‘yung nali-link sayong mayor ng Pangasinan is the one managing and operating your POGO business. Wala akong pakialam sa relasyon ninyo,” the senator said.

Guo kept denying the claim, saying she does not run any POGO business.

The POGO hub mentioned is the 10-hectare compound of Zun Yuan Technology Incorporated, located in the Baofu compound behind the Bamban municipal hall. In March, this place was raided for illegal activities, including crypto and love scams.

Investigations showed documents linking Guo to the POGO business, which she also denied.

Guo said the POGO hub in Bamban was managed by Chinese nationals.

Senator Raffy Tulfo also told Guo that she is being linked to an official from an executive department.

“Your honor, hindi ko po alam. Ngayon ko lang narinig,” she answered.

Loren Legarda Grilled Mayor Alice Guo on Birth Certificate Fraud

Senator Loren Legarda questioned PSA officials about hundreds of fake birth certificates used for passports in 2023. She wanted to know if the PSA had taken action against those involved.

The Senate of the Philippines is investigating possible corruption within the Philippine Statistics Authority (PSA). They suspect a group inside the PSA is illegally providing birth certificates to foreign nationals so they can get Philippine passports.

“There were 308 fake birth certificates that you said were issued, that were used for Philippine passports, in 2023. So I would assume that the DFA (Department of Foreign Affairs) had canceled their passports. And I would assume that you had filed cases or even invalidated the fake birth certificates,” Legarda told PSA officials present during the hearing.

A lawyer for the PSA said they are investigating and taking legal action. He explained there are two types of fraud: fake documents created at PSA offices and fake information submitted to local civil registries.

“Certainly, we have determined different kinds of fraud here. The first fraud that is proliferating is the tampering on the issued documents in our PSA outlets. These are the most frequent fraudulent action. The other type of fraud is fraud at the source, which is happening at the local civil registry office,” Ambatali explained.

At the second hearing of the Senate committee on women and children about crimes related to Philippine offshore gaming operators (POGOs) Wednesday (May 22), Guo repeatedly told senators that she barely remembered her childhood because she grew up in seclusion in a farm in Tarlac.

The mayor also stuck to her earlier narrative that she was homeschooled because her father did not want her to mingle with others because she sired her with a maid.

Legarda, however, pressed Guo to disclose specific details about her childhood, such as who watched over her at the farm and if she had playmates.

“If you’re really Chinese and fronting for other people, go back to your country! But if you are Filipino and you were born here, convince us because we want to be convinced,” she said.

“Kasi parang scripted. ‘I was born in this.’ That’s all I can remember.’ Yet when I ask you the same question, it’s the same rote,” Legarda added.

“Ako po ay lumaki sa Barangay Virgen Delos Remedios, Bamban, Tarlac. Ako po ay isang Filipino, lumaki po ako kasama po ang mga empleyado namin sa farm,” Guo replied. “Thirty-eight years ago, wala po ako talagang maalala nang sobra.”

Legarda then cut Guo off, saying she repeated details she already said.

“You don’t have to say the same thing,” a visibly irked Legarda said. “Ano ba, huwag tayong robot!”

When asked to speak in Fookien, the language commonly used by Filipinos of Chinese descent, Guo complied but told senators she is Filipino.

Senator Risa Hontiveros is leading the investigation into issues related to Philippine Offshore Gaming Operators (POGOs). During the hearing, they looked into the case of Mayor Alice Leal Guo of Bamban, Tarlac.

“She claimed in the televised interview that her mother left her after she was born. But in the hearing, you admitted that there were other children and you have two more siblings. And that you learned their names are Shiela and Siemen, and you admitted that you lied in the last hearing to protect them,” Hontiveros pointed out.

Senators believe Guo may not be a Filipino citizen and might be linked to illegal activities. They found inconsistencies in her birth records and background story. Guo denied wrongdoing.

“Ipinipilit niyo na simpleng tao lang kayo. Pero ang laman ng SALN niyo, daan-daang milyong piso. Mayor Guo, pagsisinungaling pa rin po ang paglilihim ng katotohanan,” she pointed out.

“Kayo lang ang nakilala kong tao na hindi daw kilala ang kapatid, pero magkasama sa travel abroad. Nakikipag-partner sa milyun-milyong pisong negosyo na di kilala ang kasosyo. Humihiram ng kotse, pero di alam ang pangalan ng hiniraman. Nagbenta ng chopper at may utang pa sa inyo, pero di kilala ang pangalan ng sisingilin,” Hontiveros said.

Mr. President, I rise on a matter of personal and collective privilege. For the 5th time, the Philippines has received the Dirty Ashtray award. The reason is we were blocking global tobacco control efforts. When I say we, it is a great embarrassment to me, your honor, that the representatives for us, for the Philippines, stood before a global audience of mostly health advocates, and they advocated for the tobacco industry, Mr. President.

The Global Alliance for Tobacco Control again awarded the notorious Dirty Ashtray to the Philippine delegation on the last day of the 10th session of the Conference of Parties, otherwise known as COP10, to the WHO Framework Convention on Tobacco Control, otherwise known as the WHO-FCTC, held in Panama City from February 5-10. The FCTC is a treaty negotiated under the auspices of the World Health Organization created in response to the tobacco epidemic.

The treaty has 168 signatories, and 180 parties, including the Philippines. The Philippines ratified the FCTCon February 22, 2005. According to the WHO, the FCTC provides a global response to the global tobacco epidemic, it described the FCTC as an evidence-based treaty that reaffirms all people’s right to the highest standard of health. Regular sessions of the COP are held every two years.

The Philippine delegation this year was given the Dirty Ashtray award for its brazen use of tobacco industry tactics to dispute and delay throughout COP10. According to the Southeast Asian Tobacco Control Alliance, otherwise known as SEATCA, after almost 3 days of deliberation, parties failed to achieve consensus to establish an expert group to facilitate the implementation of FCTC articles 9 and 10 on the regulation and disclosure of the contents and emission of tobacco products. With the Philippines joining a minority of parties blocking consensus.

What is article 9 and article 10? Article 9 deals with the testing and measuring of the content and emission of tobacco products and regulation. My dear colleagues, mga kababayan, sino ba may ayaw na i-test at sukatin ang laman ng tobacco products? Bakit ayaw? Bakit ayaw ipa-test? Ano ba laman nun? Ayaw ipaalam sa atin. Bakit naman tayo may delegation na hinaharang ang information na makakasakit sa ating mga kabataan? Hinaharang dahil meron silang nilalagay doon na nakakasama sa kabataan. Imagine, ganun na nga ginagawa nila, dirty tactics, sinuportahan pa ng gobyernong ito. Sinama pa sila at sinuportahan pa ang mga ganitong pangyayari. Nakakahiya, Mr. President.

Now what is article 10? Article 10 deals with the disclosure of information on such contents and emissions to governmental authorities and the public. Disclosure of information. Ang nais lang naman ipaglaban ng health advocates is kayong mga tobacco product sellers, distributors, companies, ligal naman ang pagbebenta niyo.

Pinayagan naman kayo magbenta sa aming bansa, pero you must conform to regulation. You must disclose kung ano ang laman ng mga produkto niyo, para ma-regulate naman kayo. Dahil kung hindi kayo mare-regulate, paano naman ang mga kabataan, paano naman ang mga may edad na adik? Dahil nga may mga laman yan na nakakaadik at nakakasama sa katawan.

Why in the world would we send a delegation that would prevent full disclosure of harmful ingredients in tobacco products, including vapes and ecigs? Why? Because we do not have the political will to fight against these tobacco companies. Nakakahiya. It’s bad enough that these tobacco companies can get away with it, but it is even worse and unacceptable na sinasamahan pa sila, inimbita pa na sumama dito sa conference na ito. Ang sumasama dapat sa conference na ito, health advocates. Kung gusto naman ng tobacco companies na fair lang ang turing sa kanila, na makapagbenta sila, nakakapagbenta naman sila, eh. Regulation lang ang gusto natin. And sinamahan pa sila, holding hands pa sila ng ating government officials to attend this international conference. I have no words, Mr President. It is an embarrassment.

According to the reports, the Philippines proposed a compromise option that further muddled the discussion and caused more delays. My God. My Lord. bakit ba kayo pinanganak at nagdala pa ng ganyang tao sa isang health conference na manggugulo lang. With no more time left to continue deliberations, this agenda item was deferred to COP11. Every delay is a win for the tobacco companies.

Every delay is on the hands of our government officials who allowed it, who held hands with these people and allowed it and are probably cheering na na-accomplish nila yan. Babalik ko, ano ang na-accomplish nila? Ginulo nila yung mga debates, para yung simpleng requirement na ilista nila at i-submit nila yung ingredients na laman ng kanilang produkto, ibibigay nila hindi nila magawa, nanggulo pa sila. Dinelay pa nila. Dinamay pa nila yung buong mundo. Nakakahiya, Mr President.

Former health secretaries Alexander Padilla and Esperanza Cabral have said that this is alarming and the Philippine delegation should take the dishonor as a wake-up call. Hindi lang wake up call, Mr President. Ikulong na yang mga taong yan. Budget pa tayo ng budget, our Chairman of the Committee on Health is here, budget pa tayo ng budget, debate pa tayo ng debate na increase yung budget ng healthcare, but on the other hand, sabay-sabay sumasakay ng eroplano at uma-attend ng health conference para guluhin yung health conference na yan at para i-dilute yung mga provisions na makakapagbigay lang naman ng information sa ating lahat. Kaya tuloy maraming naniniwalang nakakabuti sa kanila ang vapes. Kasi, hindi naman binibigyan ng public info, hindi pinapaalam sa public kung ano ang laman niyan. At ito, harap-harapan na ipaglalaban nila na itago yung information.

Eleven former health and education officials have urged the Philippine representatives to the COP10 of the WHO FCTC to take a stand against e-cigarettes or vapes amidst an increase in use among the Filipino youth:

Alexander Padilla (DOH Undersecretary, 2001-2009), Dr. Susan Mercado (DOH Undersecretary, 1998-2001), Dr. Madeleine Valera (DOH Undersecretary, 2012-2013); and former education department officials Bro. Armin Luistro (DepEd Secretary, 2010-2016), and Atty. Alberto Muyot (Deped Undersecretary, 2010-2016)

I can only speak also for former Secretary Liling Briones because she had made statements about this in the past when I handled DepEd budget.

The Philippines received its first Dirty Ashtray award at COP4 in 2010 but at least it was redeemed the next year and received an Orchid Award at COP5 when it excluded tobacco industry representatives from its delegation. Yun lang, Mr President, bakit ka naman magdadala ng delegation ng industriyang nire-regulate doon? Bakit? Dalhin niyo sa trade conference, walang problema. Pero bat mo dadalhin sa isang health conference tapos magpapadikta ka? Yan ang ginagawa po natin, Mr President. Nakakahiya.

At COP9 in 2021, the Philippines was given three Dirty Ashtray awards. These awards are given to “companies and governments seen as peddlers of tobacco industry interests.” So the Philippines is a peddler of tobacco industry interest. Nagtaka pa ba tayo? Why would we allow it? Wala tayong ginawa kundi ipaglaban ang ating mga kababayan, ipaglaban ang mga kabataan. But we allow government officials to do this right before our very eyes. Based on the studies collated by the Inquirer, the Vape Law that was supposed to curb tobacco smoking among adults and the youth is instead leading to a spike in the use of so-called alternatives, which experts said were as harmful, if not more harmful, than tobacco.

In-depth research is showing that the law is insufficient and leading to a failure to adequately deter some tobacco and related products from ending up at the hands of young people.

This flaw is fueling a growing trend of smoking and vape addiction among Filipino youth, and it is now coined “vapedemic” or the widespread use of vape.

A study published online in the National Library of Medicine (NLM) summarized some of the warnings and worries aired by vape law critics in past years. The law, the researchers said, “not only legitimizes the use of vaping products but also lowers the age at which these can be accessed.” The vape law allows access to tobacco, vapes, and e-cigarettes to 18-year-olds, when we had already passed a law pegging the age at 21.

Despite regulations, a separate study by the Institute for Global Tobacco Control (IGTC) at Johns Hopkins Bloomberg School of Health found ongoing sales and advertising of tobacco products near many schools in the Philippines.

“There is ample evidence showing that tobacco companies employ various strategies to promote their products, aiming to attract the attention of children and young individuals”

Renowned Filipino tobacco control advocate and Southeast Asia Tobacco Control Alliance (SEATCA) Executive Director Dr. Ulysses Dorotheo had described the then-vape bill as “a retrogressive bill in more ways than one.”

I will repeat, Mr President, the Vape Law, (RA 11900) overturned 3 protective measures that this representation fought for in the Sin Tax Law (RA 11467):

Jurisdiction to regulate vapes and HTPs was transferred from FDA to DTI Lowered the minimum age of access from 21 to 18 years old Allowed more flavors instead of limiting it to plain tobacco and plain menthol

Mr President, may I ask that we show again the slide? Historically, these industries used doctors or at least actors that looked like doctors to somehow promote that some cigarettes are healthier than others. This was done I think in the 1950s, 1960s. And time and again, I kept on saying that same lang naman ang playbook nila. They will still use whether it’s doctors, meron pang dentista, nagsasalita pa sila sa mga conference na patago pero nalalaman naman natin, kino-convince ang ibang professionals na mag-shift sa vape. Hindi dapat mag-shift, dapat huwag nang manigarilyo at huwag din mag-vape.

The tobacco industry is slimy, to say the least. Thay have a track record of avoiding regulation all over the world. In 2009, we passed the FDA Law which intended to cover all tobacco products and other products that have an effect on health. The industry filed a TRO on FDA issued regulations covering tobacco. We actually won this case after 10 years. The Supreme Court ruled that tobacco products affect health and therefore is under the jurisdiction of the FDA. But of course, nag-motion for reconsideration pa ang mga tobacco companies kasi ayaw na ayaw nila magpa-regulate.

Hindi ko po kinakampihan ang FDA, marami ring pagkukulang ang FDA, but they do have the jurisdiction to regulate. Sila lang ang mga ability. Kung gusto natin galingan nila, it’s either palitan natin yung head para mas magaling o bigyan natin ng pondo para mas maganda yung trabaho. But you cannot just give this jurisdiction to DTI, which is what we did, Mr. President.

Mr. President, we have a public duty to protect public health. The loss of lives is immeasurable. The young people that may not reach their full potential because they die of tobacco and tobacco-related products, which includes vapes and ecigs, is real. We must aim to make better legislation which prepares us for the future, and we must aim to make these people who are passing on fake and downright incorrect information, and doing it in public, and protecting the tobacco companies, they must be held liable.

Senior Deputy Executive Secretary Hubert Guevarra from the Office of the President led the largest government delegation at COP10 with more than 30 officials and staff. Wow. Wow. malaman ko nga kung ano ang budget na pinadala natin sa WHO because in May, and I was a delegate to the WHO World Health Assembly, not at the expense of the Senate or the government, if I may be clear about it, but I was sponsored by WHO itself to talk about the fight that many of you have joined me with against these tobacco companies.

In my humble opinion, talagang dapat mag-attend niyan Department of Health and Department of Education, kasi yan ang nangangalaga ng kalusugan natin and kapakanan ng kabataan natin. Sila, okay. Kung may isang dadating from the Office of the President, wala naman ho akong problema. Pero among these people, kasama pa ho dyan ang mga tobacco industry representatives.

The Philippines sent the largest government delegation to the COP10. Wow. wow ganun ba tayo kayaman? Ganun ba ka importante sa atin na pagtakpan at tulungan ang tobacco industry na kailangan pa samahan ng government officials? Kaya pala magkakasakit na at mamamatay na ang kabataan natin because we don’t care. We send our government officials to protect the tobacco industry.

Madami pa akong pwedeng sabihin, Mr President. But I think I’ve said the most important issues. Sadly, the Philippines has received this Dirty Ashtray award, and two years in a row na. Ano to, buong administration, 6 years? Yan na lang ba paghahandaan ko? I would have actually attended, because I wanted to have a voice. But the way it works is the head of delegation is the only one who can speak.

And you know very well, Mr President, they will not make me the head of delegation because I would never support the tobacco industry. So I hope, my dear colleagues, you can continue to support those of us who have been standing firmly to protect our youth against the evils of the tobacco industry.

DENR Suspends Activities of Senyor Agila’s Group in Sitio Kapihan

Sen. Cynthia Villar on Wednesday prodded the Department of Environment and Natural Resources (DENR) to immediately evict nearly 3,500 members of a suspected cult who were illegally occupying a protected forest area in Socorro town, Surigao del Norte province.

Presiding over a budget hearing, Villar said the DENR should be “decisive” in acting on the issues raised against Socorro Bayanihan Services Inc. (SBSI), whose leaders were accused of forcing young girls to marry older men as well as training child soldiers.

She made the remark after Environment Undersecretary Joselin Marcus Fragada disclosed that except for one, all SBSI members occupying the area were not among the “tenured” beneficiaries or original settlers under the DENR’s 25-year land deal with the group.

Fragada was referring to the Protected Area Community-Based Resource Management Agreement, which the SBSI used to turn a 353-hectare protected land in Sitio Kapihan into its own enclave.

“Technically, the people there are not tenured. Even their [leader] is not a tenured migrant,” Fragada said, referring to SBSI president Jey Rence Quilario, also known as “Senior Agila.”

Asked if the SBSI members would be forced to leave, Fragada told Villar: “It’s an option … We leave it to the inter-agency body to make the proper decision [on] what approach should be taken.”

Upon hearing this, the senator said: “[Just an] option? It must be done.”

“You don’t give them a choice. They have to [leave] because they’re not supposed to live in a legislated protected area,” Villar stressed.

Willie Ong 3.6B Shabu Bodega

The House Committee on Dangerous Drugs chaired by Surigao del Norte Rep. Robert Ace Barbers met with government enforcement agencies to find answers on how 530 kilograms of shabu valued at P3.6-billion were confiscated from a warehouse owned by a certain “Mr. Willy Ong” in Pampanga (hindi po Doc Willie Ong na sikat sa social media, kapangalan lang).

The meeting, which was held based on House Resolution (HR) 1346 filed by Senior Deputy Speaker (SDS) Aurelio Gonzales Jr., and HR 1351 filed by Zambales Rep. Jefferson Konghun, was attended by representatives from the National Bureau of Investigation (NBI), Philippine Drug Enforcement Agency (PDEA), Department of Justice (DOJ), Bureau of Customs (BOC), and Philippine National Police (PNP).

SDS Gonzales said he filed HR 1346 to find answers on how some 700 kilograms of illegal drugs were smuggled in Pampanga. This year, the NBI Manila Task Force against illegal drugs and the PNP Mabalacat City discovered 200 kilograms of suspected shabu in an abandoned vehicle at a mall parking lot.

On September 24, 2023, a total of 530 kilograms of shabu valued at P3.6-billion were confiscated from a warehouse owned by a certain “Mr. Willy Ong.” The said warehouse is in Barangay Malino, Mexico, Pampanga.

NBI Forensic Chemist Juliet Maghilum confirmed that the substance seized was “dimethyl sulfone,” which can act as an extender or adulterant of shabu. “It only shows that there is a clandestine shabu laboratory in the Philippines right now.

And those substances that we were able to seize are going to be used in the manufacture of illegal drugs,” NBI Task Force Against Illegal Drugs (TFAID) Chief Atty. Jonathan Galicia explained.

SDS Gonzales estimated billions worth of suspected illegal drugs were confiscated and intercepted in Mabalacat City and Mexico, Pampanga from 2021 to October 4, 2023.

An executive session was held to further go into the specifics of these drug bust operations.
